Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to
inspection.
Erosion control shall be installed and maintained throughout the entire project and must
remain until vegetation has been established.
No underground sewer within 20 feet of well.
Prior to refund of the escrow money as-built survey must be submitted and approved.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading,sidewalks, retaining
walls, etc. not currently shown on the approved survey and landscaping plan will require a
separate Zoning Permit application to be submitted and approved prior to the work
commencing.
Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the
height of the lower wall require engineered plans and a building permit to be submitted and

An accessory building must be at least 3 feet (including overhangs) from a well; 20 feet from the drainfield and
' 10 feet from other parts of the septic system.
LOCATION
An accessory building must be at least 10 feet from the house (including a deck or overhang) and 10 feet from
any other structure. It may not be placed in a drainage, utility or similar easement.
Non-lakeshore lots:
An accessory building may not be placed closer to the street than the house. On a comer lot this requirement
applies to the narrower street frontage regardless of which frontage the front of the house faces or the address
of the house; principal building setbacks may be required. Special setbacks and approval apply to a "through

Sec. 78-1434. -Area restrictions.
In all R districts, no accessory building shall exceed 1,000 square feet of footprint area; except
that accessory structures in excess of 1,000 square feet will be allowed under the following
conditions:
(1) Not more than one oversized accessory structure (OAS) shall be permitted on any
property. An oversized accessory structure is defined as an accessory structure of
footprint area in excess of 1,000 square feet, except that the following nonroofed
accessory structures which exceed 1,000 square feet footprint area are not considered as
oversize accessory structures, but are subject to the special setback restrictions of
section 78-1404.
a. Tennis courts and sport courts.
b. Pools, when pool basin structure (excluding nonencroachment-type patios) is greater
than 1,000 square feet.
c. Paddocks or arenas.

On November 22, 2016 the City received a building permit application for an accessory structure. Staff conducted a
preliminary review based on the information provided and recommends the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. Our engineer has reviewed the survey and has the following comments:
a. The survey submitted does not comply with the City's Survey Requirements,copy enclosed.
i. Show two(2)foot contours and 50'outside of the lot lines. Identify all steep slopes over 12%.
The source for all topography must be indicated on the survey. The spot elevations shown
are helpful however according to the survey requirements the topography must be
represented as contour lines.
ii. Show erosion control,construction access and stockpile location.
iii. The gradin� plan should be revised to show perimeter erosion control measures (silt fence,
biologs,etc.)down gradient from proposed work.
Please have the survey updated and submit two,full-size copies for our review.
2. Landscape Plan. Will there be any changes to the landscaping with the proposed accessory structure? If so,
the City requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements,
i.e. patios, grading, sidewalks, retaining walls, etc. The plan should include the name of the individual
performing the work. Any proposed patios, grading, sidewalks, retaining walls shown on the landscape plan
should also be reflected on the survey.
3. Oversized Accessory Structure Covenant. According to City Code Section 78-1434(3)(c), copy enclosed,
accessory structures which exceed 1,000 square feet require the filing of a restrictive covenant in the chain of
title for the property. Please provide the full names of the individual(s) listed on the property title and their
relationship to each other, (i.e. husband and wife or the name of the company/LLC). We will then have our
attorney draft the covenant for the owner(s)to sign prior to issuance of a permit. The covenant conditions are
as follows:

In all R districts, no accessory building shall exceed 1,000 square feet of footprint area; except
that accessory structures in excess of 1,000 square feet will be allowed under the following
conditions:

1. The Survey does not comply with the City's Survey standards:
#10.Topographic contours at 2' contours on the entire lot(Lakeshore, 1') and 50' outside of lot lines. Identify all

2. The grading plan is otherwise acceptable.
3. The Grading plan should be revised to indicate perimeter erosion control measures (silt fence, bio logs,
etc.) down gradient from proposed work. Measures must be installed by the Contractor and inspected by
the City prior to any work. Contractor must provide a minimum 24 hour notice prior to inspection.

Our survey is complete and I will be bringing it in tomorrow morning. Also, as we discussed on the phone,
here are the answers to the other items you addressed in your letter dated 12/8/2016.
1. Certificate of Survey. I will bring in the revised survey tomorrow
a. a.i - Contours - Complete
b. a.ii —General information. We will not be disturbing the area where this building is
going. The building is framed "pole type"but the building will look like it was stick
framed. There will not be typical foundation disturbances because this is not a typical
excavated foundation. The area where this building is going is relatively flat as outlined by
the contours.
i. Erosion control —The ground is frozen and snow covered and there won't be erosion
because there is not a typical excavation.
ii. Construction access —the access will be our driveway (approx. 150�. If you
referring to tire/wheel debris possibly getting into the street, again, this will not be a
typical excavation and no material will need to be hauled away.
iii. Stockpile location — I assume you mean for excavation. We will be boring holes (not
the typical excavated foundation). If you would like, I can place erosion control logs
around the perimeter of the area. No material will need to be stockpiled for hauling
away.
c. a.iii —Grading plan —Again, the area where this building is going is relatively flat. Grading
is not necessary for placement of this building. I asked the surveyor about this item
specifically and he did not place any erosion control because there isn't any excavating

necessary for this project. However; as I stated earlier, I could place erosion control logs
around the perimeter of the area if you would like.
2. Landscape plan
a. There will not be any changes to the landscape with this project. We plan on having grass
and mulch around this building that mirrors the rest of our yard.
