McClelland and Jeanie L. McClelland, l�usband and wife (hereinafter "the applicants") are the o�vners of the property located at 2170 Miiuzetot�ka Avenue within the City of Orono (hereinafter the "City") and legally described as follows: Lots 4, 5, and 6, Blocic S, Monterey on Miiuletonka EXCEPT the Noi�th 12.00 £eet of said Lots 4, 5, and 6, Heinlepin Cotu�ty, MiiuZesota (hereinafter the "properiy"); and WHEREAS, the applicants have made application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-420 Subdivision B for the construction of a new single family residence on a lot 0.56 acre in area and 175' in width where 2 acres in area and 200' in width are nomzally required. NOW, THEREFORE BE IT RESOLVED Uy the City Council of Orono, Miiulesota: FINDINGS 1. This application�vas reviewed as Zoning File#04-3050. 2. The property is located in the RR-1B, One Fainily Rural Residential Zoning District which requires a minimum lot area of 2 acres and a ininimum lot width of 200'. 3, The Planning Commission reviewed this application at a public hearing held on September 20, 2004 and recommended approval of variances based on the following findings: a. The applicants' proposed home will meet RR-1B Zoning District standards with re�ard to hardcover, setbacks and lot coverage, and no variances other than lot area and lot width are required. c. No additional land is available for acquisition by the applicants to make the property confornling in area or width. d. The property is sei-ved with muilicipal sewer and contains an existing residenee. e. The property is located witlun a small lot neighborhood in the RR-1B Zoning District and is similar in size to many of the lots in this nei ghborhood. 4. The City Council has considered this application including the findings and reconunendation of the Plaiuiing Commission, reports by City staff, coiruzlents by the applicants and the pubiic, aild the effect of the proposed variance on the health, safety and �velfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboriug property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a denzonstrable hardship or difficulty; is necessary to presei-ve a substantial property right of the applicants; and would be in lceeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. , CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findin�s, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Section 78-420 Subdivision B to allow a new single fainily residence to be constructed on a lot 0.56 acre in area and 175' in width where 2 acres and 200' are nonnally required, subject to the following conditions: 1. Council approval is based on the site plaii submitted by the applicants and aruzotated by City staff, attached to this Resolution as Exhibit A. Hardcover in the 75-250' zone shall be limited to 2,185 s.f. or 25% and hardcover within the 250' — 500' setback zoiie shall be limited to 4,G37 s.f. or 30% as perniitted by City Code. Applicants are advised that any future requests to inerease hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover aUove the allo�ved limits will not likely be approved without concunent reduction in existing hardcover. 3. Applicants shall remove all plastic or fabric liner material from the decorative landscape Ueds on the property to ensure their penneability as non-hardcover surfaces. 4. Requircd renlovals of structure and hardcover shall be completed by the footing inspection. 5. Authorities granted by this resolution run with the property not with the applicants, but are pennissive only and must be exercised by obtaininj a building peimit for the new construction within one year of the date of Council approval, or tlie variance will expire on tlzat date (Septenlber 27, 2005). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any autliority granted herein, and shall be punishable as a misdemean.or. 7.- The uizdersigned applicants have read, understand and hereby agree to the tenns of tllis resolution aud on behalf of the applicants and the applicants' heirs, successors and assi�is, hereby agree to the recording of this resolution in the chain of title of the property.
