Dear Mr. Leupke:
This letter is being sent to discuss several options for our typical engineered section for the boulder
retaining wall at the above location. This design is based on information and partial site plan provided by
you via email on July 30`h, 2015. The proposed boulder wall will be replacing an existing boulder retaining
wall.
The attached typical section shouid be referenced for construction details. Special note should be made
of the wail embedment depth and the geosynthetic fabric (geogrid) length as measured from the front
face of the wall if applicable.
Refer to industry standard practice references for installation information, specifications, and details.
- Boulders shall be placed to avoid continuous joint planes in vertical directions.
- Each stone shall bear on two or more rocks below it with good flat-to-flat contact.
- Compact any structural fill place behind the drainage zone to 95% standard proctor.
- Install woven landscape fabric behind the stone to limit soil migration through the wall face.
- Optional drainage stone shall consist of clean 3/4" to 1.5"crushed stone
The design of the wall system assumes the following:
• Location: To replace existing retaining wall south of house
• Length: Approximately 50'
• Maximum exposed height: 8'
• Minimum embedment depth = 12", as noted
• Soil conditions: Sandy Clay, friction angle = 30.0 degrees, unit weight of 125.0 Ib/ft3
• Allowable soil bearing capacity = 2,000 psf
• Surcharge loads behind the wali: None
• Slope at top: 5:1
• Slope at bottom: 10:1
• Boulder sizes: see cross section drawing

1. Owners have fil on# formally requesting the City to review plans
for the property addressed: (the `Subject Property") legally

2. Owners request the City to review said plans which requires City approval and may require
consutting legal and/or engineering review.
3. The City is willing to commence its review of the application and incur costs associated with said
review only ff the Owners establish an escrow to ensure reimbursemerrt to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCRO F NDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit� �,S�o with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consuftant review)or will
incur in meeting with�i ers, reviewing the plans, and preparing agenda packet material for City Council
review of La ication#2o�S�-oiz-4?--Etigible expenses shall be consistent with expenses the Owners
would be responsible for under a land use application.
�3. MONTHLY BILLING. As the City receives consuftant bills for incurred costs, the City will in tum
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible e�enses the City has incuRed.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to retum the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat.§§415.01 and 366.012.

Dear Mr. Leupke:
This letter is being sent per your request regarding the recently constructed boulder retaining walls at the
above address. This evaluation is based on the site visit I performed on October 13, 2015.
The construction of the retaining walls appears to be structurally stable and in general conformance with
boulder retaining wall and construction industry standards. The walls were constructed with stone of
sufficient size and setback. Other typical construction details such as use of drainage elements and filter
fabric also appeared to be followed correctly. As is normal for boulder retaining walls of this type, some
wall movement and soil settlement should be expected. I recommend that concentrated areas of surface
water should also be directed away from the walls. Numerous photos were taken for documentation,
some of which have been provided as part of this report.
Additionally, the soil conditions at the site met my initial soil bearing capacity requirement of 2000 pounds
per square foot (psf).
This evaluation was performed using the design guidelines presented in the third edition of the "Design
Manual for Segmental Retaining Walls" (DMSRW) published by NCMA in 2009. Direct all surface
drainage away from the retaining walls. If soil conditions, proposed layouts, or other design parameters
vary from that assumed, a revised analysis might be needed. Please call me if you have any questions or

TERMS AND CONDITIONS
This WALL EVALUATION and ensuing recommendations is expressly made subject to the following terms and
conditions to which all persons that receive and rely thereon agree:
1. Standard of Service—Services performed by ENGINEER under this agreement shall be performed in a manner
consistent with the skill and care ordinarily used by members of the engineering profession practicing under similar
conditions at the time and in the locality the services are performed.
• Client recognizes that interpretations and recommendations of ENGINEER are based solely on the
information available to the company.
• ENGINEER will be responsible for those interpretations and recommendations, but shall not be responsible
for the interpretation by others of the information developed
• Services provided reflect the professional judgment of ENGINEER,to the best of ENGINEER's knowledge,
information, and belief as of the date hereof.
• No other warranty or guarantee, express or implied, is made.
2. Said design is based entirely on and expressly limited by the scope of services ENGINEER has been employed by
Client to perform and as described in WALL PROVISIONS and LIMITATIONS.
3. If the ENGINEER is hired for any construction phase services or site visits, it is understood that the Contractor, not
the ENGINEER, is responsible for the construction of the project,and that ENGINEER is not responsible for the acts
or omissions of any contractor,subcontractor or material supplier;for safety precautions, programs or enforcement;
or for construction means, methods,techniques, sequences and procedures employed by the Contractor.
4.OWNERSHIP OF DOCUMENTS:All reports,field data,field notes,calculations,estimates and other documents
('reports') prepared by Engineer, as instruments of service,shall remain the property of Engineer. Client agrees that
all reports furnished to Client or his agents,which are not paid for,will be returned upon demand and will not be used
by Client for any purpose whatever. Engineer will retain all pertinent records relating to the services performed for a
period of five years following submission of the report,during which period the records will be made available to
Client at all reasonable times.
5.TERMINATION: This agreement may be terminated by either party by written notice. In the event of termination,
ENGINEER shall be paid for services performed and expenses incurred up to the termination notice date. Neither
Client not ENGINEER may delegate,assign,sublet or transfer his/her duties or interest in this Agreement without the
written consent of the other party.
7. To the fullest extent permitted by law, Client and ENGINEER(1)waive against each other, and the other's
employees, officers, directors, agents, insurers, partners, and consultants, any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of, resulting from, or in any way related to this wall
design and written report, (2)agree that ENGINEER's total liability to Client shall be limited to the total amount of
compensation received by ENGINEER and (3) if an action is brought against the ENGINEER and the ENGINEER
prevails, ENGINEER shall be entitled to recover costs and expenses, including reasonable attorneys'fees and costs.

TERMS AND CONDITIONS
This WALL EVALUATION and ensuing recommendations is expressly made subject to the following terms and
conditions to which all persons that receive and rely thereon agree:
1. Standard of Service—Services performed by ENGINEER under this agreement shall be performed in a manner
consistent with the skill and care ordinarily used by members of the engineering profession practicing under similar
conditions at the time and in the locality the services are performed.
• Client recognizes that interpretations and recommendations of ENGINEER are based solely on the
information available to the company.
• ENGINEER will be responsible for those interpretations and recommendations, but shall not be responsible
for the interpretation by others of the information developed
• Services provided reflect the professional judgment of ENGINEER, to the best of ENGINEER's knowledge,
information, and belief as of the date hereof.
• No other warranty or guarantee, express or implied, is made.
2. Said design is based entirely on and expressly limited by the scope of services ENGINEER has been employed by
Client to perform and as described in WALL PROVISIONS and LIMITATIONS.
3. If the ENGINEER is hired for any construction phase services or site visits, it is understood that the Contractor, not
the ENGINEER, is responsible for the construction of the project, and that ENGINEER is not responsible for the acts
or omissions of any contractor, subcontractor or material supplier;for safety precautions, programs or enforcement;
or for construction means, methods, techniques, sequences and procedures employed by the Contractor.
4. OWNERSHIP OF DOCUMENTS: All reports,field data,field notes,calculations, estimates and other documents
('reports')prepared by Engineer, as instruments of service, shall remain the property of Engineer. Client agrees that
all reports furnished to Client or his agents,which are not paid for, will be returned upon demand and will not be used
by Client for any purpose whatever. Engineer will retain all pertinent records relating to the services performed for a
period of five years following submission of the report,during which period the records will be made available to
Client at all reasonable times.
5.TERMINATION:This agreement may be terminated by either party by written notice. In the event of termination,
ENGINEER shall be paid for services performed and expenses incurred up to the termination notice date. Neither
Client not ENGINEER may delegate, assign, sublet or transfer his/her duties or interest in this Agreement without the
written consent of the other party.
7. To the fullest extent permitted by law, Client and ENGINEER (1)waive against each other, and the other's
employees,officers, directors, agents, insurers, partners, and consultants, any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of, resulting from,or in any way related to this wall
design and written report, (2) agree that ENGINEER's total liability to Client shall be limited to the total amount of
compensation received by ENGINEER and (3) if an action is brought against the ENGINEER and the ENGINEER
prevails, ENGINEER shall be entitled to recover costs and expenses, including reasonable attorneys'fees and costs.

Our engineer has performed a desk review of the as-built survey and has the following comment:
The confirmation of the soil bearing capacity at the retaining wall site as required by the permit was not
provided. Confirmation must be provided prior to close out of this permit. Attached is a copy of the issued
permit. The soil bearing report was required prior to the construction of the retaining wall. Please provide us
with a copy of the soil bearing capacity report.
While we are waiting for a copy of the soil bearing capacity report, I will have an inspector visit the site to ensure the as-
built survey accurately reflects the current site conditions. Please don't hesitate to contact me if you have any questions.
