Sea13.04 RIGHTS OF S[JB.TECTS OF DaTA
Subd. 1. Type of data. The righcs of individual on whom[he data is stored or to be stocsd shall be as set forth in this section.
Subd.2. Information reqirired to be givea individual. An individual asked ro supply privare or confidendal data concerning himself shall
� be informed of: (a)the purpose and intended use of the requesred data withia the collecting 3tate agency,poliacal subdivision,or stauwide system;
(b)whether he may refuse oY is legally required to supply tht requesud data;(c)any irnown consequence arising fmm his suppiying or refusing to supply
private or confidenrial data;and(d)rhe idendry of ocher pecsons or enaties au[horized by stace or federnl law to receive the data. This mquiremeat shall
not apply when an individual is asked to supply invesdgaave dara,pursuant to secaon 13.82,subdivision S,to a law enforeement o�cer.
The commissioner of re�enue mav place the nodce rewired under this subdivision in the individual income taz or proDertv tax rofund
instcuctions instead of on chose forms.
Subd.3. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the subject
of stored data on individuals,and whecher it is class�ed as public,private or confidenaal. Upon his further request,an individuai who is the subject
of stored private or public data on individuals shall be shown ehe dara without any charge to him and,-if he desires,shall be informed of ihe content
and meaning of chat data. Aher an individual has been shown[he private data and informed of its meaning,the data need not be disclosed to him for
six mondu thereaf[er unless a dispute or acflon pursuanc to this secdon is pending or addidonal dara on the individual has been collected or created.
The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authoriry
may require the requesting penon to pay the actua!cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immedia[ely,if possible,with any request made punuant to this subdivision,or within five days of
the date of the request,exctuding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request
within rhat dme,he shall so inform the individual,and may have an addirional five days within w6ich to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private
data conceming himself. To exercise this right,an individual shall nodfy in writing the responsible authoriry describing[tte nature of the disagmement.
The responsible authority shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and aaempt to nodfy past recipients of
inaccurate or incomplete data, including recipients named by che individual;,or(b)notify the individual thac he believes rhe dara to be correct. Data
in dispute shall be disclosed only if the individual's sta[emenc of disagreement is included with the disclosed data.
The decerminadon of the responsible au�hority may be appealed pursuant to the provisions of the administrarive procedure act relating w
wntesud cases.
