� (hereinafter "the applicants") are the owners of the property located at 679 Minnetonlca
Hi�hlands Lane�vithin the City of Orono (hereinafter the "City") and leaally described as
follows:
Lot 4, Blocl: 2, Miruzetoi�lea Highlands Estates, Herulepin County, Miiuzesota
(hereinafier the "property"); and
WI-�E�r�S, the applicants have made application to the City of Orono
for a conditioilal use permit including a 0-75' hardcover variance per Orono Municipal
Zoning Code Sections 78-966 (A} and 75-1238 (A) to allow replacement of existii�a
timber retainina walls with kevstone walls, all �vithin 75° of the OHWL of Lake
Minnetoi�lca, constitutina 7.7% hardcover where 0% is nonnally allowed and 14.�°%
currentiv exists.

a. The existinQ walls were approved as pai�t of an after-the-fact
conditional use pennit review in 1983.
b. The existin�timber walls are deteriorating and in need of repair.
c. All eYistin� uiuzecessaiy walls within 75' of the lake are being
eliminated as part of this replacenlent plan.
d. The existing deck, associated staircase, and fire-pit partly within tlie 0-
7�' zone and 75'-250' zoi�e are being removed.
4. The City Council has considered this application including the findings
and recommendation of the Plannin� Commission, reports by City staff,
conunents by the applicants and the public, and the effect of the proposed
conditional use pernlit and varia�.Zce on the health, safety and welfare of
the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other propei�ty iiZ this zoning
district; that granting the conditional use permit and variance would not
adverselv affect traffic conditions, li�ht, air nor pose a fue hazard or other
dan�er to neighboring property; would not merely serve as a convenience
to the applicants, but is necessary to alleviate a demonstrable hardship or
difficulty; is necessary to preserve a substantial property riaht of tlZe
applicants; and would be in keeping with the spirit and intent of the
7onin� Code and Comprehensive Plan of the City.

Based upon one or more of tlie above findin�s, the Orono City� Council herebv
grants a conditional use permit including a 0-7�' hardcover variance per Orono
Municipal Zoning C'ode Sections 78-966 (Aj and 78-1288 (A) to allow replacement of
existin� timber retainin� walls ��ith keystone ti�-alls, all within 7�' of the OHWL of Lalce

1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Plamiing Conunission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 838 s.f. or 7.7%
as depicted on Exhibit A. Applicants are advised that any future requests to
increase hardcover or change the nature of all existing/approved hardcover on the
property shall require City approval, and increases in hardcover will not likely be
approved without concurrent reduction in existing hardcover.
3. Applicants shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their penneability as non-hardcover
surfaces.
4. City Engineer recommendations regarding erosion and sediment control
measures, contained in the Planning report as Exhibit F, must be followed at all
times during the course of construction.
5. Authorities granted by this resolution run �vith tlie property not with the
applicants, but are permissive on?y and must be exercisetl by obtainir.g a building
permit for the new construction within one year of the date of Council approval,
or the conditional use permit and variance will expire on that date (September 26,
2006).
6. Violation of or non-compliance �vith any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, sllall automatically
terminate any authority �ranted herein, and shall be punishable as a misdemeanor.
7. The lindersim�ed applicants have read, understand and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to tlie recording of this resolution in the
chain of title of the property.
