Sec.13.04 RIGHTS OF SUB.TECTS OF DAT?i
Subd. 1. Type of data. The righu of individual on whom rhe data is stored or to be stored shall be as set forth in this secrion.
Subd.2. Information required to be givess individual. An individual asked to supply private or confidenaal data concerning himself shalf
be infocmed of: (a) the purpose and intended use of che requesced data wichin the collecnng stare agency, polidcal suodivision, or sratewide sysrem; (b)
wherher he may refuse or is legally required co supply the requested data; (c)any known consequence arising from his supplying or refusing co supply
private or confidenaal data; and(d)the idendty of othez persons or entities authorized by sta[e or federal law to receive the data. This requirement shall
not apply when an individual is asked to supply investigaave data, pursuant to secrion 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue mav place the noace�equired under tfus subdivision in the individual income rax or propertv tax refund instructions
instead of on those farms.
Subd.3. Access to data by individual. Upon request to a responsibie authoriry, an individual shall be informed whether he is the subject of
sto�ed data on individuals,and whether it is classified as public,private or confidendal. Upon his further request, an individual who is the subject of stored
private or pubiic data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disctosed to him for siz mon[hs
thereafrer unless a dis�ute or acrion pursuant to this secrion is pending or addiaonal data on the individual has been collected or crea[ed. The responsible
au[hority shall provide copies of the private or public data upon request by [he individual subject of the data. The responsible authoriry may require the

responsible authority shall widiln 30 days either: (a)cottect the data found to be inaccurate or incomplete and attempt to notify past recipienu of inaccurate
or incomplece data, including recipienrs named by the individual;or(b) notify [he individua( �ha[he believes the data to be correct. Data in dispute shall
be disclosed only if the individual's statement of disagreement is included with the disctosed data.
The determinadon of the responsible authoriry may be appealed pu�uant to the pmvisions of the administradve procedure act reladng to contested
cases.

RE: Permit to Build for the Kleineman Residence, 1280 Lyman Avenue, Orono, MN
Dear Lyle:
It is our understanding that a condition of approval for the platting of Lots 1 through 3 of Lyrnan Woods was a
requirement that the developer construct an earthen berm between the proposed new residence on Lot 1 and the
adjacent neighbor to the southwest, Ms. Margaret Fox. We further understand that the intent of such berm was to
shield Ms. Fox's home frorri headlights of vehicles exiting Lot 1.
Because we feel that there rnay be more desirable options for screening her home than clearing that portion of the
site in order to construct the berrn, it has been our intention to meet with Ms. Fox to discuss the options and come to
an agreement as to what the best solution may be. However, as we discussed (ast Friday, this office is experiencing
some difficulty contacting Ms. Fox, partly due to her unlisted phone number.
So as to not further delay approval of our application for permit to build this Project, Archetype Builders respectfully
requests that you accept this letter as our guarantee that such agreement will be worked out and submitted to the
City of Orono for approval.
Please be assured that this agreernent will be forthcoming, directly following a successful meeting with Ms. Fox.
Also, if no other option is acceptable to Ms. Fox and the City of Orono, Archetype Builders will construct the berm
shown on the approved plat plan as part of our Project.
It is important that we begin our ProJ�ect as soon as possible, and we hope this letter will be accepted as conditional
approval of our building permit application. If you have any questions concerning this issue or require additional
information, please call.

01/22/00 telephone conversation with Paul Weinberger and Chris Pence, existing reports
were deemed adequate for issuance of the Building Permit, but ultimately a new report will
need to be prepared specific only to our site. S-P Testing is in the process of preparing such
a report. Also:
a. A drain field covenant will be drawn up for execution
b. Primary and secondary drain fields will be fenced-off before this permit is issued,
including 20'-0" buffer.
