Thank you for returning my call today. Based on our conversation it is my understanding I still need to provide
two items:
1) an updated survey provided by Mark G. that shows the contours prior to the fill be brought in and contours
as it currently is with the fill added. He emailed that earlier today and is attached again.
2) load slips from Steve B. that identify the number loads/yards of dirt brought to the property.
I spoke with Steve today and he said the load slips had been emailed to the city. However, he'll have his
secretary re-email them Thursday morning.
Based on these items being received and after the your engineer's review of the information- assuming is all is
satisfactory, it is my understanding you'll approve the permit for the <500 yards of dirt brought in.
As I mentioned, Catherine Bach, at the Minnehaha Creek Watershed District is waiting to know/hear how much
dirt was brought in and the City of Orono's direction on the permitting. Once you've received all the required
information, if you could please contact Catherine and give her an update I'd sincerely appreciate your help.

Mike:When we calculated the amount of fill on this property we just looked at changes in grades and didn't look at the
material that was moved on site to flatten out the area around the old house. This looks like it could be in the range of 300
cubic yards which would make the fill brought in under 500 cubic yards and more in line with the haul slips from the
contractor.

Building Permit Application#2012-00171
On March 5, the City received your zoning permit application. After our discussions with your surveyor we now
understand over 501 cubic yards of fill was deposited at the property. Additionally we understand that you wish
to bring in additional fill for the creation of a building pad. This amount of fill requires a Conditional Use Permit
(CUP) application to be approved by the City Council. A CUP has a fee of$700. Because a portion of the work
was conducted prior to approval a double fee($1400)shall apply.
As the initial 501+cubic yards of�II was brought in prior to City approval your property is considered in violation
and after the fact fees apply. The following items must be submitted or revised with your CUP Application to
remove the "violation"status from your property:
1. Certificate of Survey. The survey submitted (dated February 7, 2012) must be revised to reflect the
following in addition to the standard City survey requirements:
• A legend identifying the labels shown;
• An explanation of"1/2 alt mound";
• A calculation the total amount of�II currently brought to the site;
• Illustrate the limits of completed grading;
• Pre-fill topography/contours;
• A calculation of additional fill to be brought to the site; and
• Show intended post-fill contours/grading ptan.
2. Wetland Delineation. The wetland delineation must be approved by the Minnehaha Creek Watershed
District (MCWD). Please provide a wetland delineation report and the MCWD approval of the
delineation.. The delineated edge of the Preserve wetland must be shown on the survey, along with the
required 50' buffer and 20' structure setback from the buffer.
3. Erosion Control. Submit an erosion control plan or a copy ofthe MCWD Erosion Control Permit.
4. Escrow & Escrow Agreement. Conditional Use Permits require submittal of an escrow and an escrow
agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket
costs incurred during the review of your conditional use permit. Due to the after the fact status of the
property, the required escrow amount for conditional use permits is $2000. The escrow agreement is
enclosed. The property owner must sign the escrow agreement and submit a check for$2000.

On January 24, 2012 a stop work order was issued at the address noted above for unpermitted and illegal
fill brought to the site. City Code Section 78-966 states permits are required for filling and grading within
the City of Orono. A copy of City Code Section 78-966 is attached for your reference. Based on
information provided, approximately 300 cy of material were deposited on the site requiring an after-the-
fact (double fee) Zoning Permit. To date we have not received a zoning permit application for the
unpermitted fill.
The property is currently in violation of City Code Section 78-966; in order to bring the property into
compliance you must submit a zoning permit application. This letter will serve as your notice a zoning
permit application,with all required submittals, must be submitted or the fill must be removed and
the site restored to pre-fill grades before March 9, 2012.
Please note, as fill was deposited on a property containing a preserve wetland, we have notified the
Minnehaha Creek Watershed District.

Sec. 78-966. Prohibition.
(a) It is unlawful for any person to perform or have performed the following land
alteration activities without a conditional use permit issued by the council:
(1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt
or similar earth material within the limits of the city.
(2) Fill or reclaim any land by depositing such material or by grading of
existing land to elevate or alter the existing natural grade.
(3) Build, alter or repair any seawall or retaining wall, or otherwise change the
grade or shore of lakeshore property.
(b) All land alterations involving filling and grading shall be performed only with
clean fill as defined in section 78-1. Granting of such permits is subject to other
regulations and prohibitions of this Code and other applicable statutes or
ordinances of other governmental bodies.
