There are possible problems with the 2nd driveway, a shed, a fence, regrading, hardcover, and lot coverage. Contact Michael Gaffron, Assistant Planning & Zoning Administrator, before December 10 , 1990 to arrange a meeting to discuss how you can resolve these problems. The following deadlines will be set for completion of this work: l . Portions of the fence which exceed 6' in height or are over the lot line shall be brought back into the property and reduced to a height of 6' by June l, 1991. 2. The shed must be moved by June 1 , 1991 , to a location meeting the 10' side setback requirement as well as being at least 5' from the rear lot line and 10' from any other structures. A review of City files and maps indicates that your property is just over 1,000' from the nearest lakeshore, hence under current codes your property is not subject to hardcover limitations. Your property is subject to a 15$ limitation on lot coverage by structures, as are all lots in Orono less than 2 acres in area. Your property is currently at approximately 9$ coverage, meeting the lot coverage requirement. However you should be advised that the tennis court would be considered as lot coverage if it became partially or fully enclosed by fences, railings or walls which e:ctend more than 6' above grade. If your 56' x 30' tennis court became partially enclosed in that manner, your lot coverage would exceed the 15$ limit. It is my opinion that your graded 30' x 56' gravel pad is precariously close to being considered as a tennis court required to meet such setback. Hence any construction of backboard wal ls or fences at its perimeter and over 6' in height would not be allowed. Because you stated your intent is to use this area as a small tennis court, you may wish to apply for variances to allow construction of walls around it. I cannot give you any good estimate of whether this would be approved. However, given the intent of the Planning Commission and Council to require tennis courts and pools to be 30' from lot lines rather than the 10' requirement which was in place prior to 1989, your application might not be successful.
