`VHEREAS, Kevin L. Thompson and Deborah Thompson, husband and �zfe
(hereinafter"the applicants") are the owners of the proper:�:located at 90 Myrtlewood Road w-ithin
the City of Orono (hereinafter the "City") and legally desc-ibed as follows:
Lot 7, Block 1,MYRTLEWOOD, Hennepin County, Minnesota
(hereinafter tne "propem-"); and
�VHEREAS,the applicants have made appLcation to the City of Orono for a variance
to Orono Municipal Zonin�Code Section 10.28 Subdi�•ision SB to allow construction of a 996 s.f.
detached gara�e/pool house/storage building,23.1'from t'r�_:;ide street lot line where a 50'side street
setback is required; and a variance to Section 10.03 Subd. 9(C)(2) to allo�v the new building to be
attached to the existin; 848 s.f. detached gara�e via an 11' s 15' (16� s.f.) greenhouse, for a final
accessory structure size of 2009 s.f.,when no accessory bu;':ding lar�er than 1000 s.f. is allowed on
a lot of 0-1.99 acres in area; and a variance to Section 10?? Subd. 5(B)to allow the construction of
a 20'x 45'(900 s.f.)in-�ound swimming pool 10'from the�ide street lot line w�here a 50'side s�eet
setback is normally required; and a conditional use perm.�t(CUP) per Section 10.20 Subd. 3Q for
plumbing in an accessory buildin�.

FINDItiGS
1. This application was reviewed as Zonina File �03-2919.
2. The property is located in the RR-1B R�.�-a1 Reside�tial Zoning District, �z-hich
requires minimum lot area of 2.0 acres an�' minimum lot width of 200'. The lot is
1.73 acres in�oss area and 2�1' in�vidth.

3. The Planning Commission reviewed this application at a public hearing held on
August 18,2003 and recommended partial approval of the application,based on the
following findin�s and conclusions:
a) Appro�al of the setback variance to allo�v the new 996 s.f accessory building
to be located 23.1'from the side street lot line is reasonable due to the wide
unused 1�InDOT right-of-way adjoinin�the side street lot line,«•hich provides
for additional sepazation of the accessory structure from the actual travelled
roadway.
b) There is no hardship.or justification presented to support the variance to
allow the attachment ofthe new 996 s.fbuilding to the existing 848 s.f.garage
via a 16�s.f. �eenhouse. The resultant building of just over 2000 s.f.in area
would potenrially have negative visual impacts as viewed from Highway 12,
and is not in keeping with the intent of the Oversize Accessory Structures
ordinance which attempts to limit the bulk and massing of accessory strucures
on properties based on the size of the property.
c) Appro�•al of a variance to allow the proposed 900 s.f.pool to be located 15'
(rather than the 10'setback proposed)from the side street lot line is reasonable
given the width of the unused portion of adjacent MnDOT right-of-way,the
fact that at the proposed location no nei�hboring property o�vners will be
affected by the�zsual or activity impacts normally associated«•ith a pool use,
and keeping in mind the 15' setback from an interior side lot line normally
required for a.ccessory structures of 7�0-1000 s.f. in azea.
d) The setback �•ariances should be approved only in conjunction with a
requirement to establish and maintain a suitable year-round ve�etative buffer
along the side street lot line to soften the visual impacts of the structures
allowed to bz nearer the lot line than normally allowed.
e) Approval of the request for a CUP for plumbing in an accessory structure to
include toilet sink and shower is reasonable given the intended use of the 996
s.f. structure a;a pool house,and althou�h the property is less than 2.O�acres
in area, the proposed use substantially meets the intent of the ordinance
allowin�plumbing in accessory structures, as long as such use is subject to
the standard CL�P conditions limiting its use for dwelling or home occupation
uses.

4. The City Council has cansidered this application including the findings and
recommendarions of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the health,
safety and welfare of the community.
5. The City Council finds that the conditions existing on this property aze peculiar to it
and do not apply generall�-to other property in this zoning district; that granting the
variances would not ad�-ersely affect traffic conditions, light, air nor pose a fire
hazard or other dan�er to neighboring property; would not merely serve as a
convenience to the applicants,but is necessary to alleviate a demonstrable hardship
or difficulty; is necessar�•to preserve a substantial property right of the applicants;
and would be in keepin� with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council finds that granting a conditional use permit to allow limited
plumbing in the accessort- structure will not be detrimental to the health, safety or
general welfare of the public, would not adversely affect light, air nor pose a fire
hazard or other dan;er to neighboring properties, nor will its use depreciate
surrounding property values and that the proposed level of use of the property will
be in keeping with the intent and objectives of the Zoning Code and Comprehensive
Plan of the City.
CO\CLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings,the Orono City Council hereby grants
a variance to Orono Municipal Zonin;Code Section 10.28 Subdivision SB to allow construction of
a 996 s.f.detached garage/pool house/sto��e building,23.1'from the side street lot line where a 50'
side street setback is required; and grants a variance to Section 10.28 Subd. 5(B) to allow the
construction of a 20'x 45'(900 s.f.)in-ground swimming poo115'from the side street lot line where
a 50'side street setback is normally requi�ed; and grants a conditional use permit(CUP)per Section
10.20 Subd.3Q for plumbin�in an accessory building as proposed;but denies a variance to Section
10.03 Subd.9(C)(2)to allow the new building to be attached to the existing 848 s.f.detached garage;
subject to the following conditions;
1. The applicants shall establish and maintain yeaz-round vegetative screening along the south
boundary of the property to reduce the visual impact of the pool and accessory building.

2. Council approval is based on the site plan submitted by the applicants and annotated by City
staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which aze
not in conformitywith City codes will require further Planning Commission and City Council
review.
3. By signing this resolution the property owners agree to the following conditions with regazds
to use of the 996 s.f.new accessory building in which a toilet,sink and shower are herewith
allowed to be installed:
a. The accessory building will not be used for a home occupation unless
specifically approved by the City or if allowed by City code.
b. The accessory building will not be used as a dwelling unless a guest house
CUP is obtained.
c. The accessory building will not be rented, leased or othenvise provided for
use as a dwelling under any circumstances.
4. Authorities granted by this resolution run with the property not with the applicants,but aze
permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire on
that date (September 8, 2004).
5. Violation of or non-compliance with any of the terms and conditions of this resolution shall
constitute a violation of the zoning code,shall automatically terminate any authority�ranted
herein, and shall be punishable as a misdemeanor.
6. The undersigned applicants have read, understood and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs,successors and assigns,
hereby agree to the recording of this resolution in the chain of title of the property.
