Dear Mr. Henke:
I conducted an inspection at the above subject property on November
17, 1987. This inspection revealed that you are in violation of the
following Ordinances:
Orono Municipal Code
Section 9.01, Subdivision 2 - Storage of Refuse. Items stored in
front yard are considered refuse and must be removed within 7 days.
Section 9.21 - Public Nuisance. Maintaining conditions which
unreasonably annoys the members of the public.
Section 9.22 - Permitting a Public Nuisance. Enforces Section 9.21.
Section 9.50 - Junk Cars, furniture, household furnishings and
appliances on public or private property. Items stored in front yard,
inoperable and unlicensed vehicles not allowed. ;
Section 9.52, Subdivision 2 (B) - Parking of recreational camping
vehicles. Camper is within 10 feet of the property line. '
Section 9.55, Subdivision 1 - Maintenance of Private Property. It is '
the duty of the property owners to maintain property in a neat and '
presentable manner free of junk and debris, etc.
Section 10.60, Subdivision 13 - Exterior Storage in Residential
Districts. This section does not allow storage of mobile materials '
and equipment unless in a building or fully screened.
Section 10.60, Subdivision 14 - Waste Materials. Also requires waste
materials to be stored in building or in container with exception of
construction materials. �

I am writing this letter to inform you that you are in violation of
the above Orono Ordinances and State Building Code.
This department has in the past spoken to you on these matters (with
exception of the exit), therefore enclosed is a warning citation.
To avoid further citations and legal action, the following corrections
must be done:
l. Remove junk and debris from yard areas. This includes, but not
limited to, old washing machine, toilet, push lawn mower, old metal
cabinet, plastic plant, etc. in front of the house.
2. Remove or store inside of building all inoperable vehicles and car
parts.
3. AI1 operable vehicles must have current license plates and tabs
and parked not closer than 10' from property Iine.
4. Recreational vehicle must have current license plates and must be
moved to not closer than 10' from property line.
5. Provide containers to store waste materials or store inside
building.
6. Provide a stairway at exit door which meets State Code
requirements. This is so you have a safe exit in case of emergency.
These corrections must be made within 7 days (November 1987) to
avoid legal action.

PUBLIC PROTECTIOiJ, CRIMES AND OFFENSES
SBCTION. 9.01. STORAGE, DEPOSYT AND DISPO�AL OF REFIISE.
Subc3. 1. Definitions. The following terms, as used in
this Section, shall have the meanings stated:
A. "Refuse" - Includes all organic material
resulting from the manufacture, preparation or serving of food or
food products, and spoiled, decayed or waste foods from any source,
bottles, cans, glassware, paper or paper products, crockery, ashes,
rags, and discarded clothing, tree or lawn clippings, leaves, weec7s
anc7 other waste products, except human waste or waste resulting
from building construction or demolition.
B. "Residential Dwelling" - Any single building
consisting of one through three dwelling units with individual
kitchen facilities for each.
C. "MultiPle Dwelling" - Any building used for
resic3e�tial purposes consisting of more than �hree dwelling units
with individual kitchen facilities for each.
D. "Commercial Establishment" - Any premises where
a commercial or industrial enterprise of any kind is carried on,
anc3 shall include restaurants, clubs, churches, conference centers
and schools where food is prepared or served.
Subd. 2. Storage.
A. It is unlawful for any person to store refuse on
residential dwelling premises for more than one weeke All such
storage shall be in five to thirty gallo� metal or plastic
containers with tight-fitting covers, which shall be maintained in
a clean and sanitary condition; provided, that tree Ie�ves, vaeeds
and grass clippings may be stored in plastic bags and tree limbs
must be stored in bundle� weighing no more than seventy-five pounds
and no longer than four feet.
B. It is unlawful for any person to store refuse on
multiple dwelling premises for more than one week. 5uch storage y
shall be in containers as for resiclential dwelling premises, except �
that containers, sometimes referred to as "dumpsters`°, with close-
fitting covers may be substituted.
C. It is unlawful for any person to store refuse on
com mercial establishment premises for more than forty-eight hours.
Such storage shall be in containers as for residential dF�elling
� - premises, except that containers, sometimes ref�rred to as

� SEC. 9.20. DISORDERLY CONDUCT. It is unlawful for any
person, in a public or private place, knowing, or having reasonable
grounc3s to know, that it will, or will tend to, alarm, anger or
disturb others or provoke any assault or breach of the peace, to do
the following: (1) engage in brawling or f ighting; or, (2) disturb
an assembly or meeting, not unlawful in its character ; or , (3)
engage in offensive, obscene or abusive language or in boisterous
and noisy conduct tending reasonably to arouse alarm, anger or �
resentment in others; or , (4) willfully anc7 lewdly expose his
person or the private parts thereof, or procure another to so �
expose himself; and any open or gross lewdness or lascivious �
behavior , or any act of public indecency; or , (5) whether or not �
posted with signs so prohibiting, voluntarily enter the waters of
any river or public swim ming pool at any time when said waters are
not properly supervised by trained life-saving personnel in atten-
dance for that purpose, or enter such waters without being garbec7
in a bathing suit sufficient to cover his person and equal to the �
s�andards generally adopted and acceptec3 by the public; or , (6) I
urinate or defecate in a place other than (a) if on public property ,
then in a plumbing fixture provided for that purpose, or (b) if on
the private property of another then in a plumbing fixture providec3
for that purpose, or (c) if on private property not owned or con-
trolled by another , then within a building; or , (7) cause the
making or production of an unnecessary noise by shouting or by any
other means or mechanism including the blowing of any automobile or
other vehicle horn; or, (8) use a sound amplifier upon streets and
public property without prior written permission from the City; or,
(9) use a flash or spotlight in a manner so �s to annoy or endanger
others; or, (10) cause defacement, destruc�ion, or o�herwise damage
to any premises or any property located thereon; or, (11) strew,
scatter, litter, throw, dispose of or aeposit any refuse, garbage,
or rubbish unto any premises except into receptacles provided for
such purpose; or, (12) enter any motor vehicle of another without
the consent of the owner or operator ; or , (13) fail or refuse to
v�cate or leave any premises after being requested or ordered,
whether orally or in writing, to do so, by the owner, or person in
charge thereof, or by any law enforcement agent or official; pro-
vided, however, that this provision shall not apply to any person
cvho is ov�ner or tenant of the premises involved nor to any law
ent-orcement or other government official who may be present thereon
�t that time as part of his official duty, nor shall it include the
wife, children, employee or tenant of such owner or occupier.
SEC. 9.21. PUBLIC tdDISANCE. It is unlacaful for any person to '
maintain a public nuisance by his act or failure to perform a legal
duty, and for purposes of this Section, a public nuisance shall be
defined as any of the following: (1) maintaining or permitting a
condition which unreasonably annoys, injures or endangers the
safety, health, morals, comfort or repose of any considerable
number of inembers of the public; or , (2) interfering with,
obstrucfcing or renc3ering dangerous for passage, any street, public
;_ right-of-way, or waters used by the public; or, (3) any other act
or omission declared by law to be a public nuisance.

vehicle lacking essential parts, household furnishings or o ;
appliances, or parts or components thereof, on any property, public �� !
or private, unless housed within a lawfully erected building. Any
violation of this Section is declared to be a nuisance and upon '
seven clays written notice to the owner, as shown by the records in
the office of the County Auditor, of private premises on which such.�
material is found, the City may remove the same and certify the �
cost of such removal as any other special assessment. For the :
purpose of this Section, an inoperable motor vehicle shall be
definec7 as lacking, including but not limited to, parts essential
to operation, such parts being wheels, tires, motor, drive train,
batte�y, or having two or more flat tires, or having the interior,
including the driver's position, usec7 for storage in such a manner
that no person can operate the vehicle.
SBC. 9.51. ABANDONIAIG A MOTOR VEHICL�. It is unlawful for
any person to abandon a motor vehicle on any public or private
property wi'chout the consent of the person in control of such
property. For the purpose of this Section, a "motor vehicle" is as
defined in Minnesota Statutes, Chapter 169.

A. "Travel Trailer " - A vehicular , portable
structure built on a chassis, designe8 to be used as a tempor�ry
dv�elling for travel, recreational, and vacation uses, permanently
identified °'Travel Trailer" by the manufacturer of the trailer.
B. "Pick-up Coach" - A structure design�d �co be
mounted on a truck chassis for use as a temporary dwelling for
travel, recreation and vacation.
C. "t�iotor Home" - A portable, temporary dwelling to ��
be used for travel, recreation and vacation, constructed as an
integr�l part of a self-propelZed vehicle.
D. "Camping Trailer" - A folc3ing s�ructure, mounted
on wheels and designed for travel, recreation and vacation uses.

habitation, except in a licensed mobile home park or City-owned ;

mobile home or recreational vehicle in any "Residence pistrict" for i
more than twenty-four hours, except in a side or rear yard at least i
ten feet from any property line. `
C. It is unlawful to use a mobile home or recrea-

for more than seventy-two hours without a permit from +che City.
SEC. 9.53. C�AISUI�YPTION A�TD POSSESSION OF �E�ER, S�7INE OR LYQUOR
O;� S�RL�TS APdD PUBLYC PROPSRTY. It is unlawful for any person to
consune, or possess in an unsealed container, beer, wine or liquor, ,�
as those terms are clefined in Chapter 4 of the City Code, on any i
street or other public property except City parks and other public �
property when and where permission has been specifically granted or �
licensed by the Council. Provided, that this Section shall not

S�C. 9.55. l9AINTENANCB OF PRIVATS PROP�RTY.
Subd. 1. ' It is the duty of the owner of every vacant
property and the owner and occupant of every occupied property to �
maintain same in a neat, clean and presentable manner free of any,
junk, c]ebris, re€use, litter, ciead trees, or noxious weeds, and to
remove all other public health or safety hazards therefrom.
Subd. 2. Grass and Weeds. The owner or occupant of
every lot or parcel shall regularly cut or otherwise maintain all
grass and weeds thereon at a height of not more than six {6)
inches, excep� this provision shall not apply to the following:
A. Publicly-owned parks, trails or nature areas.
B. Property actively being farned or used for
agricultural purposes in conformance with the Zoning Chapter .
C. Residential properties in excess of one acre
f gross lot size when located in the RR-lA, RR-1B, LR-ZA and RS Rural
Residential Zoning Districts, provided that such nroperties or
portions thereof shall be maintained in conformance with this
Subdivision upon notice from the City that lack of such main!cenance
has caused complaints from abutting property owners and is thereby
creating a public nuisance.
D. Wetlands vegetation as defined in the Zoning ,
Chapter. '
E. Grass, weeds or underbrush on any slope in
excess of 100 percent (45 degrees) .
S�C. 9.56. VACANT, DAMAGED OR HA.ZARD��S EfJYI,DINGS.
Subd. 1. Vacan� Buildings. I� is unlawfuZ for the owner
of any property to keep or allow to exist any vacant builc3ing which
is open to trespass or is not secured agains� unauthorized entry. ,,
When an unsecured building is found, the Building Official shall
post the premises and shall issue orders in person or by mail to
the last known owner of record requiring that the building be
secured within 48 hours. Failure to secure the build.ing upon
issuance of such orders shall be cause for �he Ci�y to properly
secure the building, to cause the costs thereof to be charged
against the property as provided by Minnesota Statutes Section
� 463.251, and to commence hazardous building proceedings pursuant to
_ Minnesota Statutes Section 463.15 et seq.

( odorous or solid matter of such quality and quantity as to be
readily detectable at any point beyond the lot line of the site on
which the use is located.
Subd. 7. Vibration. Any use creating periodic earth-
shaking vibrations, such as may be created from a drop forge shall
be prohibited if such vibrations are perceptible beyond the lot �
line of the site on which the use is located. The stanc]ard shall I
not apply to vibrations created during the process of construction. �
Subd. 8. Glare or Heat. Any use requiring an operation !
producing an intense heat or light transmission shall be performed '
with the necessary shielding to prevent such heat or light from
being detectable at the lot line of the site on which the use is
located. Lighting in all instances shall be diffusec7 or directed
away from "R" Districts and public streets .
Subd. 9. Explosives. Any use requiring the storage,
utilization or manufacturing of products which could c]ecompose by
detonation shall be located not less than 400 feet from any "R"
District line.
Subd. 10. Screening Required. Sc�eening shall be
required in residential zones where:
� A. Any off-street parking area which contains more
� than four parking spaces and is within 30 feet of an adjoining
residential lot line, and ,
B. Where the driveway to a parking area of more
than six parking spaces is within 15 feet of an adjoining
residential lot line.
Subd. 11. Screening, Type of. The screening required
herein shall consist of a solid fence or caall at least 50� open,
not less than four feet nor more than five feet in height but shall
not extend within 15 feet of any street or driveway opening onto a
street. The screening shall be placed along the property lines or
in case of screening along a street, 15 feet from the s�reet right-
of-way with landscaping (trees, shrubs, grass and other planting)
between the screening and the pavement. A louvered fence shall be
considered solid if it bTocks direct vision. Planting of a type
approved by the Planning Commission may also be required in
addition to, or in lieu of, fencing.
Subd. 12. Maintenance. In all districts , all
structures, required landscapinq and fences shall be maintained so
as not to be unsightly or present harmful health or safety
conditions.
Subci. 13. Exterior Storage in "R" Districts. In all "R"
( Districts, all mobile materials and equipment shall be stored

Subc3. 14. Waste Mater ials. Waste mater ial shall not be �:
washed into the public storm sewer system nor the sanitary sewer �`
system without firs� having received a permit to do so from the �`
City. If said permit is not granted, a method of disposal shall be r
devised which will not require continuous land requisition for E,
permanent operation and will not cause a detrimental effect to the 'i
adjacent land. Should the waste be of solid form rather than �
fluid, the storage area shall be so located and fenced as to be
removed fro m public view. In all c3istricts, all waste material, �
debris, refuse, garbage, materials not currently in use for
construction or otherwise regulated herein shall be kept in an I
enclosed building or properly contained in a closed container for
such purposes. The owner of vacant land shall be responsible for
keeping such vacant land free of waste material and noxious weeds.
Subd. 15. Drainage. No land shall be clevelopecl and no
use shall be permitted that results in water runoff causing ;
flooding, or erosion on ac3jacer.t properties. Such runoff shall be �
properly channeled into a storm drain, ��ater course, ponding area
or other suitable facility.
Subd. 16. Traffic Control. The traffic generated by any
use shall be channelized and controlled in a manner that will avoid
congestion on public streets, safety hazards, or excessive traffic
through residential streets. Vehicles backing from a parking space
shall not back into the public street. No access drive to any lot
shall be located within 20 feet of any two intersecting street
right-of-way lines.
Subd. 17. Radiation, Etc. No activities shall be
permitted that emit dangerous radio activity beyond enclosed areas.
There shall be no electrical disturbance adversely affecting the
aperatian of any point of any equipnent including but not Iimited
to radio and television reception other than that of the creator of

the disturbance.

At the request of the Mayor, I have reviewed the files on the property
located at 3536 Lyric Avenue. The Mayor had received calls from
neighboring property owners complaining that the current owner is
operating an autorepairbusinessfrom his home. They also complained
of the run down condition of the yard and house, questioning whether the
house is liveable in its present state. One neighbor has talked to me
of concern for the neighborhood children that play under the house
amongst the support blocks. After reviewing the Henke file and
observing the property for a few weeks, I asked permission of the City
Administrator to schedule Henke for an appearance before the Council.
Brief review of the file on 3536 Lyric Avenue from May ' 82 to present.
This next section will be a poor and limited attempt at depicting for
you a very heated and active two year exchange between Henke and the
City staff. Read the Building Official ' s chronology (exhibit E) for
more details. Please call staff if you have any guestions concerning
code requirement prior to the meeting.
The property was originally owned by an 80+ year old hermit. The house
consisted of a single room that served as bedroom, bathroom and
kitchen. Thefiles contain picturesof thestructure prior to Henke' s
renovations. Uponthe death of the originalowner, the City initiated
proceedings to declare the structure a hazardous building. In May of
' 82 Henke appeared on the scene and stated he was interested in the
property. Asked the inspector if temporary repairs could be made to
the structure so that he could live in it for a year when he would then
tear it down and build a new home. A permit was issued to Henke in June
of ' 82 to complete specific improvements for temporary use. In
September of ' 82 Henke informed the City that he planned to live in the
house permanently and wanted to put in a woodburning stove. He was
advised of the need to install footings and foundation if it was to be

used as a permanent structure. In February of ' 83, Henke siqned off on
a temporary Certificate of Occupancy (exhibit A) that required the
following to be completed:
1 - footings and foundation by July 31, 1983
2 - roof replaced by July 31, 1983
Since the temporary Certificate of Occupancy was issued Henke has had
many meetings and "exchanges" with staff. The City agreed to extend
the expiration of the temporary Certificate of Occupancy in order to
allow time for Henke to apply for a CDBG grant from the County. After
many delays (exhibit D) , Henke filed an application with the County and
was denied because of unpaid real estate taxes due on the property since
1982. A fact that puts him in default of his Contract for Deed (exhibit
B} but this is not pertinent to the City only to the estate of Richard
Gilmore.
Current status of the property.
Nothing has been done to the structure since February ' 83 - at least not
the required improvements set forth in the temporary Certificate of
Occupancy. As to reports of an auto repair operation, staff has
inspected this property twice a week since July of ' 84. We have found
no visible signs of a commercial operation. Staff has reported the
following violations:
1 . Unlicensed van parked in rear of yard - now removed
2. As of 10-10-84, the field inspector reports the grass in rear yard
is still 4 feet tall
3 . As of 1PJ-lf�-84 , the inspector reports there are no unlicensed or
"junk" cars on the property. There have been 2 to 3 cars parked in
the driveway area on the property off and on for the past two to
three months
Two weeks ago, I asked the Building Off icial to give me a current update
on his dealings with Henke. Jacobs advised that Henke still planned
to construct pier footings but that he had no money. Grants are not
available to anyone who refuses to pay taxes. In fact, Mr. Henke may
live for seven years in this structure without paying his real estate
taxes before the property is forfeit. In review of the Inspector ' s
chronology, Henke claims his back problems prevent him from doing the
work himself. Jacobs was advised to issue the necessary tags (review
exhibits G and H) .
Council action
No action is required of Council. I suggest you listen to Mr. Henke and
advise staff to proceed with the enforcement of the Building Code. At
this point, I would say enforcement that is well over due.
You may also adivse Henke that Council has no authority to grant
variances to the performance standards of the Building Code.

Dear Mr. Henke:
In reviewing your file, I have found that there has been no progress in
completing the footings as required.
On February 23, 1983, you requested that the City give you a temporary
certificate of occupancy. The City provided you with the temporary of
occupancy permit under the condition that the footings and foundation
be completed in July, 1983 and roof be replaced in July, 1983.
In July, 1983 , you were again approached by the City to get the work
completed and you said that you had no money. At this time, the City
tried to get you assistance from Hennepin County Planning and
Development. You delayed in sending the application in and was not
cooperative with them.
I am writing this letter to inform you that you have not complied with
the correction orders given and that citations are being issued for the
following items:
l. Grass and weeds over 6" tall per Orono Municipal Code Section
9 . 55, Subd 1 and 2.
2. Not installing the required footings and instead you have left
the structure on concrete block piers without motAr and
without proper frost footing depth, per SBC/UBC 2907 (a) .
3. Storage of junk cars and debris per Orono Municipal Code 950.

The above is in violaton of Orono Municipal Code Section 9.50. I

some other area of the vehicle not normally occupied by the driver
or passengers, if the motor vehicle is not equipped with a trunk.
For the purpose of this Section, a utility or glove compartment
shall be deemed to be within the area occupied by the driver or
passengers.
S$C. 9.55. MAIpTSNANCE OF PRIVATS PROP$RTY.
Subd. 1. It is the duty of the owner of every vacant
property and the owner and occupant of every occupied property to
maintain same in a neat, clean and presentable manner free of any
junk, debris, refuse, litter, aeaa trees, or noxious weeds, and to
remove all other public health or safety hazards therefrom.
Subd. 2. Grass and Weeds. The owner or occupant of
every lot or parcel shall regularly cut or otherwise maintain all
grass and weeds thereon at a height of not more than six (6)
inches, except ��i,�,s grovision shall not apply to the following:
r
A. Publicly-owned parks, trails or nature areas.
B. Property actively being farmed or used for
agricultural purposes in conformance with the Zoning Chapter.
C. Residential properties in excess of one acre
,� gross lot size when located in the RR-lA, RR-1B, LR-lA and RS Rural
Residential Zoning Districts, provided that such properties or
portions thereof shall be maintained in conformance with this
Subdivision upon notice from the City that lack of such maintenance
has caused complaints from abutting property owners and is thereby
creating a public nuisance. .
D. Wetlands vegetation as defined in the Zoning
Chapter.
E. Grass, weeds or underbrush on any slope in
excess of 100 percent (45 degrees) .
S�C. 9.56. VACANT, UAMAGED OR HAZARDOIIS BIIILDII�GS.
Subd. 1. Vacant Buildings. It is unlawful for the owner
of any property to keep or allow to exist any vacant building which
is open to trespass or is not secured against unauthorized entry.
When an unsecured building is found, the Building Official shall
post the premises and shall issue orders in person or by mail to
the last known owner of record requiring that the building be
secured within 48 hours. Failure to secure the building upon
issuance of such orders shall be cause for the City to properly
secure the building, to cause the costs thereof to be charged
against the property as provided by Minnesota Statutes Section
463.251, and to commence hazardous building proceedings pursuant to
_�. Minnesota Statutes Section 463.15 et seq.

SEC. 9.50. JQNR CARS, FQRNaTORE, HOUSEHOLD FIIRNISHINGS AND
APPLIANCSS STORSD ON POBLIC OR PRIVATS PROPSRTY. It is unlawful to
park or store any unlicensed, unregistered or inoperable motor
vehicle lacking essential parts, household furnishings or
appliances, or parts or components thereof, on any property, public
or private, unless housed within a lawfully erected building. Any
violation of this Section is declared to be a nuisance and upon
seven days written notice to the owner, as shown by the records in
' the office of the County Auditor, of private premises on which such
� material is found, the City may remove the same and certify the
cost of such removal as any other special assessment. For the
purpose of this Section, an inoperable motor vehicle shall be
defined as lacking, including but not limited to, parts essential
to operation, such parts being wheels, tires, motor, drive train,
battery, or having two or more flat tires, or having the interior,
including the driver's position, used for storage in such a manner
that no person can operate the vehicle.
SSC. 9.51. ABANDONING A MOTOR VEHICI,S. It is unlawful for
any person to abandon a motor vehicle on any public or private
property without the consent of the person in control of such
property. For the purpose of this Section, a "motor vehicle" is as
' defined in Minnesota Statutes, Chapter 169.
` �, SEC. 9.52. PROHIBITED OSE AND PARRING OF MOBILE HOM$S AND
RECRBATIONAL CAMPING VSHICLSS.
Subd. 1. Def initions. The terms "mobile home" and
"recreational camping vehicle" shall mean and include the following
definitions, and shall not include any manufactured housing unit
bearing a State of Minnesota Manufactured Housing seal or
certificate.
A. "Travel Ttailer" - A vehicular , portable
structure built on a chassis, desiqned to be used as a temporary
dwelling for travel, recreational, and vacation uses, permanently
identified "Travel Trailer" by the manufacturer of the trailer.
B. "Pick-up Coach" - A structure designed to be
mounted on a truck chassis for use as a temporary dwelling for
� travel, recreation and vacation.
C. "Motor Home" - A portable, temporary dwelling to
be used for travel, recreation and vacation, constructed as an
integral part of a self-propelled vehicle.
D. "Camping Trailer" - A folding structure, mounted
` on wheels and designed for travel, recreation and vacation uses.

§ 9.20
SEC. 9.20. DISORD$RLY CONDUCT. It is unlawful for any
person, in a public or private place, knowing, or having reasonable
grounds to know, that it will, or will tend to, alarm, anger or
disturb others or provoke any assault or breach of the peace, to do
the following: (1) engage in brawling or fighting; or, (2) disturb
an assembly or meeting, not unlawful in its character ; or , (3)
engage in offensive, obscene or abusive language or in boisterous
and noisy conduct tending reasonably to arouse alarm, anger or
resentment in others; or, (4) willfully and lewdly expose his
person or the private parts thereof, or procure another to so
expose himself; and any open or gross lewdness or lascivious
behavior , or any act of public indecency; or , (5) whether or not
posted with signs so prohibiting, voluntarily enter the waters of
any river or public swimming pool at any time when said waters are
not properly supervised by trained life-saving personnel in atten-
dance for that purpose, or enter such waters without being garbed
in a bathing suit sufficient to cover his person and equal to the
standards generally adopted and accepted by the public; or , (6)
urinate or defecate in a place other than (a) if on public property
then in a plumbing fixture provided for that purpose, or (b) if on
the private property of another then in a plumbing fixture provided
for that purpose, or (c) if on private property not owned or con-
trolled by another, then within a building; or, (7) cause the
making or production of an unnecessary noise by shouting or by any
other means or mechanism including the blowing of any automobile or
other vehicle horn; or, (8) use a sound amplifier upon streets and
public property without prior written permission from the City; or,
(9) use a flash or spotlight in a manner so as to annoy or endanger
others; or, (10) cause defacement, destruction, or otherwise damage
to any premises or any property located thereon; or, (11) strew,
scatter, litter, throw, dispose of or deposit any refuse, garbage,
or rubbish unto any premises except into receptacles provided for
such purpose; or, (12) enter any motor vehicle of another without
the consent of the owner or operator; or, (13) fail or refuse to
vacate or leave any premises after being requested or ordered,
whether orally or in writing, to do so, by the owner, or person in
charge thereof, or by any law enforcement agent or official; pro-
vided, however, that this provision shall not apply to any person
who is owner or tenant of the premises involved nor to any law
enforcement or other government official who may be present thereon
at that time as part of his official duty, nor shall it include the
wife, children, employee or tenant of such owner or occupier. �,
SEC. 9.21. PUBLIC NOISANCE. It is unlawful for any person to
maintain a public nuisance by his act or failure to perfor m a legal
duty, and for purposes of this Section, a public nuisance shall be
defined as any of the following: (1) maintaining or permitting a
condition which unreasonably annoys, injures or endangers the
safety, health, morals, comfort or repose of any considerable
number of inembers of the public; or, (2) interfering with,
� obstructing or rendering dangerous for passage, any street, public
� right-of-way, or waters used by the public; or, (3) any other act
or omission declared by law to be a public nuisance.

PUBLIC PROTECTION, CRII�S AND OFFI3NSSS
SBCTION. 9.01. STORAGE, DEP�IT AND DISPOSAL OF RSFQSE.
Subd. 1. Definitions. The following terms, as used in
this Section, shall have the meanings stated:
A. "Refuse" - Includes all organic material
resulting from the manufacture, preparation or serving of food or
food products, and spoiled, decayed or waste foods from any source,
bottles, cans, glassware, paper or paper products, crockery, ashes,
rags, and discardec3 cl.othing, tree or lawn clippings, leaves, weeds
and other waste products, except human waste or waste resulting �
from building construction or demolition.
B. "Residential Dwelling" - Any single building
consisting of one through three dwelling units with individual
kitchen facilities for each.
C. "Multiple Dwelling" - Any building used for
: residential purposes consisting of more than three dwelling units
. with individual kitchen facilities for each.
D. "Commercial Establishment" - Any premises where
a commercial or industrial enterprise of any kind is carried on,
and shall include restaurants, clubs, churches, conference centers
and schools where food is prepared or served.
Subd. 2. Storage.
A. It is unlawful for any person to store refuse on
residential clwelling premises for more than one week. All such
storage shall be in five to thirty gallon metal or plastic
containers with tight-fitting covers, which shall be maintained in
a clean and sanitary condition; provided, that tree leaves, weeds
and grass clippings may be stored in plastic bags and tree limbs
must be stored in bundles weighing no more than seventy-five pounds
- and no longer than four feet.
B. It is unlawful for any person to store refuse on
multiple dwelling premises for more than one week. Such storage
shall be in containers as for residential dwelling premises, except
that containers, sometimes referred to as "c3umpsters", with close-
fitting covers may be substituted.
C. It is unlawful for any person to store refuse on
commercial establishment premises for more than forty-eight hours.

«„� within a building or fully screened so as not to be visible from
adjoining properties, except boats and unoccupied trailers less
than 20 feet in length, which are not stored for commercial
purposes, if stored to the rear of the house and a distance of 10
feet or more from any property line.

Effective Date: 1-1-75
Subd. 14. Waste Materials. Waste material shall not be
washed into the public storm sewer system nor the sanitary sewer
system without first having received a permit to do so from the
City. If said permit is not granted, a method of disposal shall be
devised which will not require continuous land requisition for
permanent operation and will not cause a detrimental effect to the
adjacent land. Should the waste be of solid form rather than
fluid, the storage area shall be so located and fenced as to be
removed from public view. In all districts, all waste material,
debris, refuse, garbage, materials not currently in use for
construction or otherwise regulated herein shall be kept in an
enclosed building or properly contained in a closed container for
such purposes. The owner of vacant land shall be responsible for
keeping such vacant land free of waste material and noxious weeds.
Subd. 15. Drainage. No land shall be developed and no
l use shall be permitted that results in water runoff causing
'-� � flooding, or erosion on adjacent properties. Such runoff shall be
properly channeled into a storm drain, water course, ponding area
or other suitable facility.
Subd. 16. Traff ic Control. The traff ic generated by any
use shall be channelized and controlled in a manner that will avoid
congestion on public streets, safety hazards, or excessive traffic
through residential streets. Vehicles backing from a parking space
shall not back into the public street. No access drive to any lot
shall be located within 20 feet of any two intersecting street
right-of-way lines.
Subd. 17. Radiation, Etc. No activities shall be
permitted that emit dangerous radio activity beyond enclosed areas.
There shall be no electrical disturbance adversely affecting the
operation of any point of any equipment including but not limited
to radio and television reception other than that of the creator of
the disturbance.
SBC. 10.61. SP$CIAL PROVISIONS.
Subd. 1. Signs as Accessory Use. Signs are a permitted
accessory use in all districts subject to the following
regulations:

,� odorous or solid matter of such quality and quantity as to be
readily detectable at any point beyond the lot line of the site on
which the use is located.
Subd. 7. Vibration. Any use creating periodic earth-
shaking vibrations, such as may be created from a drop forge shall
be prohibited if such vibrations are perceptible beyond the lot
line of the site on which the use is located. The standard shall
not apply to vibrations created during the process of construction.
Subd. 8. Glare or Heat. Any use requiring an operation
producing an intense heat or light transmission shall be performed
with the necessary shielding to prevent such heat or light from
being detectable at the lot line of the site on which the use is
located. Lighting in all instances sha11 be diffused or directed
away from "R" Districts and public streets.
Subd. 9. Explosives. Any use requiring the storage,
utilization or manufacturing of products which could decompose by
detonation shall be located not less than 400 feet from any "R"
District line.
Subd. 10. Screening Required. Screening shall be
required in residential zones where:
A. Any off-street parking area which contains more
than four parking spaces and is within 30 feet of an adjoining
residential lot line, and,
B. Where the driveway to a parking area of more
than six parking spaces is within 15 feet of an adjoining
residential lot line.
Subd. 11. Screening, Type of. The screening required
herein shall consist of a solid fence or wall at least 50$ open,
not less than four feet nor more than five feet in height but shall
not extend within 15 feet of any street or driveway opening onto a
street. The screening shall be placed along the property lines or
in case of screening along a street, 15 feet from the street right-
of-way with landscaping (trees, shrubs, grass and other plantinq)
= between the screening and the pavement. A louvered fence shall be
considered solid if it blocks direct vision. Planting of a type
approved by the Planning Com mission may also be required in
addition to, or in lieu of, fencing .
Subd. 12. Maintenance. In all districts , all
structures, required landscaping and fences shall be maintained so
as r�ot to be unsightly or present harmful health or safety
conditions.
Subd. 13. Exterior Storage in "R" Districts. In all "R"

Mr. Henke:
I conducted an inspection on July 11, 1988 to verify that
there are no unlicensed inoperable vehicles on your property.
During this inspection I found that in your rear yard is a
vehicle license �CJR281 which is inoperable. Pursuant to Orono
Municipal Code 9.50, a vehicle is inoperable when it has two� or
more f lat tires. Your vehicle meets this criteria. Therefore I
am issuing you a citation as you have been notified many times ,
about this matter.

Dear Mr. Henke:
On 5/9/88 an inspection was conducted at the above subject
FroFerty which revealed the following code violations:
Storage of unlicensed inoperable vehicles:
Dodge R.V. License #R/V66381 Expired ' 87
Cadilac License #CJR281 Expired ' 86
Boat & Trailer License #D90-035 Expired ' 87
The above is in violaton of Orono Municipal Code Section 9.50. I
am writing this letter to inform you that these vehicles must be
licensed and operable or removed from the property before
5/25/88. If corrective action has not been made by that time
citations wi 11 be issued and the mattered referred to the City
Attorney for further legal action. If you have any questions,

As per your request I am enclosing two chronological lists for
this property dated July 12, 1987 Hazardous Building Action and
November 17, 1987 Junk and Debris - Inoperable Vehicles .

September 3, 1987 Ernst House Movers obtain permit to lift
existing structure .
September 28, 1987 Footing inspection conducted by Lyle Oman.
October 12, 1987 Mr. Henke obtained a permit for addition to
existing structure.
October 13 , 1987 Plumbing inspection made by Tom Jacobs - All
OK - Need plumbing permit.
October 23 , 1987 Footing and foundation inspection made by
Lyle Oman - Everything OK.
November 17, 1987 An inspection was conducted at the site.

SUBJECT: 3536 Lyric Avenue - Hazardous Building Action
The following events have taken place regarding the above subject
property:
June 15 1987
I met with Mr. Henke and his contractor. During this
meeting we discussed what must be done to the footings
and fonndation. Mr. Henke, at this time, decided to
install a full basement under the structure. I gave him
a building permit application.
June 18, 1987
I met with Mr. Henke, he had filled out a building
permit application and submitted it for a permit
(footings and foundation) a permit (#6421 attached) was
issued after much discussion on if he could live in the
structure while the basement was installed. Because of
same or similar cases , I told him he could live in the
structure as long as a licensed house mover lifts and
secures the structure. Also we discussed deadlines for
him to respond to, July 30 , 1987 he was to get a letter
into the City requesting an extension and that he would
complete the work. Mr. Henke then left with his
building permit.
June 25, 1987
Mr. Henke contacted me on the phone requesting a site
inspection of the roof. I explained to him, after I was
on the site , that he would have to finish the roof ,
clean up shingles, install a drip edge, finish siding
(corners) , and install stairs which met code. I also
explained again that hazardous building action would
continue if he did not get a letter in explaining his
intentions.
June 3B, 1987
Mr. Henke. brought in a letter stating that footings and
foundation would be installed the end of August and
completed in September 1987. (Letter attached) I felt
that the City must give Mr. Henke every possible chance
to perform so I agreed to this as he said he would have
the money and time then.
I have not heard from him since. Hazardous building action
should be on hold until September 15, 1987.

Henke was storing junk in front yard and burning without
permit. This was confirmed and Mr. Henke was given until
April 5, 1983 to correct the matter.

Districts. This section does not allow Mr. Henke to store mobile
materials and equipment unless in a building or fully screened.
Section 10.60, Subdivision 14 - Waste Materials. Also requires waste

October 12, 1987 Mr. Henke obtained a permit for addition to

November 17, 1987 An inspection was conducted at the site.

SUBJECT: 3536 Lyric Avenue - Hazardous Building Action
The following events have taken place regarding the above subject
property:
June 15 1987
I met with Mr. Henke and his contractor. During this
meeting we discussed what must be done to the footings
and foundation. Mr. Henke, at this time, decided to
install a full basement under the structure. I gave him
a building permit application.
June 18, 1987
I met with Mr. Henke, he had filled out a building
permit application and submitted it for a permit
(footings and foundation) a permit (#6421 attached) was
issued after much discussion on if he could live in the
structure while the basement was installed. Because of
same or similar cases, I told him he could live in the
� structure as long as a licensed house mover lifts and
secures the structure. Also we discussed deadlines for
him to respond to, July 30 , 1987 he was to get a letter
into the City requesting an extension and that he would
complete the work. Mr . Henke then le �t with his
building permit.
June 25, 1987
Mr. Henke contacted me on the phone requesting a site
inspection of the roof. I explained to him, after I was
on the site , that he would have to finish the roof ,
clean up shingles, install a drip edge, finish s �ding
(corners) , and install stairs which met code. I also
explained again that hazardous building action would
continue if he did not get a letter in explaining his
intentions .
- June 3g. 1987
Mr. Henke brought in a letter stating that footings and
foundation would be installed the end of August and
completed in September 1987. (Letter attached) I felt
that the City must give Mr. Henke every possible chance
to perform so I agreed to this as he said he would have
the money and time then.
� I have not heard from him since. Hazardous building action
should be on hold until September 15, 1987.

Subc7. 1. Definitions. The �ollowing terms, as used in i
this Section, shall have the meanings stated: �
A. "Refuse" - Includes all organic material I
!-esulting from the manufacture, preparation or serving of food or
food produc'ts, and spoiled, decayed or waste foods from any source,
bottles, cans, glassware, paper or paper products, crockery, ashes,
rags, and discarded clothing, tree or lawn clippings, leaves, weeds
and other waste products, except human waste or waste resulting
from building construction ar c7emolition.
B. "Resic3ential Dwelling" - Any single building
consisting of one through three dcaelling units with individual
kitchen facilities for each.
C. "Multiple Dwelling" - Any building used for
residential purposes eonsisting of more �chan �chree dcaelling units
vaith inGividual kitchen facilities for each.
D. "Commercial Establishment" - Any premises where
a con mercial or industrial en�.erprise of any kind is carried on,
and shall include restaurants, clubs, churches, conference cen�ers
and schools where food is prepared or served.
Subd. 2 . Storage.
A, It is unlawful for any person to store refuse on
residential dwelling premises for more than one weeko All s�ch
storage shall be in five to thi�ty c�allon metal or plas�cic
containers with tight�fitting covers, which shall be maintained in
a clean and sanitary condition; provided, �hat tree leaves, v�eeds
and grass clippings may be stored in plastic bags anc� tree limbs
must be s�ored in bundles weighing no more than seventy-five pounds
and no longer than four feet.
B. It is unlawful for any person to stor� refuse on
multiple dwelling premis�s for more than one �aeel:. Such sto,age
shall be in containers as for residential dwelling premises, e�cept
that containers, sometimes referred to as "dump�ters°°, with close-
fitting covers may be substitu�ed.
C. It is unlawful for �ny pe�son to store refuse on
con mercial estab?ishment premises for more than forty-eight nour5.
Such storage shall be in containers as for residential du�elling
gremises, except that con�ainers, sometimes referred to as
"dumpsters", with clo�e-fitting covers may be substituted.

§ 9.20
� SEC. 9.20. DISORDERLY CONDUCT. It is unlawful for any
person, in a public or private place, knowing, or having reasonable
grounds to know, that it will, or will tend to, alarm, anger or
disturb others or provoke any assault or breach of the peace, to do
the following: (1) engage in brawling or fighting; or, (2) disturb �
an assembly or meeting, not unlawful in its character; or , (3) �
engage in offensive, obscene or abusive language or in boisterous
and noisy conduct tending reasonably to arouse alarm, anger or
resentment in others; or, (4) willfully and lewdly expose his
person or the private parts thereof, or procure another to so
expose himself; and any open or gross lewdness or lascivious
behavior , or any act of public indecency; or , (5) whether or not
posted with signs so prohibiting, voluntarily enter the waters of
any river or public swimming pool at any time when said waters are
not properly supervised by trained life-saving personnel in atten-
dance for that purpose, or enter such waters without being garbed
in a bathing suit sufficient to cover his person and equal to the
standards generally adopted and acceptec3 by the public; or , (6)
urinate or defecate in a place other than (a) if on public property
then in a plumbing fixture provided for that purpose, or (b) if on
the private property of another then in a plumbing fixture provided
for that purpose, or (c) if on private property not owner3 or con-
trolled by another , then within a building; or , (7) cause the
making or production of an unnecessary noise by shouting or by any
other means or mechanism including the blowing of any automobile or
other vehicle horn; or, (8) use a sound amplifier upon streets and
public property without prior written permission from the City; or,
(9) use a flash or spotlight in a manner so as to annoy or endanger
others; or, (10) cause defacement, clestruction, or otherwise damage
to any premises or any property located thereon; or, (11) strew,
scatter, litter, throw, dispose of or deposit any refuse, garbage,
or rubbish unto any premises except into receptacles provided for
such purpose; or, (12) enter any motor vehicle of another without
the consent of the owner or operator ; or , (13) fail or refuse to
vacate or leave any premises after being requested or ordered,
whether orally or in writing, to do so, by the owner, or person in
charge thereof, or by any law enforcement agent or official; pro-
vided, however, that this provision shall not apply to any person
who is owner or tenant of the premises involved nor to any law
enforcement or other government official who may be present thereon
at that time as part of his official duty, nor shall it include the
wife, children, employee or tenant of such owner or occupier.
SEC. 9.21. PUBLIC NOISANCE. It is unlawful for any person to
maintain a public nuisance by his act or failure to perform a legal
duty, and for purposes of this Section, a public nuisance shall be
defined as any of the following: (1) maintaining or permitting a
condition which unreasonably annoys, injures or endangers the
safety, health, morals, comfort or repose of any considerable
number of inembers of the public; or , (2) interfering with,
obstructing or renc3ering dangerous for passage, any street, public
1, right-of-way, or waters used by the public; or, (3) any other act
or omission declared by law to be a public nuisance.

SEC. 9.22. PBRMITTING A PDBLIC NiJISANCS. It is unlawful for
any person to permit real property under his control to be used to
maintain a public nuisance, or let the same to another knowing it
is to be so used.

SEC. 9.50. JQNR CARS, FQRNITORE, HOUSEHOLD FORNISHINGS AND
APPLIANCES STORED ON PUBLIC OR PRIVATS PROPSRTY. It is unlawful to i
park or store any unlicensed, unregistered or inoperable motor;-
vehicle lacking essential parts, household furnishings or �
appliances, or parts or components thereof, on any property, public ��
or private, unless housed within a lawfully erected building. Any
violation of this Section is declared to be a nuisance and upon �
seven days written notice to the owner, as shown by the records in �
the office of the County Auditor, of private premises on which such � �
material is found, the City may remove the same and certify the � !
cost of such removal as any other special assessment. For the :
purpose of this Section, an inoperable motor vehicle shall be
defined as lacking, including but not limited to, parts essential
to operation, such parts being wheels, tires, motor, drive train,
battery, or having two or more flat tires, or having the interior,
including the c]river's position, used for storage in such a manner
that no person can operate the vehicle.
S�C. 9.51. ABANDONING A MOTOR VSHICLE. It is unlaF�ful for
any person to abandon a motor vehicle on any public or private
property without the consent of the person in control of such
property. For the purpose of this Section, a "motor vehicle" is as
defined in Minnesota Statutes, Chapter 169. ,
. SEC. 9.52. PROHIBITED USE AND PARRING OF I�10BILE SOMES APTD '
RECREATIONAL CAMPING VSHICI.$S. ;
Subd. 1. Definitions. The terms "mobile home" and I
"recreational camping vehicle" shall mean and include the following i
definitions, and shall not include any manufactured housing unit ,
bearing a State of Minnesota Manufactured Housing seal or ,
certificate. '
A. "Travel Trailer " - A vehicular , portable '
structure built on a chassis, designed to be used as a temporary
dwelling for travel, recreational, and vacation uses, permanently
identified "Travel Trailer" by the manufacturer of the trailer.
B. "Pick-up Coach" - A structure �esigned to be
mounted on a truck chassis for use as a temporary dwelling for
travel, recreation and vacation.
C. "Motor Home" - A portable, temporary dwelling to �
be used for travel, recreation and vacation, constructed as an
integral part of a self-propelled vehicle.
D. "Camping Trailer" - A folding structure, mounted
on wheels and designed for travel, recreation and vacation uses.

Subd. 2. Unlawful Acts. �
A. It is unlawful for any person to park a mobile �
home or recreational camping vehicle upon public property for human i
habitation, except in a licensed mobile home park or City-owned j
campground. '

B. It is unlawful for any person to park or store a i
mobile home or recreational vehicle in any "Residence District" for �
more than twenty-four hours, except in a sic7e or rear yard at least i
ten feet from any property line. �
C. It is unlawful to use a mobile home or recrea- �
tional camping vehicle for human habitation on any private property
tor more than seventy-two hours without a permit from the City.
SEC. 9.53. CONSUMPTION AND POSS$SSION OF BEER, WINE OR LIQUOR
OA1 STR.EETS AND P[TBLIC PROPSRTY. It is unlawful for any person to
consume, or possess in an unsealed container, beer, wine or liquor, ;
as those terms are defined in Chapter 4 of the City Code, on any
street or other public property except City parks and other public
property when and where permission has been specifically granted or
licensed by the Council. Provided, that this Section shall not
apply to the possession of an unsealed container in a motor vehicle
on streets or public property when the container is kept in the
trunk of such vehicle if it is equipped with a trunk, or kept in
some other area of the vehicle not normally occupied by the driver �
or passengers, if the motor vehicle is not equipped with a trurak. �
For the purpose of this Section, a utility or glove compartment
shall be deemed to be within the area occupied by the driver or
passengers. No license or permit shall be granted under this
Section unless and until the permittee or licensee, as the case may
be, has filed with the City a certificate of public liability
insurance on which the City or other owner of the property is a
named insured with limits of $ 100 ,000.00 for one person,
$300 ,000.00 for more than one person and $50,000.00 for property
damage. Nor shall such license or permit be granted until the
permittee or licensee, as the case may be, agrees in writing to pay
for all expenses incident to cleaning up all refuse and debris
resulting therefrom.
SBC. 9.54. CONSUMPTION AND POSS$SSIOAi OF BESR, �IN�3 OR LYQ�TOR
ON PRIVATE PARRING LOTS. It is unlawful for any person to consume
or possess in an unsealed container, beer, wine or liquor, as those
terms are defined in Chapter 4 of the City Code, on any privately-
owned parking lot which is clearly sign-posted prohibiting such
possession and consumption. Provided, that this Section shall not
apply to the possession of an unsealed container in a motor vehicle
on privately-owned parking lots when the container is kept in the
trunk of such vehicle if it is equipped with a trunk, or kept in

isome other area of the vehicle not normally occupied by the driver
or passengers, if the motor vehicle is not equipped with a trunk.
For the purpose of this Section, a utility or glove compartment
shall be deemed to be within the area occupiea by the driver or
passengers.
SEC. 9.55. l�AINTBNANCE OF PRIVATS PROPBRTY.
Subd. 1. ' It is the duty of the owner of every vacant
property and the owner and occupant of every occupied property to
maintain same in a neat, clean and presentable manner free of any,
junk, debris, refuse, litter, dead trees, or noxious weeds, and to
remove all other public health or safety hazards therefrom.
Subd. 2. Grass and Weeds. The owner or occupant of
every lot or parcel shall regularly cut or otherwise maintain all
grass and weeds thereon at a height of not more than six (6)
inches, except this provision shall not apply to the following:
A. Publicly-owned parks, trails or nature areas.
B. Property actively being farmed or usea for
agricultural purposes in conformance with the Zoning Chapter .
C. Residential properties in excess of one acre
.� gross lot size when located in the RR-lA, RR-1B, LR-lA and RS Rural
Residential Zoning Districts, provided that such properties or
portions thereof shall be maintained in conformance with this
Subdivision upon notice from the City that lack of such maintenance
has caused complaints from abutting property awners and is thereby '
creating a public nuisance. I
D. Wetlands vegetation as defined in the Zoning
Chapter. '
E. Grass, weeds or underbrush on any slope in '
excess of 100 percent (45 degrees) .
SBC. 9.56. VACANT, DAMAGBD OR H�4.ZARDOIIS ��ILDINGS.
Subd. 1. Vacant Buildings. It is un].awful for the owner
of any property to keep or allow to exist any vacant building which
is open to trespass or is not secured against unauthorized entry. �
When an unsecured building is found, the Building Official shall
post �he premises and shall issue orders in person or by mail to
the last known owner of record requiring that the building be
secured within 48 hours. Failure to secure the buildi.ng upon
issuance of such orders shall be cause for the City to properly
secure the building, to cause the costs thereo� to be charged
against the property as provided by Minnesota Statutes Section
� 463.251, and to commence hazardous building proceedings pursuant to
t Minnesota Statutes Section 463.15 et seq.

� odorous or solid matter of such quality and quantity as to be
readily detectable at any point beyond the lot line of the site on
which the use is located.
Subd. 7. Vibration. Any use creating periodic earth-
shaking vibrations, such as may be created from a drop forge shall
be prohibited if such vibrations are perceptible beyond the lot ,
line of the site on which the use is located. The stanc3ard shall
not apply to vibrations created during the process of construction. �

Subd. 8. Glare or Heat. Any use requiring an operation
producing an intense heat or light transmission shall be performed �
with the necessary shielding to prevent such heat or light from �
being detectable at the lot line of the site on which the use is �
located. Lighting in all instances shall be diffused or directed �
away from "R" Districts and public streets.

Subd. 9. Explosives. Any use requiring the storage, �
utilization or manufacturing of products which could decompose by �
,
detonation shall be located not less than 400 feet from any "R" �
District line. �

Subd. 10. Screening Required. Sc�eening shall be
required in residential zones where:
� A. Any off-street parking area which contains more
than four parking spaces and is within 30 feet of an adjoininq
residential lot line, and ,
B. Where the driveway to a parking area of more
than six parking spaces is within 15 feet of an adjoining
residential lot line.
Subd. 11. Screening, Type of. The screening required
herein shall consist of a solid fence or wall at least 50� open,
not less than four feet nor more than five feet in height but shall
not extend within 15 feet of any street or driveway opening onto a
street. The screening shall be placed along the property lines or
in case of screening along a street, 15 feet from the street right-
of-way with landscaping (trees, shrubs, grass and other planting)
between the screening and the pavement. A louvered fence shall be ,
considered solid if it bTocks direct vision. Planting of a type i
approved by the Planning Com mission may also be required in i
adc7ition to, or in lieu of, fencing. '
Subc3. 12. Maintenance. In all districts , all
strvctures, required landscaping and fences shall be maintainec3 so
as not to be unsightly or present harmful health or safety
conditions.
Subd. 13. Exterior Storage in "R" Districts. In all "R"
( Districts, all mobile materials and equipment shall be stored

within a building or fully screened so as not to be visible from `
adjoining properties, except boats and unoccupied trailers less
than 20 feet in length, which are not stored for commercial
purposes, if stored to the rear of the house and a distance of 10 '
feet or more from any property line. �

Subd. 14. Waste Mater ials. Waste mater ial shall not be �'.;
washed into the public storm sewer system nor the sanitary sewer �
system without first having received a permit to do so from the 4;
City. If said permit is not granted, a method of disposal shall be '
devised which will not require continuous land requisition for
permanent operation and will not cause a detrimental effect to the
adjacent land. Should the waste be of solid form rather than
fluid, the storage area shall be so located and fenced as to be
removed from public view. In all districts, all waste material,
debris, refuse, garbage, materials not currently in use for
construction or otherwise regulated herein shall be kept in an
enclosed building or properly contained in a closed container for
such purposes. The owner of vacant land shall be responsible for
keeping such vacant land free of waste material and noxious weeds.
Subd. 15. Drainage. No land shall be developec] and no
' use shall be permitted that results in water runoff causing
` flooding, or erosion on adjacent properties. Such runoff shall be
properly channeled into a storm drain, water course, ponding area
or other suitable facility. �

Subd. 16. Traffic Control. The traffic generated by any �
use shall be channelized and controlled in a manner that will avoid

through residential streets. Vehicles backing from a parking space
shall not back into the public street. No access drive to any lot p
shall be located within 20 feet of any two intersecting street j

Subd. 17. Radiation, Etc. No activities shall be
permitted that emit dangerous radio activity beyond enclosed areas.
There shall be no electrical disturbance adversely affecting the
operation of any point of any equipment including but not limited
to radio and television reception other than that of the creator of '

the disturbance.
S$C. 10.61. SPECIAL PROVISIONS.
Subd. l. Signs as Accessory Use. Signs are a permitted
accessory use in all districts subject to the following
