GRANT OF PERMANENT ROAD EASEMENT
BRIAN E.PALMER and NLIA M.PALMER,husband and wife,hereinafter referred to
as "Grantors", in consideration of One Dollar($1.00)and other good and valuable consideration,the
receipt and sufficiency of which is hereby acknowledged, does hereby grant unto the CITY OF
ORONO, a municipal corporation organized under the laws of the State of Minnesota,the Grantee,
hereinafter referred to as the "City", its successors and assigns, forever, a permanent easement for
public roadway purposes over, across, on and through land situated within the County of Hennepin,
State of Minnesota, as described on the attached Exhibit"A" and depicted on the attached Easement
� Sketch.
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public roadway systems over, across, on and through the easement premises, together
with the right to grade, level, fill, drain, pave, and excavate the easement premises, and the further
right to remove trees, bushes, undergrowth, and other obstructions interfering with the location,
construction, and maintenance of said public roadway systems.
The above named Grantors, their successors,heirs, and assigns, do covenant with the City,
its successors and assigns, that they are well seized in fee title of the above described easement
premises;that they have the sole right to grant and convey the easement to the City;that there are no
unrecorded interests in the easement premises; and that they will indemnify and hold the City
harmless for any breach of the foregoing covenants.

Easement Description
Parcel Descrintion:
That part of Tract A lying Easterly of the following described line: Beginning at the most
Northerly corner of said Tract A; thence Southerly to a point on the South line of said Tract A,
distant 120 feet West from the Nor�heast corner of Tract B, Registered Land Survey No. 1067,
Hennepin County, Minnesota
which lies Southwesterly of Line A described below:
Line A: Beginning at Right of Way Boundary Corner B 13 as shown on Minnesota Department
of Transportation Right of Way Plat No. 27-134; thence Northwesterly on an azimuth of 302
degrees 53 minutes 43 seconds along the boundary of said plat for 58.51 feet to Right of Way
Boundary Corner B 14; thence deflect to the left along the boundary of said plat on a tangential
curve, having a radius of 11279.16 feet and a delta angle of 03 degrees 42 minutes 00 seconds,
for 728.39 feet to Right of Way Boundary Corner B15 and there terminating.
Subject to the following restrictions and reservations:
No access shall be permitted to Trunk Highway No. 12 from the lands herein conveyed;
The State of Minnesota reserves a wall maintenance, footing and drainage easement in perpetuity
on that part of the lands herein.conveyed which lies Northeasterly of the following described
line: Beginning at Right of Way Boundary Corner B12 as shown on said Plat No. 27-134;
thence Northwesterly on an azimuth of 302 degrees 53 minutes 43 seconds along the boundary
of said plat for 98.41 feet to Right of Way Boundary Corner B20; thence deflect to the left along
the boundary of said plat on a tangential curve,having a radius of 11264.16 feet and a delta angle
of 03 degrees 47 minutes 54 seconds, for 746.75 feet to Right of Way Boundary Corner B16 and
there terminating;
Together with a nonexclusive easement for road purposes over that part of Tract B,Registered
Land Survey No. 1067, lying within 1�5 feet on each side of the following described centerline:
Commencing at the Southwest corner of said Tract B; thence on an assumed bearing of North 87
degrees 45 minutes 40 seconds West on the Westerly extension of the South line of said Tract B
a distance of 13 feet to the point of beginning of the centerline being described; thence North 14
degrees 20 minutes East a distance of 6632 feet; thence along a tangential curve to the right
having a radius of 120 feet and central angle of 47 degrees a distance of 98.44 feet; thence
North 61 degrees 20 minutes East a distance of 97.80 feet; thence along a tangential curve to the
right having a radius of 730 feet and central angle of 12 degrees a distance of 152.84 feet; thence

North 73 degrees 20 minutes East a distance of 290.63 feet to the North line of Tract B and there
ending as contained in Doc No. 1422743; (See Order poc No.1616118)

That part of Tract A, Registered Land Survey No. 1067, for road piuposes, described as follows:
That part of said Tract A lying within the circumference of a circle having a radius of 50 feet, the
center of said circle being the Northeast corner of Tract B, said registered land survey, as contained
in Document No. 1574029.
New Roadwav Easement Descrintion: �
The South 50.00 feet of the West 120.00 feet of the parcel described above lying west of the above
described existing road easement owned by the City as contained in Document No. 896443.

CONSENT TO EASEMENT
U.S. BANK NATIONAL ASSOCLATION, which holds a mortgage on all or part of the
property more particularly described in the foregoing Grant of Permanent Easement, which
mortgage is was recorded on October l, 2007 as Document No. 4431722 with the office of the
Hennepin County Registrar of Titles, for good and valuable consideration, the receipt and
sufficiency of which is hereby aclrnowledged, does hereby join in, consents, and is subject to the
foregoing Grant of Permanent Easement.
