A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-966, 78-967 8� 78-1286 FILE NO. 14-3670 WHEREAS, Rodney P. Burwell and Barbara Etaine Burwell, husband and wife (hereinafter "the Owners") are the owners of the property located at 1100 Millston Road within the City of Orono (hereinafter the "City") and legally described as: Lots, 3, 4 and 5, Block 1, Millston, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, the Owners have made application to the City of Orono for a variance from Orono Municipal Zoning Code Section 78-1279 to atlow construction of a replacement lake access stair and new subterranean retaining walls within 75 feet of the OWHL of Tanager Lake to replace an existing deteriorating stair, repair ravines caused by erosion and stabilize the slope; and WHEREAS, the Owners have made application to the City of Orono for a conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966, 78-967 and 78-1286 to allow grading for construction of subterranean retaining walls, new stair system and landscape plantings in conjunction with slope stabilization measures, to create an armored swale directing storm water toward the lake and removal of the existing stairs within 75 feet of the OHWL on the Property; and WHEREAS, the Owners have made appfication to the City of Orono for variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow new hardcover in conjunction with construction of a replacement lake access stair with low retaining walls within 75 feet of the OWHL of Tanager Lake where no hardcover is permitted; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on May 19, 2014 at which times all persons desiring to be heard concerning this application were given the oppo►tunity to speak thereon. � Page 1 of 5 . �-o�o C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL � ti � �,� f .41Z NO. rAKES H��� NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 14-3670. 2. The Property is located in the LR-1A One Family Lakeshore Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. 3. The Planning Commission reviewed this application at a public hearing held on May 19, 2014 and voted 7 for and 0 against on a motion to approve the variances and conditional use permit. The Planning Commission finds that the following factors support the granting of the request: a. The Property has 10.1 acres ir� area (or 441,332 square feet). Including the adjacent properties the Owners own approximately 15 acres of land. b. The Property has approximately 400 feet of width at the OHWL and _ approximately 407 feet at the 75-foot setback c. The existing stair is deteriorated. The new stair is essential in order to access the lakeshore over the steep slope and is necessary for the Owners' enjoyment of the Property. The meandering in-grade stair will serve to better protect and stabilize the slope than an above grade stair where erosion can occur beneath. d. The proposed additional hardcover resulting from the meandering stair and low walls is reasonable, consistent with the comprehensive plan and will not alter the character of the area. e. The Owner has provided a landscape plan which will serve to screen and mitigate views of the proposed stairs (and small walls) and armored swale from the lake. f. The hardcover within the.0-75' zone should not increase with the installation of the new fake access stair and reorientation of the lake access path. With approximately 54,372 square feet or 12.3% overall hardcover, the Property will conform to the hardcover limitations of a Tier 1 lot. The proposed armored swa�e, meandering stair with low walls within the 75- foot setback will not alter the essential character of the neighborhood and will result in minimal or no negative impact on adjacent proper�ies. h. The sub-grade retaining walls will be hidden under the earth and beneath vegetation offering a natural looking shoreline from the lake. i. The installation of the sub-grade retaining walls will help to support the slope and, combined with the armored swale and vegetation plan should help to improve storm water quality and prevent further erosion from the site. j. The Owners have provided a landscape plan which will serve to stabifize the slope as well as screen views of the proposed improvements from the lake. k. The Owners have provided a plan to reorient the existing lake access path to the new stair system which results in 16 square feet less hardcover within the 0-75' zone. I. The Owners' request is in harrnony with the purpose and intent of the ordinance, consistent with the comprehensive plan and will not alter the character of the area. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Owners and the public, and the effect of the proposed variances and conditional use permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council grants: a variance from Orono Municipal Zoning Code Section 78-1279 to allow construction of a replacement lake access stair and new subterranean retaining walls within 75 feet of the OWHL of Tanager Lake repair ravines caused by erosion and stabilize the slope; and variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow new hardcover in conjunction with construction of a replacement lake access stair with low retaining walls within Page 3 of 5 �-o�o � � C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL y`�r,, ti`'~� N o. 6 4 1 Z kESNOt� 75 feet of the OWHL of Tanager Lake where no hardcover is permitted; and a conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966, 78-967 and 78-1286 to allow grading for construction of subterranean retaini.ng walls, new stair system and landscape plantings in conjunction with slope stabilization measures, to create an armored swale directing storm water toward the lake and removal of the existing stairs within 75 feet of the OHWL on the Property; subject to the following conditions: 1. Council approval is based on the survey, plans and hardcover calculations submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A, B and C. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed overall hardcover levels are conforming to the Tier 1 standards; hardcover within the 0-75' zone shall not increase above the approved level of 632 square feet. 3. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining permits for the project and commencing construction of said project within one year of the date of Council approval, or the approvals granted by this Resolution will expire on that date (June 9, 2015). 4. An as-built survey will be required upon completion of the project prior to refund of the permit escrow. 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. � 6. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behatf of the Owner and the Owner's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
