I apologize for the mixed messages you have received. I checked with our engineer, who did some rough calculations, and he confirmed you will not actually need an erosion control permit with the District.Your project will result in less than 5,000 sq ft of land disturbance and less than 50 cubic yards of earth material.The confusion was regarding the cubic yards of material involved. However, please do install the silt fence that is displayed on your plans. I again apologize for the confusion,you will not need a permit with the District for this project. Our erosion control rules are triggered if there is either a land disturbance of 5,000 sq ft or more (not applicable with your project), or if there is grading,excavating, filling, or storing on site 50 cubic yards of soil/earth material or more. I will be putting in an above grade "guard wall" to prevent any vehicles from slipping down the edge of the hill that is at the edge of the driveway. It is NOT a retaining wall as it's above the driveway and will have rebar less than 1' below grade just to hold it in place. It's not holding back anything. WHAT is triggering the erosion control permit need? We are simply replacing an existing driveway and we are adding rock to actually STOP the erosion that's been happenin�on the hill off the ed�e of our drivewav that's been happening for nearly 30 years• We need an erosion control permit for our erosion control project?! We are replacing an existing driveway! The only filling in of dirt is to stabilize the eroded hill and to possibly (if needed) level out areas where the driveway has sunk. NOTHING we are doing is anywhere near the far edge of our property where there is any wetlands/marsh. When I spoke to someone last Thursday I was told that the only reasons we would be triggering a needed permit from your office was if we were by a lake (we are not), or if we were hitting the part of our land that's marsh (we are not). There is no retaining wall. We are creating a "guard wall" above grade so nobody goes off the hill. We are very slightly widening the footprint of the driveway on the side yard. That's it. NOTHING will create any erosion. Nothing much is changing except going from asphalt to concrete. I don't even have any idea of how to fill in the erosion control permit as a result. Are you honestly suggesting that we have to add 6" of topsoil to our entire driveway before we cover it with concrete? That will make it too high for our garage! The only land that's being "disturbed" is the part that's currently underneath asphalt. I have no idea how I'm supposed to address any number of the boxes under site plan. For example, given we are simply replacing an existing driveway, there isn't any location for a proposed runoff control, erosion prevention, sediment control, etc. If the driveway didn't create a need for any of that for the past nearly 30 years, why now? I need some sort of rational explanation for why this is necessary and exactly how I'm supposed to even fill out your permits given the above issues.
