RE: Deck Construction
Dear Mr. Lee,
It has come to the attention of this department that you have recently constructed a deck
on your property at 601 Minnetonka Highlands Lane. This letter is to inform you that
Building Permits are required for deck construction in the City of Orono and that decks
are required to meet building and zoning code requirements.
Therefore The City must require you to remove the deck or submit a permit application
with building plans, hardcover calculations, and a survey showing the location of the
deck. If the deck is found to be in compliance a permit will be issued. A deadline of
December 15, 2003 has been established for removal or application submittal. If this
deadline is not met The City may initiate legal action. If you have any questions please
feel free to contact me at my office.

Dear Mr. Oman:
I have received your letter of December 2nd stating that I have
constructed a new deck at my property at 601 Minnetonka Highlands
Lane. I would like to have the record show that I contracted
with E & J Construction Company, Earl Austad, Owner, to replace
the existing deck and concrete pad.
This deck and pad have been in existence for approximately 30
years, since we purchased this house. This was a new home 30
years ago built by Dean Bailey of The Carpenters Construction
Company. That deck had become dangerous for anyone to use and
for the sake of safety it had to be replaced. The replacement
deck is one foot smaller in size than the original deck. The
concrete pad is the same size as it was originally. Earl Austad
of E & J Construction Co. informed me that he called your office
and someone told him that being this was a replacement deck, a
permit was not necessary.
For the record I called your office, after I found the yellow
notification card under my garage door on November 23rd, and left
messages for Bruce Vang on November 24th and November 25th. And
Earl Austad said that he would call Mr. Vang regarding this
matter. We have not heard anything since, so I am enclosing the
form you sent me for a building permit application, if that is
necessary in this instance. I am also enclosing the plans
provided by Earl Austad.
