Chris,
At the request of the Developer,Jamison Kohout, I went out and inspected the raingarden for the project. At
this time I believe the developer has met his obligations with respect to the rain garden. The grades are per the design
and the vegetation has been established.
Of note-one homeowner, 1579 Maple PL appears to have"regraded"their section of the raingarden. I will
send a separate letter to the homeowner directing them to vegetate the area to avoid erosion and sediment issues.
The developer is interested in receiving his escrow money back.

Thank you! I let him know that it is ok to disturb cattails while doing correction work for the pond.This area is not a
wetland so an aquatic plant removal permit from the DNR is not needed, nor is a separate permit needed with MCWD.

Lauren,
There is an unfinished drainage pond along Minnie Avenue side of the Development. The pond was not built to the
approved plan and I've told the developer he needs to get the pond fixed prior to us signing off on an as built and closing
out the project. The pond is supposed to be generally flat bottomed but should drain to the north through the culvert
at the north end. As built there are currently two low spots that are up to a foot below the deign elevation and culvert
inlet elevation causing standing water for long durations. Attached is what is supposed to be there.

We received a call last week from a homeowner in the Crystal Bay View Development(1555 and 1565 Maple Place)who
was asked by Orono to clear out the bottom of the pond. Do you have any context for this? I did a brief look at these
properties and am not seeing a pond in this area.
Please let me know if you have any information.

Subject: As-Built Survey- Maple Place Pond/#12-3546
Jamison,
On April 6, 2016 we received an as-built survey dated 3-21-2016 for the Maple Place Pond. Our engineer has reviewed
the survey and has the following comments:
1. The as-built should fully depict the area covered in the approved plan for the development. In particular the as-
built should show the complete drainage system up until it connects to the city system at the north east corner.
2. Although flat-bottomed,the approved plan had the pond drain to the north. The approved plan shows the
lowest contour interval at 933. As-built portions of the pond sit a foot below the invert elevation of the culvert
inlet. The as-built has two(2) high points in it that will and are causing water to pool. The pond and should be
cleaned out and the bottom regraded to comply with the approved plan.
Please address the engineers comments and submit an updated as-built survey for our approval.

ZONING PERMIT E CROW AGREEMENT

AGREEMENT made this�day of 20�Z-by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and ("Owners").
Recitals
1. A zoning permit application has been filed for a property located at and adjacent to 1545 Maple
Place the ("Subject Property"), legally described at Lots 7, 8, 9, 10, 11, 12 and 13, Block 6, Crystal Bay View,
Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$10,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Poilution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with permit #ZC�t Z -��� if compliance with the approved zoning permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
