A RESOLUTION APPh20VING
CREATION OF DRIVEWAY EAS�MENTS
INVOLVING PROPERTIES LOCATED AT
3�72 & 3480 SHORELINE DRIVE
AND 3477 LYRIC AVENUE

WHEREAS, the City of Orono is a municipal corporation or�anized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted
subdivision regulations for the orderly,economic and safe development of land within the City;and
VVHEREAS,the City Council has considered the application for a Class I subdivision
by Lyle C. Scott and Joyce E. Scott, husband and wife (hereinafter "the applicants") per Orono
MLuucipal Code Section 82-15(a)(3)to create a driveway easement involving properties known by
PIN No.s 17-117-23 43 0088; 17-1 17-23 43 0089; 17-1 17-23 43 0093; and 17-117-23 43 0094,said
properties legally described as:
Lots 11, 12, 17, aiid 1�, Block 6, "Navarre Heights",Hennepin County,Minnesota
(hereinafter "the properties"); and
VVHEREAS, after due published and maiiec�notice iii acc�rdance with Minnesota
Statutes 462.353 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on January• 17,2006 at which time all persons desirin�to be heard
concernina this application were aiven the opportunity to speak thereon; and
WHEREAS,the Planning Comrnission reviewed the proposed driveway easement to
provide legal access from Lyric Avenue to the two lots abuttinQ Shoreline Drive,and on a vote of 5-0
reconunended approval of creation of the proposed easements; and
WHEREAS, the applicants have completed all requirements of the City for the
creation of a driveway easement for ingress and egress in favor of Lot 17 over Lot 12;and in favor of
Lot 18 over Lots 11 and 12,

1\TOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Orono hereby approves the creation of the proposed ingress/ejress easements as shown on the
Certificate of Sui-vey by Danial G. Nickols, a licensed surveyor of Schoell & Madson, Inc. dated
Novernber 23, 200�, attached hereto as E�.hibit "A", subject to the following conditions:
1. Applicant shall be responsible for the creation and.filin� of the aforesaid easements in the
chain of title of the affected properties.
2. Nothing in this approval shall be construed as grantin�any variances, zoning approvals,or
waivers of any development standards established by the City of Orono.
3. The aforesaid easements shall be filed with either the Hennepin County Recorder's Office or
Registrar of Titles Office withui one year of the date of this Resolution. If said easements
have not been filed within one year,this approval will expire and it will be necessary to file a
new application witli the City of Orono for easement approval.
Adopted by the City Council of Orono, Mirulesota this 23rd day of January, 2006.
