Dear Mr. Gibbs,
As per our phone conversation this morning I am confirming in writing our discussion and
agreement regarding septic system compliance, due by December 2010, and the responsibility of
the seller of a home in the city of Orono.
In May of 2008 and then again today you stated that if a home as been listed on the market prior
to October of 2007 (the date Ordinance # 38,third series was published to the public)the home
owner or seller, will not be required to have completed the septic system upgrade or replacement
prior to the sale of the property and not required to place in escrow the dollar amount to cover the
cost of the replacement or upgrade.
The property that I am marketing as a realtor with The Ritter Team at Re/Max Results in Wayzata
is 25 Luce Line Ridge, Orono, Minnesota. I have had this home listed for sale since September
2007 and now has been on the market for 551 consecutive days. My request of you today was to
allow us,the realtor and home owner/seller to take the home off the market, cancel it from its
current listing and re-list within a 24 hour period of time in order to drop the lengthy number of
days from the MLS.
You agreed to let us do this in order to, as you said, refresh the listing of this home on the market.
You also stated that you are willing to allow this and still regard it as being listed on the market
prior to October 2007 because it is still listed with me,the realtor with the originating listing and 1
have the Exclusive Right to Sell Listing Agreement from September, 2007 as confirmation.
Thank you for your consideration regarding this issue and I am confident the home at
25 Luce Line Ridge will sell in the near future.
