I have reviewed the permit application 2012-00330 and there are still outstanding issues which need to be addressed
from initial permit review and letter dated March 6, 2012:
• The project will disturb more than 100 cubic yards of material. Therefore, a Storm Water Pollution Prevention
Plan (SWPPP) must be submitted for review in accordance with Sec. 79 of the City Code. The minimum $2,000
sediment and erosion control financial security should also be required of the owner for this permit.
• Retaining Wall Plan and proposed grading differs between the survey and Retaining Wall Plan. The survey calls
out the top of wall at 983.5 while the retaining wall plan calls out the top of wall at 983.0.
• The applicant will be required to obtain a Minnehaha Creek Watershed District permit for erosion control. A
copy of the approved permit should be submitted to the City.
I also have additional comments which need to be addressed:
• The current building application is only for a retaining wall, but the survey calls for a proposed deck. If a deck is
being proposed, a separate permit application must be submitted with all the necessary requirements. If a deck
is not scheduled to be built, the proposed deck needs to be removed from the survey.
• The survey needs to have to proposed contours included on the survey.

Attached please find the City engineer's comments on your submitted plans. Please address the issues outlined within
the memo as well as below in order for our plan review to continue:
1. The Ciry will not permit a 2�d curb cut/driveway approach per City Code Section 18-136 please revise your survey
to reflect only one driveway access to the public road;
2. Hardcover zone (setback from the OHWL) must be indicated on the survey;
3. Hardcover must be calculated according to the appropriate zone (property is estimated by staff to be split
between the 250'-500'and 500'— 1000'zones) on the sheet(s) provided;
4. A Building Permit application is required for the construction of retaining walls 4'and over. According to your
submitted plans the retaining wall is 4'or greater. Please complete the attached Building Permit application and
submit. An additional permit fee will apply; and
5. The proposed deck as shown also requires a Building Permit application (& plans) and is not part of this review.
It can be included on the Building Permit application for the retaining walls.
The attached escrow agreement and submittal of an escrow of$2500 is also required to be submitted prior to the
issuance of any permits.

Dear Melanie:
As requested, we have reviewed the submittal package for the proposed grading and retaining wall
installation at 680 Minnetonka Highlands Lane. The Building Permit Survey is dated February 24, 2012
and the Retaining Wall Plan is dated February 23, 2012. Based on our review, we offer the following
comments for your consideration:
L This project will disturb more than 100 cubic yards of material. Therefore, a Storm Water
Pollution Prevention Plan (SWPPP) must be submitted for review in accordance with Sec. 79 of

2. Retaining wall layout and proposed grading differs between the Building Permit Survey and
Retaining Wall Plan. Revise the layout and grading so that plans are consistent with each other.
3. Provide top of wall and bottom of wall elevations and dimensions on the retaining wall in key
locations (i.e. grade changes, alignment changes).
4. Provide proposed grading elevations at key locations on the Building Permit Survey.
5. Revise the proposed driveway layout to include only one driveway approach(per City Code
Section 18-136).
6. The proposed driveway appears to have a slope of 12°Io. Consider revising the driveway slope to
under 10% when reconfiguring the driveway layout.
7. Include Hardcover Zoning (setback from OHWL) on the Building Permit Survey and revise
Hardcover Calculations to correspond with appropriate zones.
8. The total for Proposed Hardcover Calculations should read"Proposed Hardcover"not "Existing
Hardcover".
9. The applicant will be required to obtain a Minnehaha Creek Watershed District permit for erosion
control. A copy of the permit should be submitted to the City after MCWD approval.
10. The proposed deck will require a separate Building Permit Application and corresponding plans.

Please review the attached information for a grading permit (Zoning Permit 2011-01062). The remodei work was done to
the house under a separate permit in order to convert the lower garage into living space/garage and the upper garage
was recently created out of living space...
Attached are:
1. Permit cover sheet
2. Revised survey/grading plan (FYI - from the original submittal I requested top and bottom of the retaining walls
and proposed grading be added.);
3. Engineered plan for retaining walls;
4. Recent photo of the site
Please provide comments on the attached grading plan on or by March 6t". When referencing the plans/survey in your
review letter please refer to the most current revision date of the survey, rather than the"date received"stamp.
In the meantime, I will also forward the following comments to the property owner&surveyor which may require an
additional survey revision:

Christine,
I recently had a conversation with Paul Soberg,the owner of 680 Minnetonka Highlands Lane.We discussed the final
closeout of his site, and said that you need to get confirmation from us that the site stabilized to release some sort of
assurance.According to our rules to confirm a site is completely stabilized,there needs to be a uniform perennial
vegetative cover with a density of 70�0 over the entire pervious surface area, or other equivalent means necessary to
prevent soil failure under erosive conditions.
In this case,the site was inspected in early November,and the front yard definitely met this 709�o stabilized.There is a
portion of the back yard that has not met that requirement, and there is still going to be small scale construction to be
done there (finishing of a deck). I am confident to say there is not evidence to believe that any of this exposed sediment
will leave site, or reach any storm drains. It is relatively flat,and would need to travel a long distance over a well
stabilized area to get close to the edges of the site.We are going back to confirm that the backyard will be stabilized
after final deck construction in the spring, but have been assured that no large machinery or earth moving is necessary
with this. I give our permission that the site is stabilized to the point where no soil will leave the site.

� BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2012-00330
AGREEMENT made this /D�day of , 20�� by and befinreen the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Paul Sob g ("Owners").
Recitals
1. A building permit application has been filed for a retaining wall and deck located at 680
Minnetonka Highlands the ("Subject Property"), legally described as Lot 2, Block 1, Minnetonka Highlands
Estates, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2012-00330 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject Brn�rty pursua o Minn. Stat. §§415.01 and 366.012.

I recently had a conversation with Paul Soberg, the owner of 680 Minnetonka Highlands Lane. We discussed the final
closeout of his site, and said that you need to get confirmation from us that the site stabilized to release some sort of
assurance.According to our rules to confirm a site is completely stabilized, there needs to be a uniform perennial
vegetative cover with a density of 70%over the entire pervious surface area, or other equivalent means necessary to
prevent soil failure under erosive conditions.
In this case, the site was inspected in early November, and the front yard definitely met this 70%stabilized.There is a
portion of the back yard that has not met that requirement, and there is still going to be small scale construction to be
done there (finishing of a deck). I am confident to say there is not evidence to believe that any of this exposed sediment
will leave site, or reach any storm drains. It is relatively flat, and would need to travel a long distance over a well
stabilized area to get close to the edges of the site.We are going back to confirm that the backyard will be stabilized
after final deck construction in the spring, but have been assured that no large machinery or earth moving is necessary
with this. I give our permission that the site is stabilized to the point where no soil will leave the site.
