FYI—
Today i contacted Joe Bieker who had been inquiring about building on Lots 16& 17, Block 5, Navarre Heights (the two
vacant lots west of 3472 Lyric). I advised Joe that he could make the building permit application to build a single
residence on the combination of the two lots. in discussions with "Abby' at Hennepin County(612-348-2995) I learned
that Hennepin County will be processing a combination of Lots 16& 17 per the City's request in Tax Forfeit Resolution
No. 5965 adopted 9-14-09.
The combined property should be assigned the address 3484 Lvric Avenue. Chris—please make a street file for this
address—I have various documents to put in it.
The combined property is 100' x 134.5' or 13,450 s.f. in area and subject to the LR-1C zoning standards. Because the
property is a nonconforming lot within the Shoreland Overlay District, it is subject to the provisions of Section 78-72(c).
Because past City requirements for combination of these previously tax-forfeited lots pre-date the recent state statute
regarding nonconforming lots of record in Shoreland,they will be subject to Section 78-72(c)(1) rather than 78-72(c)(2).
The property is limited to 25% hardcover.
The property was fully assessed for sewer and water service in the 1963-1B and 1964-16 sewer projects and 1970 LW-1
water project. Sewer and water stubs are available. No assessments for sewer or water are due. The Met Council SAC
charge will be due with the building permit, as these lots have not had a sewer connection in the past.

Hennepin County has requested that the City determine the appropriate disposition for a
tax-forfeit lot located between 3472 Lyric Avenue (Lot 18) and 3496 Lyric Avenue (Lot
15). This parcel is one of two adjacent vacant lots that have gone tax forfeit in the past and
each time have subsequently been repurchased by the adjacent owner of the home at 3472
Lyric. The current owner of 3472 Lyric for reasons unknown to staff did not purchase the
adjacent vacant lots when he purchased the home in April of 2009.
The tax forfeit lot is 50' in width and 134.5' in depth, being approximately 0.16 acre in
area. The minimum width and area requirements of the LR-1 C District are 100' and 0.50
acre respectively. The adjacent property to the west at 3496 Lyric is also 0.16 acre and
contains a single family home. The adjacent lot to the east (Lot 17) is vacant but is also a
potential candidate for future tax forfeiture as it has back taxes due.
Although the Navarre Heights neighborhood has some homes located on single lots, many
are on combinations of two or three lots. Parcels 15-16-17-18 have historically contained
two homes on a total area of 0.62 acres. It would not be in keeping with the intent of the
zoning code to allow a third home to be constructed in such a small area.
Staff Recommendation
Staff recommends that the lot be released for purchase by an adjacent owner, with the
stipulation that it is not separately buildable and must be combined for use with an adjacent
homestead parcel.
COUNCIL ACTION REQUESTED
Adopt the attached resolution to release the property for sale to adjacent owners.
A RESOLUTION TO RELEASE TAX FORFEITED
LAND FOR SALE TO ADJACENT OWNERS
WHEREAS,the City of Orono is a municipal corporation organized and existing under laws
of the State of Minnesota; and
WHEREAS, pursuant to Minnesota Statutes 282, the City has received from Hennepin
County notification that a parcel of land within the City has become the property of the State of
Minnesota for non-payment of real estate taxes,referencing C/NC List#1481,said parcel identified
as PINS 17-117-23-43-0072; and
WHEREAS, the City Council has reviewed said land for compliance with local zoning
ordinances,for the amount of outstanding special assessments remaining unpaid to the City,and/or
for possible public use by the City as authorized in the Statutes. In addition the Council has
reviewed said land and certified that this parcel need not be withheld from sale pursuant to
Minnesota Statutes 85.021, 92.461, 282.01, Subd. 8, 282.018, Subd. 1 or 282.018, Subd. 2.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono,
pursuant to Minnesota Statutes 282,hereby approves the classification of said parcel of land as Non-
Conservation land,and further approves the sale of said land to adjacent homestead property owners,
with the following recommended conditions:
1. The parcel to be sold remains subject to applicable zoning ordinance provisions, including
those regulations providing for minimum lot area and minimum lot width. Substandard
parcels may be usable only in combination with other adjoining parcel(s). This property does
not meet current zoning standards.
2. Release of this parcel by the City Council is subject to the condition that upon purchase by
adjacent property owner of said tax forfeit parcel, purchaser shall legally combine for tax
purposes the adjacent existing homestead property and said tax forfeit parcel.
3. Release of this land by the City Council is subject to the condition that all outstanding special
assessments shall be paid in full to the City upon return to private ownership. Any amount
not recovered at the time of sale shall be subject to reassessment by the City.

conservation lands or non-conservation lands, as is appropriate, by the County Auditor's Administrative Review Board.
Enclosed is a copy of County Auditor's Directive No. 2009-21 providing for the classification of the lands, under
authority granted in accordance to Minnesota Statute 282.135 by the Board of Hennepin County Commissioners.
As required under M.S. 282.01, the department requests that your city officials review Conservation/Non-Conservation
List # 1481 C/NC. When municipal review has been completed, the department will require a certified copy of a
municipal resolution that resolves and approves parcels for public auction, for auction to adjacent owners, or requests
public use conveyance or nonpublic sale to your city. See enclosed Exhibit A, an outline for suggested points that
should be covered in your municipal resolution.

FOR PRIVATE SALE TO ADJACENT OWNERS
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREAS, pursuant to Minnesota Statutes 282 , the City
has received from Hennepin County a list of lands within the City
which have become the property of the State of Minnesota for non-
payment of real estate taxes; and
WHERE�IS, the City Council has reviewed said lands for
compliance with local zoning ordinances , for the amount of
outstanding special assessments remaining unpaid to the City,
and/or for possible public use by the City as authorized by the
Statutes .
NOW, THEREFOgtE BE IT RESOLVED that the City Council of
, the City of Orono, pursuant to Minnesota Statutes 282, hereby
approves the classification of each of the following parcels of
land as non-conservation land, and furthermore, approves the
public sale of each parcel of land as listed below to adjacent
property owners as these properties are currently unbuildable.
Al1 parcels remain subject to all applicable zoning
ordinance provisions, including those regulations providing for
minimum lot area and minimum lot width. Substandard parcels may
be useable only in combination with other adjoining parcel (s) .
Release of these lands by the City Council is subject to
the condition that all outstanding special assessments shall be
paid in full to the City upon return to private ownership. Any
amount not recovered at the time of sale shall be subject to
reassessment by the City.

WHEREAS,the city of Orono is a municipal corporation organized and existiiig under the

NOW, THEREFORE, BE IT RESOLVED,that the City Council of the city of Orono,
pursuant to Minnesota Statutes 282,hereby approves the classification of said parcel of land as non-
conservation land, and furthermore, approves the public sale of this parcel of land as listed below
to adj acent property owners.
All parcels remain subject to all applicable zoning ordinance provisions, including those
regulations providing for minimum lot area and minimum lot width. Substandard parcels may be

Release of tlus parcel by the City Council is subject to the condition that upon purchase by
adjacent property owner of said tax forfeit parcel purchaser shall legally combine for tax purposes �
adjacent existing homestead property and said tax forfeit parcel.
Release of tlus land by the City Council is subject to the condition that all outstand'uig special
assessments shall be paid in full to the City upon return to private ownership. Any amount not
recovered at the time of sale shall be subject to reassessment by the City.

A RESOLUTION TO RELEASE TAX FORFEITED
LAND FOR SALE TO ADJACENT OWNERS
WHEREAS,the City of Orono is a municipal corporation organized and existing under laws
of the State of Minnesota; and
WHEREAS, pursuant to Minnesota Statutes 282, the City has received from Hennepin
County notification that a parcel of land within the City has become the property of the State of
Minnesota for non-payment of real estate t�es,referencing C/NC List#1481,said paxcel identified
as PINS 17-117-23-43-0072; and
WHEREAS, the City Council has reviewed said land for compliance with local zoning
ordinances,for the amount of outstanding special assessments remaining unpaid to the City,and/or
for possible public use by the City as authorized in the Statutes. In addition the Council has
reviewed said land and certified that this parcel need not be withheld from sale pursuant to
Minnesota Statutes 85.021, 92.461, 282.01, Subd. 8, 282.018, Subd. 1 or 282.018, Subd. 2.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono,
pursuant to Minnesota Statutes 282,hereby approves the classification of said parcel of land as Non-
Conservation land,and further approves the sale of said land to adjacent homestead property owners,
with the following recommended conditions:
1. The pa.rcel to be sold remains subject to applicable zoning ordinance provisions, including
those regulations providing for minimum lot area and minimum lot width. Substandard
parcels may be usable only in combination with other adjoining parcel(s). This properiy does
not meet current zoning standards.
2. Release of this parcel by the City Council is subject to the condition that upon purchase by
adjacent property owner of said tax forfeit parcel, purchaser sha11 legally combine for tax
purposes the adjacent existing homestead property and said tax forfeit parcel.
3. Release of this land by the Ciiy Council is subject to the condition that a11 outstanding special
assessments shall be paid in full to the City upon return to private ownership. Any amount
not recovered at the time of sale shall be subject to reassessment by the CiTy.

Hennepin County has requested tb.at the City determine the appropriate disposition for a
tax-forfeit 1Qt located between 3472 Lyric Avenue (Lot 18} and 3496 Lyric Avenue (Lot
15). This parcel is one of two adj acent vacant lots that have gone tax forfeit in the past and
each ti_me have subsequently been repurchased by the adjacent owner of the home at 3472
Lyric. The current owner of 3472 Lyric for reasons unknown to staff did not purchase the
adjacent vacant lots when he purchased the home in April af 2009.
The tax forfeit lot is 50' in width and 134.5' in depth, being approximately 0.16 acre in
area. The minimum width and area requirements of the LR-1C District are 100' and 0.50
acre respectively. The adjacent property to the west at 3496 Lyric is also 0.16 acre and
contains a single family home. The adjacent lot to the east (Lot 17) is vacant but is also a
potential candidate for future tax forfeiture as it has back taxes due.
Although the Navarre Heights neighborhood has some homes located on single lots, many
are on combinations of two or three lots. Parcels 15-16-17-18 have historically contained
two homes on a total area of 0.62 acres. It would not be in keeping with the intent of the
zoning code to a.11ow a third home to be const�ucted in such a smail area.
Staff Recommendation
Staff recommends that the lot be released for purchase by an adjacent owrxer, with the
stipulatian that it is not separately buildable and must be combined for use with an adjacent
homestead parcel.
COUNCIL ACTION REQUESTED
Adopt the attached resolution to release the property for sale to adjacent owners.

FOR PRIVATE SALE TO ADJACENT OWNERS
WHEREAS,the city of Orono is a municipal corporation organized and existing under the
laws of the State of Minnesota; and
WHEREAS, pursuant to Minnesota Statutes 282, the City has received from Hennepin
County a list of lands within the City which have become the property of the State of Minnesota for
non-payment of real estate taxes; and
WHEREAS, the City Council has reviewed said lands for compliance with local zoning
ordinances,for the amount of outstanding special assessments remaining unpaid to the City, and/or
for possible public use by the City as authorized in the Statutes. In addition the Council has
reviewed said lands and certified that this parcel need not be withheld from sale pursuant to
Minnesota Statutes 85.021, 92.461, 282.01, Subd. 8, 282.018, Subd 1, 04 282.018, Subd. 2.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the city of Orono,
pursuant to Minnesota Statutes 282,hereby approves the c,lassification of said parcel of land as non-
conservation land, and furthennore, approves the public sale of tlus parcel of land as listed Uelow
to adjacent property owners.
All parcels remain subject to all applicable zoning ordinance provisions, including those
regulations providing for ininimum lot area and minimum lot width. Substandard parcels may be
usea'ole only in combination with ot?-er adjoining parcels(s).
Release of this parcel by the City Council is subject to the coildition that upon purchase by
adjacent property owner of said tax forfeit parcel purchaser shall legally combine for tax purposes �
adjacent existin�homestead property and said tax forfeit parcel.
Release of this land by the City Council is subject to the condition that all outstanding special
assessments shall be paid in full to the City upon return to private ownership. Any amount not
recovered at the time of sale shall be subject to reassessment by the City.

Enclosed please find a list of lands located in your municipality. These parcels have forteited to the State of

OUTLINE OF POINTS TO COVER IN A GOVERNMENTAL SUBDIVISION RESOLUTION FOR TAX-
FORFEITED LANDS
I. First the classification as Conservation and Non-Conservation Land must be approved.
II. Next, the parcel(s) should be formally recommended for either public auction, auction to
adjacent owners if M.S. 282.01, subd. 7a is applicable(unbuildable lots), or request of a
conveyancetoyourgovernmentalsubdivisionfora publicuse.
III. Further, each parcel may be eligible to be withheld from auction for up to one year, for
investigative purposes. To do this please send a written request to this office within the 90
days.
IV. Next,each parcel should be verified as to the Special Assessments shown as certified to the
county before forfeiture. These specials were canceled at forfeiture and a percentage will
be paid from any sale proceeds. Should any portion remain unpaid your city has the right to
reassess the unpaid balance against the property. However, please keep in mind that the
forfeiture process is intended to be a "cleansing"process attempting to turn a bad scenario
around.
V. Special Assessments levied after the forfeiture should be certified to this office. These
specials are added to the appraised value and paid from any sale proceeds.
VI. Each parcel should be reviewed for Public WaterFront,Wetland, Peat and Timber issues,or
any public nuisance conditions and duly noted in the municipal resolution.
We ask your assistance in determining if any parcels on List 969-NC have wells. If any of the parcels on the
list have wells, please request a Minnesota Department of Health Well Disclosure Certificate from this
department. Please provide available information about parcels such as zoning, known soil conditions,
known environmental contamination, or special municipal restrictions. Such information may assist the
county in managing and marketing the properiies in order to faciliiate its return t:,a�ax productive status.
If you request conveyance to your governmental subdivision, please submit a properly completed and
executed form PT962.RAR, titled, "Application bv a Governmental Subdivision for Convevance of Tax
Forfeited Land" for each parcel requested. Minnesota Department of Revenue requires use of this form.
Enclosed is form PT962.RAR. You may copy this form for future use only providing that the printing ends up
on both sides as it is on the originally I sent you. Call if you choose to have us provide you with the forms.
Conveyance to a governmental subdivision for a public purpose is subject to the recommendation of the
County Board, except as provided in M.S. 282.01, Subd. 1b (targeted neighborhood lands). The County
Board policy requires that a specific public purpose be identified in the request; Use of the phrases"public
purposes"or "other public purposes" is not acceptable. For your convenience, I have enclosed a copy of
Hennepin County Resolution No. 87-8-612,which covers the guidelines for what is deemed an acceptable
"public purpose".
