4. All demolition debris shall be compleiely disposed of off site in accordunce with alI

5. Water wells must be abandaned in accordance with State Health Dcpartment regularioas.
6. Inspection requi.red when all debris has been removed,before backfilling.
7. Within 5 working days of superstructure remova2, a fina� inspection sh��ll be requested. The
site shall be Ieft clean and clear of all debris,with any excavation fillecl with eazth level with
the adjaccnt ground elevation(except vvhen such excavation is ta be us�d as parc of a new
building and such new building is actually under const�uction).
8. Septic systems must be abandoned per Minnesota Rules Chapter 7080. All septic tanks
must be pumped, czusl�ed and filled with native soils. An inspection is required afler the
tanks aze pumped and before the tanks are crushed and filled.

To the property awner: Demolition of the principal dwelling structure on a property may automatically terminate
certain rights which may have accrued to the property by virtue of the continued existence of that building.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot area or
width standards)will, with few exceptions, require variance approval by the City Council, and such approval is
neither automatic nor guaranteed but requires that a hardship be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including setbacks,
lot coverage by structures, hardcover(impervious surface), height limits, etc.
• Where municipal sewer is not available, provision of two (2) sites for a conforming on-site sewage treatment
system is rrtandatory.
• Unless specifically approved by the City, all accessory structures must be removed at the time af principal
dwelling demolition, This also applies to seasanal and permanent docks,which may not be re-installed until a

Zoning application 12-3584 and demolition permit #2011-01051 pertaining to 517 Femdale
Road North is complete. The Applicant, Perry Schmidt, has requested a refund of the
escrow.
At the December 10, 2012 council meeting, the City Council approved the applicants request
to refund his $700 after-the-fact, double fee charged for ATF CUP (12-3584). The applicant
is also requesting refund of his $2,000 escrow for the demolition permit (2011-01051). The
total amount to be refunded is $2,700.

Curtis noted the applicant would like to address the City Council re�arding the after-the-fact fee.
Perry Schmidt,Applicant, stated he would Iike the City Council to consider a reduction or waiver of the
after-the-fact fee. Schmidt indicated he recently purchased the property and tore down the existing house.
Following the demolition, some fill was brought in without the necessary permit being obtained for that
work. Schmidt indicated since it was less than 500 cubic yards,he did get administrative approval later
for that work.
Due to the fact that there is a wet2and on the site,the Niinnehaha Creek Watershed District was asked to
=et involved and they required some additional work be completed on the site. One of the conditions was
that additional dirt be brou�ht in and the area seeded. Schmidt indicated he attempted to keep the City
infomied and involved in trying to resolve the issue. Schmidt sta.ted the adcutional dirt was brou=ht in
and that he sent an e-ma.il notifying Staff and the Watershed District when the work was going to take

Gaffron noted this is a housekeeping text endment to help clean up existing ordinance that was
adopted in December of 2010. There w e a number of revisions made to e zoning code sections

ESCROW AGREEMENT
AGREEMENT made this�day o1lJ , 20 � � , by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City") and Perry&Anne Schmidt_("Owners").
Recitals
1. An application for a demolition permit has been filed for the principal and accessory structure(s)
located at 517 Femdale Road North ("Subject Property")legally described as, see Attachment A.
2. In conjunction with the demolition erosion control measures are required as shown on attached
Exhibit"B".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for
all out-of-pocket costs (including planning, engineering, or legal consultant review)the City has incurred to assure that
the erosion control measures are installed and maintained so the property complies with the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the work. If
compliance with the approved Land Disturbance Permit is not accomplished within the allowable time period, the City
may bring the project into compliance by use of the security.
3. RIGHT OF ENTRY. The Owners hereby grant the City, its agents, employees, officers and
contractors the right to enter the property to perform all work and inspections deemed appropriate by the City in
conjunction with the required erosion control measures, including but not limited to constructing or completing any and
all of the agreed upon improvements should the Owners' contractor not complete those improvements by the date
specified herein.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in tum
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. Any remaining amount of the financial security deposited with the City for
faithful performance of the plans and specifications and any related remedial work will be released after the
completion and inspection of all such measures and the establishment of final stabilization for the Subject Property.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligibl. expenses
incurred City exceed the amount in escrow, the City shall have the right to certify the unpaid ance to the
subjec prope pursuant to Minn. Stat. §§415.01 and 366.012.

Subject: Land Alteration Permit
A demolition permit to remove the pre-existing residence and two small accessory buildings on this
property was issued on October 12, 2011. The residence structure was subsequently removed and fill
presumably brought to the site to fill in the hole left from removal of the house and foundation. On or
about January 23-24, 2012 additional fill was brought to the site by Burns Excavating without having
obtained a land alteration permit. A Stop Work Order was issued on January 24 and the City followed
up with requests for information and the appropriate after-the-fact permit application.
The initial report by property owner Perry Schmidt was that approximately 300 cubic yards of fill was
brought in by Burns. As part of the preparation for issuance of a permit, Gronberg & Associates
conducted an as-built topographic survey (dated 2/7/12) after the Burns fill occurred.
A survey on file dated 9/14/11 established the pre-demolition topography of the site. There is no
interim survey that would establish the contours after demolition but before the Burns filling activity of
January 23-24.
Gronberg's initial estimate of total fill added to the site based on the 9/14/11 and 2/7/12 surveys
indicated an amount somewhat in excess of 500 cubic yards, which would trigger the need far a
Conditional Use Permit. Subsequent information provided by Burns suggests that only 360 yards of fill
were brought onto the site in January. Gronberg has corroborated this with a statement that his initial
calculations included both fill used to complete the demolition and the fill brought in later by Burns;
and that the 360 cubic yards shown on the haul slips may in fact be accurate.
Absent further solid evidence of an exact amount of fill brought to the site, the City will issue an
after-the-fact land alteration permit (double fee) for the fill that occurred in January, subject to
the following conditions and advisories:
1. Issuance of this permit in no way should be construed as having established a new `existing grade'
for use in determining the building height or number of stories for any new home proposed to be
constructed on the site. The grades existing at the time of the survey dated 9/14/11 will be used to
determine the height & stories of any new house proposed.
2. No additional fill may be brought onto the site under this permit.
3. Property owner is subject to City and MCWD erosion control and wetland protection regulations.
Proper erosion control measures shall be implemented and maintained until the site is revegetated.
4. Property owner is advised that construction of a new home on the property will very likely trigger
City requirements for establishment of wetland buffers. The wetland on and adjacent to the
property is mapped as a Preserve classification which will require 50' buffers plus a 20' structure
setback.
5. The 2/7/12 survey indicates the limits of grading have not impacted the tested septic system sites.
Issuance of this permit should not be construed as acceptance that those sites have not been
impacted by the fill activity. The City makes no conclusion as to whether those sites have been
impacted.

Mike: When we calculated the amount of fill on this property we just looked at changes in grades and didn't look at the
material that was moved on site to flatten out the area around the old house. This looks like it could be in the range of 300
