RE: 3300 Navarre Lane
Michael J. Swanson, 3300 Navarre Lane,was in City offices on Monday, August 24, 1998. He is
the new owner of 3300 Navarre Lane, a corner lot located at Navarre Lane and Hillside Place. A
survey is attached, dated 1976.
Mr. Swanson is interest in building a new garage in the rear of the property with access form Hillside
Place. Under usual circlunstances,he would be allowed to do this as a matter of right if the proposal
met the setback and hardcover requirements and if a curb cut was approved for access to Hillside
Place.
In 1994 Jacci Segner applied for a subdivision of a lot line rearrangement for property at 3286/3290
Navarre Lane. Ms. Segner also owned the property at 3300 Navarre Lane. Ms. Segner agreed to
eliminate and redirect access so that Hillside Place would be used only by the two new lots. She
was required to regrade along Hillside Place and install a fence at 3300 Navarre Lane to eliminate
access.
The resolution for the lot line rearrangement was sent to Universal Title by a legal assistant at
Popham Haik for filing. Universal Title did not file it against 3300 Navarre Lane. It therefore does
not appear on the certificate of title. Mr. Swanson had no knowledge that he could not remove the
fence or have access from Hillside Place.
Mr. Swanson has removed the fence to do landscaping work and in preparation to build a new
garage. Lyle Oman sent Mr. Swanson a letter on June 23, 1998,requiring him to replace the fence.
There are two problems with this situation. First, the resolution was not properly filed on 3300
Navarre Lane and possibly 2260 Bayview Place. Should it be refiled? Secondly, can Mr. Swanson
be ordered to replace the fence when he had no notice of the City's actions? Should Mr. Swanson
be advised to request that the City Council reconsider the resolution agreement and consider
allowing him access to Hillside Place?
This is a very unusual set of circumstances. I would appreciate some direction on this as Mr.
Swanson awaits City guidance.

Deaz Mr. Swanson:
The previous owner of your property developed 2 lots on the north end of Hillside Place. A
condition of the development was that the road(Hillside Place)was to be used by only those 21ots.
The City required driveways from 2260 Bayview Place and your property to be removed from
Hillside Place and required a permanent fence to be erected(see enclosed agreement filed on your
chain of title). '
It has come to the attention of this department that the fence has been removed. This letter is to
require you to replace the fence before July 13, 1998. If this deadline is not met the City will initiate
legal action. If you have any questions please feel free to contact me at my office.

A. Segner is the owner of real property located at 3286 Navarre Lane (the "3286
Patcel") and 2260 Bayview Place (the "2260 Parcel") and 3300 Navane Lane (the "3300

c� D. The City has maintained municipal sanitary sewer lines and manholes within
N Hillside Place since 1965, and has maintained che capability for vehiculaz travel on Hillside
� Place anly to the extent necessary to maintain the sewer system;

�. E, City Municipal Code ("Cade"�, Secdons 6.05, Subdivision 9 and 6.�6,
Subdivision 9 provide standards for placement, design and cons�ucrion of residenLial
driveways accessina onto gublic and private roads. Those sections srate as follows: "A. One
driveway approach shall be allowed from up to twa single residential pazcels of land to the
same public (or private) road provided that apgropriate easements exist between parties
sharin� the driveway and driveway approach. Parcets having frontage on more than one
public (private) road shall be allowed a driv�way apgroach w ane public {or private) road";
F. The 2264 Parcel and the 3300 Parcel have previously utilized a private drive
within Hillside Place. - There is no current use of Hillside Place by the owner of the 2250
Parcel and the 3300 P'azcel;
G. Segner and Marinos have requested the City to approve a private drive within
Hillside P�ace to allow access to the 3286 Parcet and the 3290 Parcel, and the City hes
apgroved such request provided Segner and Marinos enter into this Agreecuent; �

NOS�, TT�REFORE, in consideration of the City allowin� the private drive servicing
the 3286 Pazcel and the 3290 Parcel to be located in Hillside Place and the mutual benefics to
be derived therefrom, Segner and Marinos agree as follows:
AGREEhIENTS:
. 1. The foreooing recit.als ase incorporated as parc of this Agreement,
2• All use of Hillside P12ce for access pnrposes to and frorn the 2260 Parcel and
the 330� ParCel shall be discontinued immediately upon execuuon of this Agreemen�
3. Segner shall immediately construct, ac her sole expens�, a permanent fence
along the entire easterly boundary of the 2260 Parcel and the 3300 Parcel abuttina Hillside
Place. Said fence shall at a minimum be 36" in height with two 2"X4" r�i.Is at approximately
].$" and 3b" above grade, with 4"X4" posts spaced 8' agart No gaG� for vehicutar �cess to
Hillside Place shatl be installed as part of such fence.
4. Seener shati immediately and exclusively utilize the existing dtxveway from the
2260 Parcel to Bayview Place Por access to and from the 2260 Parcel.
S. Segner shall immediat�ly construct at her sole expense, a new driveway access
to Nava.tTe Lane to s�rvice the 330Q Parcel, and shall thereaicer exclusively utilize such new
driveway access to and from Navarre Lane to the 3�00 Parcel. �
6. Segner and Marinos agree that only �he owners of the 3236 Parcel and the
3290 Parcel, and their respective invitees, shsll be allowed to utilize that portion of I-�illside
Place legally described on E�xhib�" attached hereto and made a gart hereof (the "Private
� Drive") for private driveway purposes as allowed by the City's Code SecCion 6.06,
f i Subdivision 9, excegt that incidental use of said right-of-way by pub�ic andlor pnivate
�� emergency vehicies, school buses and the public for access to adjoining properties or other
incidental travel shall be permitted.
7. Marinos and Segner hereby agree:
(a) The Private Drive shall be conscructed and maintained at Segner and
Marinos sole ezpense in accordance wirh all applicabte City Code
requiremenrs; and
(b} Immediately upon notice to Marinos and Segner that the City desires to
open �illside Place for public travel, Marinos �nd Segner shail, at their sale
expense, immediately recnove the Private Drive and restore Hil2side Place to
grade.

8. Segner and :vlarinos hereby indemnify and hold the City harmless fram any
and ail clai.ms, causes of acdon, liabiiities, damages or other losses (includin� attorneys' fees
and costs incurred by City in connection therewith or in enforcement of this Agreement)
sustained or incu.-red by reason of use of the Private Drive by Segner and Marinos, and their
respective invitees, successors ar assigns.
9. City shall honor any request of the owners of the 3286 Parcel and the 3290
Fazcel to post Hillside PIace with "No Parkir,g" signs and subject Hiliside place to
�nforcement of same by the City's Police Deparnnent
10. This Agreement shall run with the land, shall be bindinJ upon Segner and
Nlarinos, their respective successors and assigns, and may be enforced by the Ciry at law or at
equity.
11. Any future use of Hillside Place by an owner of the 226Q Parcel or the 3300
Parcel shall constitute a vioiation of this Agreement and of Municipal Code Section 6.05,
Subdivision 2, and snall constitute a misdemeanor. This paragraph does not apply to Se�ner,
her successors or assigns, as the owner of th� 32E6 Parcel.
12. This Agreement may be amended or tenuinated only by a recordable, wrirten
