DECLARATION OF RESTRICTIVE COVENANT
THIS DECLARATION OF RESTRICTIVE COVENANTS (the "Declaration"), is made this
�day of__('>G 1 D�� , �a/I , by the undersigned parties, representing all of the
owners in fee of the land hereinafter described, lying in Hennepin County, Minnesota.
WHEREAS, Thomas J. Ryan and Suzanne M. P. Ryan, husband and wife, are the fee
owners of real property at 2350 Longview Circle, legally described as Lot 6, Block 1, Longview,
Hennepin County, Minnesota; and
WHEREAS, property owners have applied to the City of Orono for Building Permit No.
2011-00909 to construct a detached accessory structure (the "Structure"); and
WHEREAS, Building Permit No. 2011-00909 includes the installation of a toilet and hand
sink in an accessory structure; and
WHEREAS, Building Permit No. 2011-00909 also includes construction of an oversized
accessory structure; and
WHEREAS, the undersigned parties desire to impose upon and subject said land to
certain covenants, conditions, restrictions and reservations for the benefit of said land and its
present and future owners;
NOW, THEREFORE, the undersigned parties hereby declare, impose upon, create and
establish the following covenants, conditions and restrictions upon the property:
1. PROHIBITION ON USES.
A. The Structure shall not be rented, leased or otherwise provided for use as a
dwelling or guest house under any circumstances.
B. No bathing facilities shall be installed in the Structure.
C. The Structure shall not be used for a home occupation unless specifically
approved by the city or if allowed by this Code.

D. No future subdivision wlll be approved that piaces the Structu�thin a lot
that has no principai structure, except that the cit�+in its subdmsion approva�t
rnay grarrt a finite time periad in which the oversized accessory strudure may
remain without a principal structu�e, in order that a principal structure may be
constructed.At the end of this time period, the oversized acxessory structure
must be removed if no principat structure has been canstructed.
E. If the property is subdivided, the oversize acxessory structure and principal
structure witl�focated together within a lot that rneets the minimum lot area
cequirement for the given size of accessory building.
F. In subdivision approval, the setback required for the oversize accessory
structure shall remain.
2. RUN WITH THE LAND. The co�venan#s and restrictians set forth in this
�claration shall run with the land, shalt be reoorded with Hennepin County against the title ta
the iand,and shall be binding upon and inure to the benefit of the City and the Declarants
named herein, their successors, heirs, and assigns, and any other person or errtity at any time
herea€te�who shafl become the owner of the land,
