Erosion control lan or co of MCWD Erosion Control Permit t_ast updated: Juy,2010 Minor Land Alteration: Description of Work Nathan VanCamp 601 Minnetonka Highlands Lane Orono, MN 55356 The line colors noted in the description below are referring to the map that is included with this application which is titled"Description of Work." 1. Existing Land Contour The south western corner of the property is the highest elevation. From that point the property slopes down to the northern, northeastern and eastern corners. The total change in slope from the south west corner to all other corners is roughly 10 feet. The proposed fill area(Black line) is fairly level, however it has a slight slope as indicated(Green lines). The proposed fill area is the lowest grade on the property. The proposed fill area has a steep bank along all sides. This bank follows the outlined fill area line. Along Minnetonka Highlands Lane (southern side)the bank is approximately 4 feet high and tapers down along Tonkawa Road (eastern side) and is about 18 inches at the north eastern corner. Along Elm Street(northern side) the proposed fill area this bank is approximately 18 inches high. There is an 18 inches bank along the north western edge of the proposed fill area, and slopes up to approximately 3.5 feet at the south western corner of the fill area. 2. Proposed Land Contours The proposed fill area is approximately 40 feet wide and 100 feet long. Around 250- 300 cubic yards of fill will be brought in(see included Fill Hauling Route)to raise the elevation approximately 18-24 inches. This will eliminate the bank along the western portion of the fill area and make the back yard level with the fill area. Fill material will be comprised of 14-18 inches of a clay/sand mixture and will be topped with 4 inches of black dirt. The fill area will be graded to maintain the current slope (Green lines). A swale will be made along the western and northern most edges of the fill area to capture and direct water run off from both the streets and the property (()rxn�;e lines). This will flow into the culvert(Brown lines) along the northern edge of the property. This culvert directs the water into the ditch along Elm Street. 3. Erosion Control Plan During the filling and grading activities a silt fence (Red lines)will be installed between the fill area and the culvert along Elm Street. This will capture any soil that erodes during rain storms. Grass will be planted on the entire fill area. The equipment compacted the soil and they recommended spreading approximately 1" of black dirt over the area that was covered in fill, so that the grass seed will take again. They also recommended using a straw mat (or equivalent) over the seed far erosion control. We would like to have them do this, so that the area that was covered in fill can be restored to grass. We will wait for your confirmation before asking them to do this. They also recommended leaving the silt fence in place until the new seed is growing well. We plan to do this as well. He was upset with the limited amount of time he had to complete the stabilization of stockpiles (deadline of 8:00 AM Wednesday 12/1). He said he did have silt fence installed, but he took it out to do some other work on the property. Re�ardin�the possibility for your proiect qualifvin�for an exemption under the Wetland Conservation Act(WCA): It appears the only exemption your project (or a portion of your project) may qualify for is the De minimis exemption under Section 8420.0420 Subpart 8(A)(3) of the attached rule,which allows for a specific square footage of wetland impact (i.e.fill)that would not require replacement. The square footage of allowed impact is determined by the type of wetland (Type 1,Type 2,Type 3, etc.) and whether the project location is inside or outside of the shoreland wetland protection zone and the building setback zone (these zones are classified by and regulated under the city of Orono). I spoke with Melanie Curtis(city of Orono) about whether the project location is inside or outside of these zones, and she informed me that your property is within the shoreland wetland protection zone. We are still working together to determine if the project location is within the building setback zone or not. If the project location is determined to be within the building setback zone, it would reduce the amount of fill allowed even further. Given that your property is within the shoreland wetland protection zone,the absolute maximum possible amount of wetland you would be able to fill under the De minimis exemption is 400 square feet* (*this much fill would only be allowed if it is a Type 1,2, or 6 wetland). Based on the materials you submitted,the proposed fill area is approximately 40' wide by 100' long, which would total approximately 4,000 square feet. At this point, we can confirm that you will not be able to proceed with the project as your plans indicate without providing replacement. As mentioned above, in order to determine the specific square footage of fill that may be acceptable,the wetland type needs to be determined. The full wetland delineation report should identify the type of wetland on your property. However,the boundary and type determinations given in the wetland delineation report are not valid until approved by the WCA Local Government Unit,which is MCWD. The full wetland delineation report and a completed Application for Approval of Wetland Boundary and Type (attached) will need to be submitted to me to start this process. After receiving the complete application, a decision will follow 1)field review of the boundary/type and 2)completion of the comment period (which is a minimum of 15 business days from the date the application is received). After the boundary &type are approved (and after determining whether the project location is in or out of the building setback zone),we can then determine the exact amount of allowed wetland impact allowed under the De minimis exemption. The plans are dated 8-14-10. We have the following comments with regards to engineering matters: • The grading plan and narrative provide sufficient information to evaluate the grading and the work appears acceptable from an engineering standpoint. However, due to the limited plan information a site review should be done by ciry stafF just prior to final restoration. • Minnehaha Creek Watershed District permits will likely be needed with this project. The site should be reviewed for wetlands by the MCWD prior to filling activities. Owner requests the City to review this application. 3. The City will commence its review of the application and incur costs associated w�h said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUND Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $��ith the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incuned (including planning, engineering or legal consultant review)or will incur in reviewing the plan. Eligibie expenses shall be consistent with expenses the Owners would be responsible for under a zoning permit application. 7he escrow will also guarantee reimbursement to the City for all out-of- pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the wo�lc and to repair any damage to pubiic property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with zoning pertnit#20`D��Z?� if compliance with the approved zoning permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when the review has been completed and written notfication is received from the Owners requesting the funds. 6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn.
