However we do require a 35 foot setback from the edge of the wetland. In this case where the MCWD is in the process of approving the edge of the wetland we need to wait to have the edge confirmed to accurately apply our setback measurement. The delineated line on the revised survey in the wetland delineation packet appears to exceed our 35 foot setback from the newly delineated edge of the wetland. This survey is not to scale. As we discussed we will need 2 full sized copies of the revised survey, showing the new delineation. The survey shows the proposed grading albeit with a very lightly shaded line so our engineer can review the plan. We will probably be able to issue the permit pending no unknown issues come up relating to grading, etc, early next week if you're able to drop off the scaled surveys tomorrow or Wednesday... Catherine Bach from MCWD is coming out this week to do a site visit and confirm the wetland boundaries. As I read the city's letter(dated April 17), Item 5 states the City can issue me a permit with a copy the MCWD permit, which in this case only requires an approved erosion control permit. I'm not sure if/why the City requires/supersedes the need for an approved wetland delineation when MCWD does not require it? Sorry if I'm being obtuse, but just a little confused on some of the reasoning behind the requirements? If the City does require a formal approval on the wetland delineation, is there anvthin� I can do from the City's standpoint to avoid the 15 business dav comment period? Just thinking outside the box...if it helped, I have talked with all of my neighbors, and everyone is willing to sign a document stating they do not oppose my pool permit? The difference means digging mid-June (and hopefully getting to use the pool this summer) instead of starting mid-late luly?? Please let me know what else I can be doing to help. I am willing to do whatever it takes to keep things moving. I spoke with Catherine Bach on Friday about the "unclassified" wetland that may exist based on the City's files. She said it is not a wetland according to the MCWD, and can send that in writing to the City if needed. 4. With the recent ordinance change, it sounded like the vegetation buffer no longer applies to my case? 5. In an email from Meaghan Watson on Friday, she confirmed that "the project won't trigger the wetland protection rule, so we can issue this just as an erosion control permit and do not need to notice the project or approve the delineation prior to issuance." Your application is incomplete. The following items must be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Certificate of Survey. A survey was submitted with the application. Our City engineer has reviewed the survey, his comments are attached. Please provide 2 copies of an updated, full size certificate of survey which meets all of the City's survey standards (enclosed) indicating the location of the proposed pool, including existing and proposed grading as well as all existing buildings, structures, landscaping and retaining walls on the property. �' Building Permit Application for a Swimming Pool. The property owner's signature is required on the building permit application prior to the issuance of the pool permit. 3. Wetland Delineation. According to the City's wetland map, two wetlands are present. One wetland is classified as a Manage 2 wetland. According to Orono's City Code Chapter 78 Article XI Wetlands Protection, Manage 2 wetlands require a 25 foot wide vegetative buffer. Also, the map indicates an "unclassified" wetland may exist on the property. Additional information may need to be submitted to the MCWD and the City to determine buffer width. Contact the MCWD to determine if it is necessary to hire a wetland delineator to perform a MN Ram analysis and complete a functional assessment to determine the preservation classification (i.e. buffer width) of the unclassified wetland. Please submit a wetland delineation report to the Minnehaha Creek Watershed District (MCWD) for their approval. The approved delineated edge of the wetland(s) must be shown on the survey including the required buffer width and structure setback of 20 feet. 4. Wetland Buffer(s). The proposed project appears to trigger the administration of the City's Wetlands Protection regulations. Once the delineated edge of the wetland and the required buffer has been marked in the field by the surveyor, our wetland specialist will visit the site. The wetland specialist will determine if the existing wetland buffer meets with City Code Section 78- 1605 or if a buffer must be established. A report will be generated stating if the buffer meets city code or if invasive species must be removed and native vegetation planted. The wetland specialist report will also contain an escrow amount, which must be received prior to the swimming pool permit being issued. The wetland buffer escrow will ensure the wetland buffer improvements or establishment are completed. You will be required to submit a planting plan for the wetland specialist to approve. You are required to contact the MCWD regarding your proposed project to determine if your project triggers any of the MCWD permitting requirements. The City of Orono will not issue a building permit without a copy of the permit from the MCWD or written documentation stating the proposed project does not trigger any MCWD permitting requirements. 6. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer quire submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is $2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for $2,500. The above information is required in order for the plan review to continue.
