As part of the permit application process,your application was distributed to other DNR disciplines as well as local,state, and federal regulating agencies to allow them an opportunity to review your project and provide comments. DNR Wildlife commented that the existing riprap is adequately stabilizing the shoreline and expressed concem that new riprap will eliminate that vegetation; that it is preferable to retain the vegetation and bushes that are growing in the exiting riprap, as they provide wildlife habitat. Similazly, DNR�cological Resources requested that you be informed that there are a number of options available to you to stabilize your shoreline other than riprap that would serve the same function as riprap but provide a more natural appearance to yaur shoreline.It may be possible to use riprap to stabilize the tce of the slope and use native planrings to retain a more natural look. Additionally, we encourage the use of native vegetation because of the ecological benefits to wildlife and water quality. I have also attachcd a brochure on]akescaping and I encourage you to incorporate lakescaping into your shoreline stabili7ation efforts. The pertnittee shall make no c�anges,wfthout written permission previously obtained from the Commissioner of Natural Resources,�the dimensions�capacity or location of any ltems of work authorized hereunder. 5. The psrmittee shali grant access to the site at all reasonabte times during and after construction to authorized representatives of the Commissioner of Naturel Resources for inspection of the wo�k authorized hereunder. 6. This peRnit may be temninated by the Commissioner of Natural Resources at any time deemed necessary for the conservation of water resourcea of the state,or in the interest of public health and welfare.or for violation of any of the conditions o�appficable Iaws,unless otherwise provided in the permit. The permittee may request an extension of the time to complete the project,stating the reason thereof,upon written request to the Commissioner of Natural Resources. 8. In all cases where the permittae by pe�forming the work authorized by this pertnit shall involve the takfng,using, or damaging of any property rights or interests of any other persan or pe�sons,or of any publicly owned lands or improvements thereon or interests therein,the pe�mittee,before proceeding,shall obta�n the written consent of all perso�s,agencies, or authorities concerned, and shall acquire all property, rights, and interests needed for the work. 9. i'his permit is permissive only. No liability shall be imposed by the State of Minnesota or any of its offrcers, agents or employees, o�cially or personally, on account of Ihe granting hereoF or on account of any damage to any person or property resulting from any act or omission of the permittee or any of its agents, employees, or contractors. This permit shall not be construed as eskopping or limiting any legal claims or right of actian of any person other than the state against the permittee, its agents, employees, or contractors, for any damage or injury resulting from any such act or omission, or as estopping or limiting any legal claim or right of action of the state against the permittee, its agents, employees,or contractors for violation of or failure to comply with the permit or applicable conditions. 10. Any extension of the surface of public waters from work authorized by this permit shall become public waters and left open and unobstnlcted for use by the publlc. 11. Where the work authorized by this permit involves the draining or filling of wetlands not subject to DNR regulations, khe permittee shall not initiate any work under this permit until the pe�mittee has obtained official approval from the responsible local government unit as cequfred by the Minnesota Wetland Conservation Act. 12. Erosion control measures shall be adequately designed for the site characteristics. They may include staked hay bales, diversion channels, sediment ponds, or sediment fences. They shall be installed in accordance with"State of Minnesota Stormwater Man��l"MPCA, November 2005(and as revised in the future),prior to commencement and maintained throughout the project. All exposed soil shall be stabilized as soon as possible and no later than 72 hours after the completion of the project. Topsoil should be used to re-dress disturbed soil areas and indigenous plant species should be used to revegetate disturbed areas whenever possible. 13. No activity affecting the bed of the protected water may be concfucted between April 1 and June 30, to minimize impacts on fish spawning and migration.
