Subject: Building Without a Permit -
Revocation of Burning Permit (#11-306-88)
On November 3, 1988, the City received a complaint that Mr. Henke was
pouring concrete in the rear yard area of his property. At approximately
15:45 hours, I conducted an inspection in which Mr. Henke was on the
property. As I entered the property, I went and spoke to Mr. Henke and his
first response was "do you have my burning permit with you?" I explained
to Mr. Henke that I did not have his burning permit and that I was there to
check on his property for a code violation of pouring concrete. Mr. Henke
took me back behind the garage and showed me a 3-4' wide section of
concrete by 20' long which he had poured which connected an existing slab
to his already existing garage. I explained to Mr. Henke that this was in
violation of the ordinances and that I would think that he would want to
comply with the ordinances and not have more trouble than he already has.
His statement to this was that if he could not get a permit for it, that he
would break it out because it would stil 1 be green. I told Mr. Henke that
I would have to check with the City Attorney on this matter to find out
what type of action the City would be taking.
As I was leaving the property, Mr. Henke referred to his "No
Treaspassing" signs and told me to obey them and that he was leaving for
City Hall to pick-up his burning permit. I explained to Mr. Henke that his
burning permit was revoked, he continued on past me and went to City Hall.
At that point I met Mr. Henke in City Hall and explained again that his
burning permit was revoked due to the fact that we cannot go onto his
property and check to make sure that he is not violating any conditions of
the burning permit and that burning permits are a privilege, not a
necessity, therefore the permit is revoked. As Mr. Henke was leaving, his
last statement was "Things were going to get worse before they were going
to get better!"
After Mr. Henke left, I wrote a letter to Mr. Henke which will be
hand-delivered by the Orono Police Department that his burning permit has
been revoked.

Dear Mr. Henke:
On November 3, 1988, I conducted an inspection on your
property to check for a vio lation of bui lding without a permit.
During this inspection I met with you and we discussed the slab
you were pouring. I explained to you that this was in violation
of codes and that I would be checking with the City Attorney to
see what type of action would have to be taken. As I was leaving
the property you stated that I must obey the sign "No
treaspassing". Since City employees cannot go onto your property
and burning permits are a privilege not a necessity your burning
permit #11-306-88 has been revoked. If you are found burning on
the property, citations wil 1 be issued and the matter referred to
the City Attorney for proper legal action. If you have any
questions on this matter contact me at my office.

- Wood and paper products only

3. If piles are not easily found and no one will be home, you must
draw a map on back side of permit application locating the burn pile.
4. If these conditions are not met, the permit will be denied and you
may not apply for another permit for 30 days.
5. Read all conditions on backside of permit before burning.
Violations of these conditions may result in the issuance of citations
and permit may be revoked.

On November 3, 1988, I received a complaint the Mr. Henke
was pouring concrete in the rear yard area of his property. At
approximately 1545 hours I conducted an inspection in which Mr.
Henke was on the property. As I entered the property 2
approached Mr. Henke to advise him that I was on the property to
check for a code violation of pouring concrete. Mr. Henke took
me back behind the garage and showed me a section of concrete
that was 3' to 4' wide and 20' long, which he had poured. This
section of concrete was connected to an existing slab and Mr.
Henke's pre-existing garage. I explained to Mr. Henke that he
was in violation of the ordinances and that I would think that he
would want to comply with the ordinances and not have more
trouble that he already has. His statement to this was that if
he could not get a permit for it, that he would break Yt out
because it would still be green. I told Mr. Henke that I would
have to check with the City Attorney on this matter to f ind out
what type of action the City would be taking.
Af ter speaking with the City Attorney, Bryan Crawf ord, and
reviewing the files of the subject property, the City has no
alternative but to write citations for the above violation. This
is due to the fact that Mr. Henke has been found working on his
property twice before without permits. On January 29, 1987, Mr !
Henke installed a side door on the existing house on the property
(which has not been completed), and on June 10, 1983, Mr. Henke
was found filling and grading on the property without a permit.
Mr. Henke was notified that permits are required, and
therefore, Citation #388051782 was issued to Mr. Henke.

Subject: Building Permit
On November 21, 1988, Mr. Henke came to the office and spoke to me
about his permit. He was upset that I noted on the application that we
could not verify slab conditions on the edges because no details had been
submitted and we did not do an inspection (the work that we are talking
about has already been conpleted). Mr. Henke was also upset that there was
an investigation fee of $30.00 for working without the permit. I explained
to Mr. Henke that if he provided a detail of the slab condition at the
edges, that I would accept this and remove the note at the bottom of the
application which states that he cannot put a shed or building on top of
the slab. Mr. Henke appeared that he understood this, explaining to me
that he would not be picking up the permit at this time, and that he would
have to talk to his attorney about the matter due to the legal proceedings
going on. I told Mr. Henke that I understood this and that it was fine.
He left the office.
