Re: Post-acquisition Zoning Status of Properties along Highway 12 Route
Dear Ms. Lee:
You have inquired as to the post-acquisition zoning status of certain MnDOT-acquired properties
which MnDOT proposes to re-sell. The properties you have inquired about specifically include:
1200/1230/1290 Orono Oaks Drive; 1180 Lyman Avenue; 365 Old Crystal Bay Road North; and
375/380 Silver Meadow Drive.
All of the above properties are located in the RR-1B Rural Residential Zoning District requiring a
minimum lot area of 2.0 dry buildable acres and a minimum lot width of 200'. Required property
setbacks for principal structures are 50'front and rear, 30'sides, 50'side street. We have now been
provided with approximate"before"and"after"lot azea information for the properties in question.
None of the above listed properties are provided with municipal sanitary sewer; they are all served
by septic systems.Each non-served property is required to have a conforming septic system and an
alternate site available for future use. You have provided the City with septic system testing
information which we have reviewed.
Based on the information provided,the following are our conclusions regarding the status of these
properties as you prepare to re-sell them:

1180 Lpman Avenue(Developed residential lot)
Proposed Legal Description: (metes and bounds)
Lot Standards:
Gross area prior to MnDOT Acquisition: 1.48 acres (Area var. granted 1987)
Proposed gross area: 1.1 acre approx.
Lot area becomes more nonconforming to the 2.0 acre minimum standazd.
The impact of this is that total reconstruction on the site would require a lot
area variance.
House Setbacks:
Proposed rear house setback is approximately 20-25'. Required = 50'.
The rear yard becomes substandard, and no additions to the existing home
within 50' of the rear lot line would be allowed. The house becomes
nonconforming as to location.
On-site systems:
Proposed tested drainfield sites have been rejected because they do not conform to
minimum City requirements, to wit:
a) Primary site is a performance system.
b) Alternate site is within City cul-de-sac easement, the ultimate use of which
would be for road purposes.
c) Primary site does not meet required 20' setback to property line.
The use of a performance system as a primary system for an existing residence is
allowed only when a standard system is not feasible due to pre-existing lot
limitations, or only when a site is concurrently approved and preserved meeting
the requirements for a standard system.
The use of the City road easement for a primary or alternate site will not be allowed.
The extreme length of Lyman Avenue suggests that future development of a cul-de-
sac will likely be warranted,and the City has to date acquired 2/3 of the area for such
a cul-de-sac, including the easement area within 1180 Lyman Avenue.
If septic sites do not exist,the only reasonable alternative would be to remove the house,the
site becomes unbuildable, and attach it to adjoining lot(s) as additional yard area.

1200 Orono Oaks Drive (Developed residential lot)
Proposed Brief Legal Description: Lot 6 and part of Lot 5, Block 1, Orono Oaks
Lot standazds:
Proposed gross area(no wetlands): 2.8 acres (Conforming lot area)
House setbacks remain conforming.
On-site systems:
Proposed tested drainfield sites have been rejected because they do not conform to
minimum City requirements, to wit:
a) Neither mound site proposed meets City setback to driveway of 20'or state
code setback of 10'.
b) Alternate site does not meet 20'required setback to property line.
c) Primary site does not meet required 20' setback to property line.
While the 10' setbacks to lot lines are not necessarily onerous, the setbacks to the
driveway are of particular concern, because the primary site will impose lateral
underground flows downhill directly towazd the existing driveway,potentially causing
it damage and/or the driveway compaction will tend to block any such potential
flows, which could cause surfacing of sewage; and the alternate site abutting the
downhill side of the driveway will potentially be negatively impacted by runoff
directly from the driveway or by snowmelt from snow plowed onto the mound.
Because both sites as designed contain inherent risks, the City is not supportive of
granting variances to allow such systems.

Lot Standards:
Proposed gross lot area: 1.8 acres (Appears to include no wetlands)
Lot area becomes non-conforming to the 2.0 acre minimum standard.
The impact of this is that total reconshuction on the site would require a lot
azea variance.
House setbacks:
Proposed rear house setback: 25' (15' from wall easement); Required=50'
The rear yard becomes substandard, and no additions to the existing home
within 50' of the rear lot line would be allowed. The house becomes
nonconfornung as to location.
On-Site Systems:
Proposed tested drainfield sites and designs are acceptable.Highway construction will
eliminate part or all of existing drainfield (which is nonconforming and must be
replaced by 2010). Once existing system is destroyed,City will not allow occupancy
of residence until new primary septic system is installed.
1290 Orono Oaks Drive (Developed residential lot)
Proposed Brief Legal Description: Part of Lot 3 and Part of Lot 4,Block 1, Orono Oaks
Lot Standards:
Proposed gross lot area: 1.9 acres
Proposed net dry buildable lot azea(excl.wetlands): 1.8 acres
Lot area becomes non-conforming to the 2.0 acre minimum standard.
The impact of this is that total reconstruction on the site would require a lot
area variance.
House setbacks:
Rear corner of house ends up 20' from reaz lot line, 10' from perm. wall
easement and abutting temp. construction easement. Required rear yard
setback is 50'. The rear yard becomes substandazd, and no additions to the
existing home within 50' of the rear lot line would be allowed. The house
becomes nonconforming as to location.
On-site systems:
Existing and identified future drainfield sites not affected. The existing on-
site system is considered as conforming.

380 Silver Meadow Drive (Developed residential lot)

Lot Standards:
Proposed Gross Lot Area:: 1.6 Acres approx.
Lot area becomes non-conforming to the 2.0 acre minimum standard.
The impact of this is that total reconstruction on the site would require a lot
area variance.
House setbacks:
Proposed rear(north)yard setback appears to be reduced to 40'where 50'is
required. The rear yard becomes substandard, and no additions to the
existing home within 50' of the rear lot line would be allowed. The house
becomes nonconforming as to location.
On-Site Systems:
Existing septic system is not impacted. Highway construction will eliminate
part or all of former tested alternate site, so a new alternate site should be
tested and submitted for approval.
375 Silver Meadow Drive (Previously developed residential lot now vacant)
Proposed Brief Legal Description: Part of Lot 3,Block 1, Meyer Dairy Addition
Lot Standards:
Proposed Gross Lot Area: 1.2-1.4 Acres approx.
Lot area becomes non-conforming to the 2.0 acre minimum standard.
The impact of this is that total reconstruction on the site would require a lot
area variance.
House setbacks:
House has been removed. Re-use of the site for residential use would require
a lot area variance, and provision of conforming house location and septic
system sites.
On-Site Systems:
Re-usability of existing system is unknown but doubtful. Potential impacts
may have occurred to possible alternate sites by house moving process.
This azea is not provided with municipal sewer.The post-taking lot size of just over one acre
is nonconforming. If MnDOT can show that suitable primary and alternate drainfield sites
are available,and that a new home can be constructed meeting all City location requirements,
then a variance for lot area might be granted if applied for.The alternative is to sell this land
to one or more adjacent property owners as additional yard area.

365 Old Crystal Bay Road N. (Previously developed residential lot now vacant)
Proposed Legal Description: (metes and bounds)
Lot Standazds:
Proposed Gross Lot Area: Approx. 6.0 acres
Lot area is conforming to the 2.0 acre minimum. Lot width remaining is
approximately 200'(requires 200'to be considered as conforming in width).
House setbacks:
House has been removed.
Subdividability:
Lot has potential to be divided into two lots, a front lot of at least two acres
and a reaz lot of at least 3 acres would be required. The rear lot would be
accessed by a 30'outlot containing a private driveway under city codes. �
On-Site Systems:
Testing has been submitted and approved for primary and alternate drainfield
sites for a"west lot" and an"east lot".
As we discussed on September 11,we understand it is MnDOT's policy to sell the properties as-is
with full disclosure of their status in relation to local codes. You are free to distribute the above
information,with the caveat that lot azea and setback data is merely estimated from provided plans
and may not be completely accurate.
In cases where you propose to move lot lines or create new lots, Orono does have a subdivision
ordinance requiring Planning Commission review and Council approval.
I am enclosing the on-site system review information from Matt Bolterman,Orono's Septic Systems
Inspector. You can contact Matt at 952-249-4600 if you wish to discuss his conclusions. We have
the copies of the septic testing and design reports here in the office if you wish to retrieve them.

MN-DOT has altered several properties in Orono in redoing HWY 12. After reviewina the septic
designs I have concluded that some of these designs do not meet Oronos' Septic Ordi.nance.
