Sec.13.04 RIGHTS OF SLJBJECTS OF DATA � "
Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secdon.
Subd.2. Informadon required to be given individual, pn indiv9dual asked to supply private or confidendal daca conceming himself
shall be informed oF. (a)the purpose and intended use of the requesud data within the collecting state agency,polidcat subdivision,or statewide
ryscem;(b)whether he may refuse or is legally required to supply the requested data;(c)any lrnown consequence arisiag from his supplying or
refusing to supply private or confidrnrial data;and(d)the idenary of other persons or endaes authorized by state or federal!aw ro receive the dara.
This requirement shall not apply when an individual is asked to supply investigative data, pursuant to secdon 13.82, subdivision 5, to a law
enforcement o�cer.

Subd. 3. Access to data by indiridual. Upon request w a responsible authoriry,an individual shall be informed whether he is the
subject of s[ored data on individuals,and whether it is classified as pubiic,private or confidendal. Upon 6is further request,an individual who
is the subject of swred private or public data on individuals shall be shown the daa wirhout any charge to him and,if he desires,shall be informed
of the content and meaning of that data. Aher an individual has been shown the private data and informed of its meaning,the data need aot be
d'uclosed to him for six months thereafter unless a dispuce or ac6on pursuant to this secdon is pending or addirional data on the individual has been
collected or created. The responsible authoriry shall provide copies of the private or public dara upon request by the individual subject of the data.
The responsible aurhority may require the requesang person ro pay the actua!cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
of the dace of the request,excluding Saturdays,Sundays and lega!holidays,if immediate compliance is not possible. If he cannot comply widi
[he request wi[hin that ame,he shall so inform the individual,and may have an addiaonal five days within which to comply with the request,
exctuding Saardays,Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or
private data conceming himself. To eae�ise this right,an individual shall notify in wriang the responsible authoriry describing the oaaire of dze
disagreemecu. The respo�sible authoriry shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to aoafy
past recipiencs of inaccurate or incomplete data,inctuding recipienu named by the individual;or(b)noafy the individual that he believes the data
to be coaect. Data in dispute shall be disclosed only if the individual's sratement of disagreement is included with the disclosed data.
The determinaaon of the responsible authoriry may be appealed pursuant w the provisions of the administraave procedure act relating
[o contested cases.
