Schedule a minimum of one hour for the framing inspection. i Erosion control mechanisms must be installed and inspected by the City proper to any land disturbing activities. The contractor must provide a ��� minimum of a 24 hour notice prior to inspection. Erosion control shall be installed and maintained throughout the entire G/� project and must remain until vegetation has been established. When completed the driveway must be paved with blacktop, cement or the /��� equivalent per City Code Section 18-136. Prior to the issuance of a Certificate of Occupancy an as-built survey and G���� hardcover calculations must be submitted and approved. Staff conducted a preliminary review based on the information provided and recommends the following items be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Lots of Record. This lot is 6,715 sf and 49.86 feet wide where 21,700 sf and 100 feet in width is the minimum required by the LR-iC zoning district. However, according to City Code Section 78-72(cj(1), this lot can be redeveloped without lot width and lot area variances only if the property can meet all the specific criteria(copy of code section attached). Otherwise a lot width and lot area variance are needed. 2. Hardcover Calculations. The property is located in Tier 3 of the Stormwater Quality Overlay District; which permits 35% hardcover. However due to the non-conforming lot size in order to redevelop this property without lot area and lot width variances the maximum allowed hardcover is limited to 25%. Proposed hardcover as submitted is 26.9%. Attached is a copy of our hardcover information packet. 3. Certificate of Survey. If not applying for a variance,please reduce the hardcover and provide two copies of an updated,full size certificate of survey which meets all of the City's survey standards (enclosed). 4. Building Plans. If not applying for a variance and the hardcover reduction results in a change in the proposed home, please provide two copies of updated building plans. 5. Landscape Plan. Prior to the issuance of the building permit a landscape plan must be submitted showing all the proposed exterior/landscaping improvements, i.e.patios,gradin�,sidewalks,retaining walls,etc. The plan should include the name of the individual performing the work. The landscape plan should match what is shown on the survey. 6. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will �uarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$2,500. (a) A lot of record is any lot for which a deed or registered land survey has been recorded in the office of the register of deeds or the registrar of titles for Hennepin County prior to January 1, 1975, and after approval bythe council if required. (b) A lot of record located within an R(Residential) or RR(Rural Residential) district but not within the Shoreland Overlay district, RS Seasonal Recreational district, or any of the LR-Lakeshore Residential districts,which does not meet the requirements of this chapter as to area or width may be utilized for a single-family detached dwelling purpose, provided that in the judgment of the council or administrative approval by the planning director, such use does not adversely affect public health or safety and the following requirements are met: (1) In R districts of one acre or less and served by public sanitary sewer.A lot of record existing upon January 1, 1975, in any R district of the city of up to and including one acre,which lot is serviced by public sanitary sewer and which does not meet the requirements of this chapter as to area or width only, may be utilized for single-family detached dwelling purposes without council approval if all other requirements of the underlying zoning district are met, including but not limited to required yards, setbacks, lot coverage by structures, hardcover, etc. However,the lot of record shall not be more intensely developed unless combined with one or more abutting lots or portions so as to create a lot meeting the requirements of this chapter. (2) In R or RR districts of greater than one acre and served by public sanitary sewer.A lot of record in any R or RR district in the city in excess of one acre which does not meet the requirements of this chapter as to area or width only may be utilized for single-family detached dwelling purposes by administrative approval if the planning director finds that the following conditions are met: a. It is at least one acre in size, and the average width of the lot is at least 100 feet; b. It is served by public sanitary sewer; and c. It otherwise meets the requirements of this chapter or other applicable Code provisions. (3) In R or RR districts not served by public sanitary sewer.A lot of record in any R or RR district in the city not served by public sanitary sewer must meet the area and width requirements of this chapter and shall not be utilized for single-family detached dwelling purposes without council approval.Administrative approval may be granted for a lot of record not meeting the lot area and width requirements if the planning director finds that the following conditions are met: a. The lot area and lot width each meet at least 50 percent of the district standard. b. Suitable primary and alternate septic sites are identified on the properry and are protected from future development by execution of a covenant. c. All other zoning ordinance requirements must be met, including but not limited to the following: 1. Setbacks. 2. Hardcover. 3. (c) A lot of record located in any shoreland district, including the Shoreland Overlay district, RS Seasonal Recreational district, and any of the LR- Lakeshore Residential districts, that does not meet the requirements of this chapter for lot size or lot width shall be subject to the following regulations: (1) A nonconforming single lot of record may be allowed as a building site without variances from lot size and width requirements, provided that: a. All setback requirements can be met; b. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or the lot is connected to a public sewer; and c. The impervious surface coverage meets all hardcover location and square footage restrictions of this chapter and the total square footage of hardcover does not exceed 25 percent of the entire fot area. d. All other zoning district standards can be met. (2) In a group of two or more contiguous lots of record under a common ownership, an individual lot must be considered as a separate parcel of land for the purpose of sale or development, if it meets the following requirements: a. The lot must be at least 66 percent of the dimensional standard for lot width and lot size for the shoreland classification consistent with Minnesota Rules, chapter 6120; b. The lot must be connected to a public sewer, if available, or must be suitable for the installation of a Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, and local government controls; and c. Impervious surface coverage must meet all hardcover location and square footage restrictions of this chapter and the total square footage of hardcover must not exceed 25 percent of the entire lot area; and d. Development of the lot must be consistent with the comprehensive plan. (3) A lot subject to either subsections 7 -72(c)(1)or(2) remains subject to the hardcover restrictions of this chapter, as follows: a. Where the hardcover square footage allotment as calculated based on the assigned tier exceeds 25 percent of the entire lot area, hardcover shall be limited to 25 percent of the entire lot area. b. No portion of the impervious surface square footage allowed shall be placed within in 75 feet of a lake OHWL or tributary bank, except for those items normally allowed in such location as regulated elsewhere in this chapter. (4) A lot subject to subsection 78-72(c)(2) not meeting the requirements of subsection 78-72(c)(2) must be combined with the one or more contiguous lots so they equal one or more conforming lots as much as possible. (5) Notwithstanding subsection 78-72(c)(2), contiguous nonconforming lots of record in shoreland areas under a common ownership must be able to be sold or purchased individually if each lot contained a habitable residential dwelling at the time the lots came under common ownership and the lots are suitable for, or served by, a sewage treatment system consistent with the requirements of Minn. NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby approves the requested variances as described above based on one or more of the following findings of fact concerning this property: FINDINGS OF FACT: A1. The analysis contained within staff inemos and the exhibits attached to the aforesaid memos, all minutes from the above mentioned meetings, and any and all other materials distributed at these meetings are hereby incorporated by reference. The Property is located within the LR-1C Single Family Lakeshore Residential District which requires a minimum lot area of 0.5 acres (21,780 s.f.) and a minimum lot width of 100' for construction of a single family residence. A3. The Property is 6,715 s.f. (0.15 acres) in area and 50 feet in defined width, and contains an existing single family residence. The property is considered as legally nonconfornung with regard to lot area and lot width. A4. The property is located within Storm Water Overlay District Tier 3 which allows 35% hardcover for conforming lots. In order for a nonconforming lot to qualify for avoidance of the need for area and width variances for redevelopment, the lot would be limited to 25%hardcover. A5. The applicant is proposing to remove the existing residence structure and replace it with a new residence. When applying for the demolition and building permits, applicant was advised that either hardcover would be limited to 25%, or a lot area & width variance application would be required in order to increase that to 35%. Applicant determined that keeping to the 25%limitation would severely restrict the driveway, decks, sidewalks, and potential other amenities desired, hence this application. Setback, height and structural coverage limits will be met; hardcover is proposed at 28.1% where 35% would be allowed if the variances are granted. A6. The Navarre Heights neighborhood consists of single family homes located on Lyric Avenue, Livingston Avenue and Crystal Place, between Shadywood Road and Blaine Avenue. In this neighborhood, 42 homes are on single lots virtually identical in size and shape to the applicant's lot; 22 homes are on double lots; 5 homes aze on triple lots; and one home is on a combination of 41ots. A7. The applicant's property has contained a single family residence for many decades. The ability to rebuild on the property in the same manner as other existing developed properties in the immediate neighborhood would be limited if the area and width variances are not granted. The applicant's proposed site plan indicates all required LR- 1C setbacks will be met, and the proposed house is well under the 1500 s.f. structural coverage allowance for lots less than 10,000 s.f. in area. A8. The property abuts the City's Navarre playground, which is partially screened from this property by a row of arbor vitae along the west line of the park. Additionally, applicant's property contains two mature oak trees (30" and 36") which provide afternoon shade to the park. While it is hoped that one or both of these trees can be preserved during the demolition/rebuild process,neither tree is specifically protected under City ordinances. A9. In considering this application for variances, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed variances Page 2 of 6 �o�o C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL � ���kESHO��G`� N�. h �J � ;. upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. VARIANCE ANALYSIS: B 1. "Variances shall only be permitted when they are in harmony with the general purposes and intent of the ordinance . . . ." Single family residences are a permitted use within the LR-I C zoning dishzct B2. "Variances shall only be permitted... when the variances are consistent with the comprehensive plan." The proposed residential principal structure is a residential use which is consistent with the comprehensive plan guiding of this and surrounding properties for residential use. B3. "Variances may be granted when the applicant for the variance establishes that there are practical difficulries in complying with the zoning ordinance. `Practical difficulties,' as used in connection with the granting of a variance,means that: i. T'he property owner in question proposes to use the property in a reasonable manner, however,the proposed use is not permitted by the official controls." ii. The plight of the landowner is due to circumstances unique to his property not created by the landowner." iii. The variance,if granted,will not alter the essendal character of the locality." The property owner is proposing to use the property in a reasonable manner but the size of the lot is below the minimum lot size standards of the Zoning Code. The plight of the property owner is due to the existing substandard lot size, which is a result of the property being platted as part of the Navarre Heights subdivision in 1909, long before local zoning codes were in effecz The Navarre Heights neighborhood consists of lots typically SO feet in width and 130-145 feet in depth. Over time these lots have been developed for individual homes singly or in combinations of 2 or 3 lots together. Construction of a single family residence on a single lot in this neighborhood will not be inconsistent with the character of the surrounding neighborhood B4. "Economic considerations alone do not constitute practical difficulties." Economic considerations have not been a factor in the variance approval determination. B5. "Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter 78." This condition is not applicable, as the use for a single family residence is an allowed use in the LR-1CDistricz B7. "The board or council may pernut as a variance the temporary use of a one-family dwelling as a two-family dwelling." This condition is not applicabl� B8. "The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property." The lot size and hardco►�r restrictions applying to this property are similar to those of other properties in the neighborhood, and there are many similar sized developed lots in the neighborhood B9. "The conditions do not apply generally to other land or structures in the district in which the land is located." The standards applicable to this properly apply to all other property in the neighborhood; however, in order to be allowed the 35% hardcover that other developed similar-sized lots are afforded, granting of a variance to lot area and width is required B10. "The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant." The properly rights of the owner will be diminished if the variances are not granted, as the new residence would not be able to have the 35%hardcover that neighboring similar-sized lots are allowed B 11. "The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter." Granting of the variances would not impair health, safety, comfort or morals and would not be contrary the intent of the zoning cod� B 12. "The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty." Applicant shall comply with the permitting requirements of the Minnehaha Creek Watershed District. 4. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining a building permit for the project and commencing construction of said project within one year of the date of Council approval, or the variances will expire on that date(April 11, 2017). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6.
