Minor Land Alteration: Description of Work
Nathan VanCamp
601 Minnetonka Highlands Lane
Orono, MN 55356
The line colors noted in the description below are referring to the map that is included
with this application which is titled"Description of Work."
1. Existing Land Contour
The south western corner of the property is the highest elevation. From that point the
property slopes down to the northern, northeastern and eastern corners. The total
change in slope from the south west corner to all other corners is roughly 10 feet.
The proposed fill area(Black line) is fairly level, however it has a slight slope as
indicated(Green lines). The proposed fill area is the lowest grade on the property.
The proposed fill area has a steep bank along all sides. This bank follows the
outlined fill area line. Along Minnetonka Highlands Lane (southern side)the bank is
approximately 4 feet high and tapers down along Tonkawa Road (eastern side) and is
about 18 inches at the north eastern corner. Along Elm Street(northern side) the
proposed fill area this bank is approximately 18 inches high. There is an 18 inches
bank along the north western edge of the proposed fill area, and slopes up to
approximately 3.5 feet at the south western corner of the fill area.
2. Proposed Land Contours
The proposed fill area is approximately 40 feet wide and 100 feet long. Around 250-
300 cubic yards of fill will be brought in(see included Fill Hauling Route)to raise the
elevation approximately 18-24 inches. This will eliminate the bank along the western
portion of the fill area and make the back yard level with the fill area. Fill material
will be comprised of 14-18 inches of a clay/sand mixture and will be topped with 4
inches of black dirt. The fill area will be graded to maintain the current slope (Green
lines). A swale will be made along the western and northern most edges of the fill
area to capture and direct water run off from both the streets and the property
(()rxn;e lines). This will flow into the culvert(Brown lines) along the northern edge
of the property. This culvert directs the water into the ditch along Elm Street.
3. Erosion Control Plan
During the filling and grading activities a silt fence (Red lines)will be installed
between the fill area and the culvert along Elm Street. This will capture any soil that
erodes during rain storms. Grass will be planted on the entire fill area. Once the
seed has completely rooted in the silt fence (Red lines)will be removed.

Just checking up on the status of the vegetation reestablishment after the soil stockpile was removed. Has the seeding

Nathan
It's my understanding that you've restored the site to preexisting conditions and re-vegetated. This activity
resolves the violation on the property. You applied for a permit(after-the-fact) for the dirt brought to the site but
at this point I close this permit and close the violation file. The$2000 escrow you provided in August of 2010 will
be refunded following City Council authorization to issue a check.
Is this correct?

Melanie,
I was under the impression that MCWD needed to give the final approval before Orono would close the permit,
hence my request below. Could you please confirm what the city needs to close the permit?

Thanks for the update. I'll get one of our inspectors out there this week to have a look.
You will need to coordinate with City staff in order to close out their permit, as MCWD has a separate
regulatory process.

Greetings Catherine,
Due to the heat the past few months, we have been doing a lot of re-seeding and watering to try to get seed to
establish. I would estimate that we have greater than 70% cover at this time.
What will MCWD need to close out the permit with the City of Orono?
Thanks,

Nathan,
Thanks for the update. Adding 1" of black dirt prior to seeding will be fine. You can add more black
dirt/topsoil in the areas outside of the wetland boundary if desired to promote healthy growth, but
please limit it to 1" within the delineated wetland. I also wanted to confirm what seed mixes you will be
using within the wetland. You had last indicated the following:
"To prevent the buckthorn and other invasive weeds from taking over, I was looking at planting a meadow
mix from Prairie Moon for the area that is wet (500 sq. feet). For the rest of the area (1500 sq ft) I was
considering planting grass (mix of Kentucky Blue & Rye grass). I also was considering planting a few water-
loving trees (Cedar and Silver Maple) in the area. Are there issues with planting trees?"
I had confirmed with you that this planting plan was acceptable, is this still what you had in mind? The straw
maUequivalent is a definitely a good idea to help the seed establish. The perimeter will need to stay in place
until the area has adequate vegetative cover. Please do not remove it until we have given you the OK (give us
a call or e-mail when you think the coverage is adequate for it to be removed). I'll have an inspector get out
there soon to have a look.
Your follow-up is much appreciated. I'll be in touch.

Catherine,
Our excavation contractor was able to remove the dirt yesterday. The equipment compacted the soil and they
recommended spreading approximately 1" of black dirt over the area that was covered in fill, so that the grass
seed will take again. They also recommended using a straw mat (or equivalent) over the seed far erosion
control. We would like to have them do this, so that the area that was covered in fill can be restored to grass.
We will wait for your confirmation before asking them to do this. They also recommended leaving the silt
fence in place until the new seed is growing well. We plan to do this as well.
Please confirm that we can have our contractor perform the restoration as detailed above.

Melanie,
So sorry for the delay. Earlier this spring I spoke with Nathan who indicated that the contractors he was discussing the
project with though that it would be difficult to get in there to remove the fill while it was so wet, and that he was going
to get in touch with me in June when things dried out and impacts would be minimized. One of our inspectors has been
out there within the last month or so and the stockpile is still covered &contained. I haven't heard from him yet, but I
will keep you in the loop whether I give him a call/e-mail or if he calls me. Let me know if you need any more info.

Nathan,
Following our phone conversation today, the deadline of April 1, 2011 for removing the soil stockpile on your property
(as noted in my last e-mail) will no longer be enforced due to the concerns from various contractors we discussed. Most
importantly, it would be difficult for the contractors to know where to excavate with the existing snow cover, and it is
very important that excavation into the underlying/adjacent wetland does not occur. We discussed an anticipated
removal of the stockpile sometime around June 2011 (after things dry out after spring melt--there will be less of an issue
of significant disturbance from heavy equipment on saturated soils on site).
As I mentioned, because the stockpile will be on site throughout the spring melt, it is crucial that you make sure the
perimeter control and stabilization of the entire stockpile is in place as soon as possible (we discussed the use of
firewood in conjunction with silt fence as perimeter control, which would be acceptable as long as it is functional and is
able to keep runoff contained to the stockpile area and out of the adjacent wetland). Formal enforcement actions may
be pursued if additional wetland impacts occur due to perimeter control failure and/or lack of adequate stabilization.
I will be contacting you in mid-April to set up a site meeting to verify that the perimeter control and stockpile
stabilization we discussed is in place and adequate. Depending on the weather conditions, you may be contacted earlier
to verify these items are in place if significant snowmelt is occurring. It is your responsibility to ensure the perimeter
control and stockpile stabilization are in place prior to sprin melt to avoid sediment impacts to the adjacent wetland
from runoff.
Let me know if you have any other questions.

Please see the recent correspondence below regarding 601 Minnetonka Highlands Lane. One of our inspectors will be
visiting the site today to verify the perimeter control and stabilization (I have attached the inspection report that
required the homeowner to do this). We were going to follow-up with the homeowner early next spring (at the latest)

FYI—
I just got a call back from Nathan VanCamp regarding the letter I just sent him (below). He was upset with the limited
amount of time he had to complete the stabilization of stockpiles (deadline of 8:00 AM Wednesday 12/1). I had to
explain that we have been particularly lenient with him in the first place letting him keep the stockpite within the
wetland, especially considering the fact that perimeter control was not installed. He said he did have silt fence installed,
but he took it out to do some other work on the property. He said he could probably have the temporary stabilization
done by Friday 12/3, and I agreed to this deadline extension. He should be sending me an e-mail when the stabilization
is complete, but if I haven't heard from him by next Friday (12/3), I told him we would send an inspector out to make
sure it was completed. If it's not completed, we'll go from there...

I will only remove the soil that was brought in. To be clear, I do not intend to "restore to the original condition
as closely as possible." That would involve letting the area get overgrown with buck-thorn, thistles and vines.
However, I do intend to plant seed. Do you have restrictions on seeding? If so, please provide the details.

The area should be restored to its original condition as closely as possible. You can start by removing the fill,
but make sure not to excavate into the native soil below the fill (any contractors involved in removing the fill
must also be aware of this requirement). After the fill has been removed, give me a call and I can come out

Nathan,
I sincerely apologize for my delayed response.
Reardinthe possibility for your proiect qualifvinfor an exemption under the Wetland Conservation Act(WCA):
It appears the only exemption your project (or a portion of your project) may qualify for is the De minimis exemption
under Section 8420.0420 Subpart 8(A)(3) of the attached rule, which allows for a specific square footage of wetland
impact (i.e.fill)that would not require replacement. The square footage of allowed impact is determined by the type of
wetland (Type 1,Type 2,Type 3, etc.) and whether the project location is inside or outside of the shoreland wetland
protection zone and the building setback zone (these zones are classified by and regulated under the city of Orono). I
spoke with Melanie Curtis(city of Orono) about whether the project location is inside or outside of these zones, and she
informed me that your property is within the shoreland wetland protection zone. We are still working together to
determine if the project location is within the building setback zone or not. If the project location is determined to be
within the building setback zone, it would reduce the amount of fill allowed even further.
Given that your property is within the shoreland wetland protection zone, the absolute maximum possible amount of
wetland you would be able to fill under the De minimis exemption is 400 square feet* (*this much fill would only be
allowed if it is a Type 1,2, or 6 wetland). Based on the materials you submitted, the proposed fill area is approximately
40' wide by 100' long, which would total approximately 4,000 square feet. At this point, we can confirm that you will
not be able to proceed with the project as your plans indicate without providing replacement.
As mentioned above, in order to determine the specific square footage of fill that may be acceptable, the wetland type
needs to be determined. The full wetland delineation report should identify the type of wetland on your property.
However, the boundary and type determinations given in the wetland delineation report are not valid until approved by
the WCA Local Government Unit, which is MCWD. The full wetland delineation report and a completed Application for
Approval of Wetland Boundary and Type (attached) will need to be submitted to me to start this process. After
receiving the complete application, a decision will follow 1)field review of the boundary/type and 2)completion of the
comment period (which is a minimum of 15 business days from the date the application is received). After the boundary
&type are approved (and after determining whether the project location is in or out of the building setback zone),we
can then determine the exact amount of allowed wetland impact allowed under the De minimis exemption.
Please let me know if you have any questions about where to go from here.

Catherine,
I had Ben Carlson from Arrowhead Environmental Consulting look at my property. He did some testing (soil boring) and
prepared the attached GPS wetland boundary map.
He did not provide the full delineation report, but I can request this if needed. I would like to talk with someone from
MCWD that is able to determine if my project would qualify for a exemption (fill without mitigation). I would like to know if
any options exist for such an exemption and what the requirements are.

Nathan,
In addition to the completed Application for Approval of Wetland Type & Boundary form that you provided, a wetland
delineation report will also need to be submitted. Attached is a list of certified wetland delineators who are qualified to
prepare these types of reports. MCWD is the Local Government Unit(LGU)for Wetland Conservation Act enforcement
within the city of Orono. We are responsible for reviewing and approving/denying wetland delineation reports. On the
application form you provided, the Local Government Unit should be changed from the City of Orono to MCWD,and
under the "Agent/Consultant Information" section, you should enter the information for whoever prepares the report.
Once the wetland delineation report is complete, please make the above-referenced changes to the application form
and submit both items to me. Please call me if further clarification is needed.

Our wetland map shows an unclassified wetland on the property. I will be on site next Wednesday to inspect if
there is in fact a wetland on site. If there is not, then only a District issued Erosion Control permit will be

Re: 601 Minnetonka Highlands Lane
File No. 000139-10000-2
File No. 2010-00721
Dear Melanie:
We have reviewed the grading plan and info for minor grading work at 601 Minnetonka
Highlands Lane. The plans are dated 8-14-10. We have the following comments with regards to
engineering matters:
• The grading plan and narrative provide sufficient information to evaluate the grading and
the work appears acceptable from an engineering standpoint. However, due to the
limited plan information a site review should be done by ciry stafF just prior to final
restoration.
• Minnehaha Creek Watershed District permits will likely be needed with this project. The
site should be reviewed for wetlands by the MCWD prior to filling activities. Evidence
that a watershed permit has been granted or is not needed should be submitted to the
city.
• Newly graded slopes must not exceed slopes of 3 feet horizontal to 1 foot vertical.
• Grading work must not impede the flow of any offsite stormwater runoff through the
property.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. It appears that the sediment and erosion control financial security already
has been collected by the city.
If you have any questions, please call me at(651) 604-4894 or send an email to
darren.amundsen@bonestroo.com.
Sincerely,
`j ;---__

Your haul route indicates that you are getting the fill from 1300 Loma Linda. Is this the case? If so, we will need to
contact the property owner as they need to apply for a zoning permit for land alteration.
I spoke with Darren (one of our engineers) this morning and he indicated that we will need evidence from the Minnehaha
Creek Watershed District(MCWD) that they are ok with your project. I wanted to pass that info along to you as soon as
possible. Their website is: http://www.minnehahacreek.orcl/. I have attached your permit packet in case you'd like to
forward it to a representative at the MCWD for their review.
Also, I will forward Darren's comments when I receive them. Have a nice day.
Thanks, Melanie

See the attached comments from Darren, our engineer. Also, our engineer stopped over at the site to review the current
drainage and said it is likely a wetland. It will be up to the MCWD to determine if these are incidental or not... because
of this your project may require more permits/approvals from both the MCWD and the City.
