Lindblad 3505 Lyric Avenue Wayzata, MN 55391 Dear Ms. Lindblad: I am writing to you to inform you that your property at 3505 Lyric Avenue is in violation of the following municipal code: Section 10.03, Subdivision 16. Traffic Visability - corner of Navarre Avenue and Lyric Avenue. Tree at intersection is , a traf f ic visibi lity hazard and must be removed f rom road elevation. Correction action must be made before March 7, 1988. If corrections have not been made by this time, citations will be issued and you will have to appear in court to explain why you will not correct this matter. Box 66 V Crystal Ba,y, MN 55323 Dear Mr. Jacobs: In response to your letter of February 25, 1988, this is to inform you that I have nor� complied with your �emand that I remove from the corner of Navarre Avenue and Lyric Avenue the Colorad.o blue spruce tree which, I presume, is the tree to which you refer. In view of my com- pliance, I will assume that no further threats of citations and court appearances will be forthcoming from your office . I have had no complaints about lack of visibility at this corner, nor have there ever been any accidents there , to my knowledge . Any driver coming to a complete stop and proceeding with caution should have had no problem. I have certainly never knowingly violated any part of the municipal code, and it would seem to me that a simple telephone call or courteous note , advising me of the existence of said violation -- and possibly a chance for discussion -- would have accomplished the same result as did your offensive letter, with its threatening overtones . I have alvrays been willing to comply with any reasonable request. Your time-frame was unreasonable . I was given only five (5) business days in which to get this work done . There was not suffi- cient time in �vhich to get written cost estimates on removing the tree , and I was forced to hire the only tree service that c�uld come on such short notice--so, obviously, I didn' t have the benefit of accepting a lower bid . A more real_istic time-frame in which. to get the tree removed would have been 30 days , which, I believe, is the usual and customary, as well as legal, time allowed. I have lived in Orono all my life, and my parents before me, first in Orono Township, then the Village, and no�v the City. t�e have always been able to discuss with Orono any prob)_ems and settle any differences of opinian in a friendly, civil manner, and, until receiving your letter, have always felt comfortable that problems arising could be dealt �vith in an informal, pleasant and non-threat- ening manner. If your intent was to intimidate me , you have surely accomplished that; I'm sorry you felt it neeessary to employ such tactics , as I very much value a good working relationship bet��veen City of.ficials and residents , I would appreciate your acknotivledging, by letter, that the matter of the violation of Section 10. 03, Subdivision 16, of the Orono P�Zunicipal Code, as outlined in your letter of February 25, 1988, has now been resolved and that there will be no further legal action. s very truly, � �-` , cc: D�essrs .
