Dear Mr. Ritchie:
On November 19, 1990 this office required you to discontinue the commercial use of the
property at 3220 Navarre Lane, Orono, Minnesota (letter enclosed). The City has recently
received a complaint and a site inspection confirmed that the building is again or is still being
used for commercial purposes.
Therefore the City must again require you to cease this use before February 7, 1994. By that
date, the items stored for your business must be removed. If this deadline is not met, the City
will initiate legal action. If you have any questions or if you have a problem meeting this
deadline, please feel free to contact me at my office.

Dear Mr. Ritchie:
On January 18, 1994 this of�ce again notified you of the zoning violation at 3220 Navarre Lane.
That letter required you to cease use of the building for commercial purposes. We spoke on the
phone and I also spoke to Bill Summers. Bill Summers said he would arrange access for an
inspection to verify that the building is used for personal storage only. As of this date, an
inspection has not been arranged. Therefore the City must require you to schedule an inspection
of the building before March 17, 1994. If this deadline is not met, the City will initiate legal
action. If you have any questions or if I can assist you in anyway, please feel free to contact
me at my office.

Dear Mr. Oman,
On March 18, 1994 I waited for our meeting to inspect the property. You later rescheduled the
meeting to Monday, March 21 st. I again waited and did not meet with you. I left a note on the
door to inform you that I had upheld my commitment to be at the building.
I would again remind you that this building is grand-fathered in for my storage uses. The building
is not for commercial use anyway.
I would like to register a complaint about the commercial equipment that is repeatedly parked in
front of the property. This equipment is the property owned by a neighbor to my building. I am
sure an investigation into your complaints would show that I am not responsible for the
complaints about commercial use.
Please recognize my participation and interest in resolving this matter.

agricultural activity. Mr. Richie is also the owner of B & C Heating in the neighboring City
of Spring Park. He uses the building for storage of duct work, furnaces, tool boxes, office

LAND USE HISTORY
1. Prior to January 1, 1975 the effective date of the Orono Zoning Code, said land was
occupied and used for an auto repair business known as the Collision Center, owned and
operated by Darrel Watschke.
2. The auto repair business continued to be operated on said land after January 1, 1975
becoming thereafter a legal non-conforming use of land pursuant to Section 31.100 of the
Orono Zoning Code.
3. No application has ever been made for a non-conforming use certificate of occupancy or
conditional use permit pursuant to Sections 32.250 and 32.480 of the Orono Zoning
Code.
4. On or about March 20, 1976, Richard Proudfit became contract purchaser for said land
and changed the use of said land to rubber manufacturing and/or product research and
development of rubber parts under the name of Viking Rubber Company. The change
in use of said land was made contrary to the provisions of Section 31.101 of the Orono
Zoning Code, and without application for a certificate of occupancy for the new use
pursuant to Section 32.210 of the Orono Zoning Code.
5. On February 20, 1979, an after-the-fact application for a non-conforming use certificate
of occupancy and conditional use permit was made by Richard Proudfit to the City of
Orono pursuant to Sections 32.210 and 32.480 of the Orono Zoning Code following
complaints to and inspections by the Building and Zoning Staff of the City of Orono.
6. Said application was reviewed by the Planning Commission and by the City Council of
the City of Orono during which reviews Richard Proudfit was provided an opportunity
to be represented by counsel, to be heard and to present any information desired in
explanation of the circumstances noted above.

building located at 3220 Navarre Lane.
Per our discussion this morning I am in process of relocating the limited
materials contained in the building. We are preparing for a sale to be
conducted in the very near future. You may inspect the empty building by
June 30, 1994. We anticipate having the contents removed on or before
June 15, 1994.

Dear Mr. Richie:
On May 9, 1994 you provided the Ciry with a letter stating you were in the process of relocating
the materials contained in the building at 3220 Navarre Lane. You stated the City could inspect
the empty building on June 30, 1994. Due to these statements, the City halted formal complaint
procedures. As of this date, the building is still being used for commercial purposes.
Therefore you leave the City no alternative but to proceed with legal action. A formal complaint
will be filed on August 29, 1994 if you have not ceased commercial use of the property. Any �
further commercial use of the property after that date will result in immediate legal action. If
you have any questions, feel free to contact me at my office.
