Roger,
I left you a voice message earlier. I am looking at purchasing 135 Luce Line Ridge in Orono. I would like to
initially discuss putting up an accessory building. I have downloaded the application packet but I have some
questions about your process. My initial questions are:
1. The lot is 2.68 acres. I wouldn't be building more than a 1200 sq. ft footprint. I believe the
property is a PRD. Can you please tell me what the setbacks would be? The setbacks for an
accessory structure vary depending upon the size of the structure proposed. Attached is the
Accessory Structure information sheet. 135 Luce Line Ridge is located in the RR-1A zoning
district. However, setbacks (building envelope) are determined by the PRD Resolution No. 1709
(attached). An accessory structure must not be located nearer the front/street lot line than the
house. Also, in addition to the setbacks based on size, a proposed accessory structure must be a
minimum of 10 feet from other buildings; 20 feet from the drainfield; and 10 feet from other parts
of the septic system.
2. Would you have exact placement/specifications on the existing sepfic system? If yes, would these
available to me?
a. Initially I would like to place the structure on the north/northwest corner of the existing
driveway.
I have attached a copy of the as-built location of the septic system from 1987. As Roger has stated
above, we cannot assure this location is accurately depicted. The location should be verified.
3. I've read that accessory buildings cannot be placed closer to the street than the house. This, along
with whatever the side and rear setbacks are, may be difficult to do in that location. I want to hold
to that; however, I do not know what the setbacks are. Would it possible/feasible to obtain a
variance if it is necessary?
a. I would be mirroring the aesthetics (cedar, brick, angles, etc.) of the house on this new
structure
b. I would be trying to retain the trees and vegetation of where I believe the septic drain field
is currently
According to the PRD Resolution No. 1709 the front setback is 50'. Any proposal of an accessory
structure forward (streetward) of the principal structure would require a variance. Part of the
variance request requires stating what the practical difficulty is for requesting a variance. You will
need to describe why the accessory structure needs to be forward of the principal structure, i.e. is
there no legal alternative location?
4. Would it be possible to meet someone from your office out at the property?
a. We are having our inspection next Tuesday, August 16.
b. If that day doesn't work, I can make it when it's convenient for you.

I am the building Official for the City of Orono but I do not do zoning review so I will not be able to answer the zoning
questions 1.,3.,and 4..
As far as the septic system I have some records of the location but I cannot guarantee their accuracy because the
system was installed in 1987.There are other requirements for the septic system.There is a point of sale requirement in
the City of Orono for the septic system, if found non-compliant it is to be replaced at that time of sale. I have copied the
code section below.
There is a requirement that no permits can be issued for any additions or additional structures constructed until there is
a compliant septic system. I have also copied the code section for permits below.Our records show that your system is
probably non-compliant and would require a Compliance Inspection at the point of sale to verify it's status. Until you
have a Compliance Inspection completed you will not be able to know exactly where your system is. If the system is non-
compliant you won't know the location of the new system until you have a designer find a buildable location for their
design.Also,the system will need to be installed before you can do any additions to your house or additional buildings. I
have coped this reply to Christine Mattson in Planning And Zoning to address your other questions. If you have any

Sec. 58-77.-Rrc��ri�t�nsa�st�nd�r+�s for;indi�ri���f�wage tt��tm�nt sy�t�r�ts.
(a) No owner of a tract of land upon which a dwelling is located, or a tract of land upon which a structure which is required
to have an individual sewage treatment system is located, shall sell or transfer to another party said tract of land, unless
the following requirements are met:
(1) The seller of any property having an individual sewage treatment system shall have a state licensed inspector or
designer I complete the Minnesota Pollution Control Agency(MPCA)sewage system compliance inspection form
for existing sewage systems in accordance with this article and Minnesota Rules chapter 7080. The exception
would be a new septic system installed within the previous five years or a compliance inspection performed by a
licensed inspector or designer I within the previous three years.
(2) The seller must provide a copy of the completed sewage system disclosure form and the certificate of compliance
or notice of non-compliance to any person who signs a purchase agreement. The disclosure form and certificate
of compliance or notice of non-compliance inspection form must be provided to the buyer prior to signing the
purchase agreement.
(3) The licensed inspector or designer I must submit a copy of the certificate of compliance or notice of non-
compliance to the city within 30 days of the date of inspection.
(4) If the existing system is found to be out of compliance it must be brought into compliance prior to transfer of the
proper#y. If the system is not brought into compliance prior to transfer, the seller shall provide the buyer sufficient
security in the form of an escrow agreement to assure the installation of a complying ISTS.
(5) If the seller fails to provide a certificate of compliance, the seller shall provide the buyer sufficient security in the
form of an escrow agreement to assure the installation of a complying ISTS.
(6) The security shall be placed in an escrow with a licensed real estate closer, licensed attorney-at-law or a federal
or state chartered financial institution. The amount escrowed shall be equal to 150 percent of a written estimate
to install a complying ISTS provided by a licensed and certified installer, or the amount shall be equal to 110
percent of the written contract price for the installation of a complying ISTS provided by a licensed and certified
installer. After a complying ISTS has been installed and a certificate of compliance issued,the City of Orono shall
provide the escrow agent a copy of the certificate of compliance.

Sec. 58-47.-�t�6i�l��p+�t"�ti��p�� �ts.
(a) New residence. No building permit shall be issued for any new building that will be connected to an ISTS until a site
evaluation and design is approved by the on-site systems manager. The site evaluation must include the identification
of both primary and alternate drainfield sites suitable for a minimum of a five-bedroom residence. If the building will be
connected to an existing system, a site evaluation and design must be approved by the city, including the existing
system specifications and a future site meeting the provisions of this article.A new residence must be connected to an
ISTS meeting the definition of a code system.

• (b) Required upgrade or replacement A sewage treatment system not meeting the requirements of Minnesota Rules
' Chapter 7080, as amended, or the requirements of this article, whichever is more restrictive, must be upgraded, at a
minimum, at any time a building permit is required for any improvements on, or use of, the property, subject to the
following:
(1) Any such system for which the city has previously issued orders requiring upgrade or replacement of the system
by December 31, 2007, shall not be subject to this requirement until January 1, 2008.
(2) Any such system for which the city has previously issued orders requiring upgrade or replacement of the system
by December 31, 2010, shall not be subject to this requirement until January 1, 2011.
(3) Regardless whether previous upgrade or replacement orders have been issued, this upgrade or replacement
requirement shall not apply when said building permit is for regular maintenance or upkeep including but not
limited to replacement of inechanical equipment such as air conditioning, furnaces, water heaters, or water
softeners, or for re-roofing, re-siding or window replacement.
(c) Construction of additional bedrooms or construction including water-using appliances that will increase the sewage
flow into an ISTS. A building permit shall not be issued until the city confirms that the existing ISTS is compliant and of
adequate size to treat the sewage flow from the building and that a future drainfield site is designed and preserved. If
the existing ISTS must be repaired or replaced, an ISTS design for both the existing ISTS and a future drainfield site
must be approved before issuing a building permit. If expansion or replacement of the ISTS is required, the ISTS must
be installed and inspected before a certificate of occupancy shatl be issued for the construction. Failure to identify
satisfactory drainfield sites for the proposed sewage flow for use now as well as a future site shall result in the denial
of the building permit application.
(d) Expansion of an existing building, including decks and patios; construction of an accessory building, driveway or land
alteration. A future drainfield site must be designed and presenred prior to the issuance of a building permit for any
expansion of an existing building, construction to an accessory building or driveway or land alteration on a property
using an ISTS. A building permit will not be issued when the proposed work would preclude the use of the only future
drainfield site approved by the city.

Dear Mr. & Mrs. Anderson:
The city does not show your current system as being non-compliant. There is currently no need for you to do
anything. You mention a possible building permit to finish the basement? If this will involve the addition or
creation of bedrooms or adding to the water use capacity then the existing system may need to be certifled and or
expanded to accommodate the new house configuration. The main point of the letter was to introduce the
residents to the fact that a new ordinance has been passed that requires all properly owners with a septic system
to have a compliance inspection done at the time of sale and if the existing system is not up to code then is needs

Andy—
The existing trench drainfield system is very likely not compliant with current requirements for separation from the
seasonally saturated soils. This would have to be verified by soil borings on site by a certified ISTS designer. You should
probably plan on not being able to re-use the existing drainfield, and we would expect new testing and design work to
confirm that primary and alternate sites are available in order for a building permit to be issued. The attached
information from 30 years ago suggests the system was designed for a 3-bedroom house,today we require designs for 5
bedrooms. It's not apparent from our records whether an alternate site still exists. For additional discussion on this topic
