CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6766 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR A MAINTANENCE BUILDING AND AN AFTER -THE -FACT OUTDOOR KITCHEN AND PATIO PER THE PROVISIONS OF ORONO ZONING CODE SECTIONS78418 and 78-916 AT 685 N. OLD CRYSTAL BAY ROAD FILE NO. 17-3936 WHEREAS, the Orono Public Schools ISD 278, (hereinafter "the Applicant") is Owner of the property located at 685 N. Old Crystal Bay Road within the City of Orono (hereinafter the "City"), identified as Hennepin County PINS 33-118-23-21-0002, legally described as: The south 940 feet of Government Lot 1, Section 33, Township 118, Range 23, Hennepin County, Minnesota, subject to roads (hereinafter the "Property"); and WHEREAS, the Owner has made application to the City of Orono for a Conditional Use Permit (hereinafter "CUP") to allow the construction of a maintenance garage and an outdoor kitchen area; and WHEREAS, within the RR -1 B One -family Rural Residential Zoning District in which the Property is located, "Schools, daycare centers, uses accessory to a high school' may be allowed as an Conditional Use, NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 17-3936. 2. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above mentioned meetings, and any and all other materials distributed at these meetings are hereby incorporated by reference. 3. The Property is zoned RR -1B One -family Rural Residential District requiring a minimum lot area of 2.00 acres and a minimum lot width of 200 feet. The Property is approximately 32 acres in area. 4. The Outdoor kitchen is part of an outdoor learning and gathering pavilion that is customary improvement in a high school campus. 5. The redevelopment of the maintenance area is customary to the operations of a high school campus. Page 1 of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6 7 6 6 6. The planned improvements are located to the interior of the campus, visual impact to surrounding parcels will be negligible. 7. Analysis of the requests per section 78-916 of the City Code is as follows: a) Consistent with the community management plan; The community management plan guides the property for institutional uses. The school district operations falls into this category. b) Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 of the City Code; Schools are a conditional use in the RR -16 zoning district, as are accessory uses. The kitchen is 177 feet from the closest lake property line. The maintenance garage will be 724 feet from the lake. Lake Classen requires a 150 foot setback. An existing interior property line runs through the existing school buildings, this property line issue should be addressed. C) Adequately served by police, fire, roads, and stormwater management; The additions are adequately served. d) Provided with an adequate water supply and sewage disposal system; the additions are adequately served. e) Not expected to generate excessive demand for public services at public cost; This statement is true. f) Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; these improvements are in the center of a much larger school complex and are not expected to impact any adjacent property. g) Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; This statement is true. h) Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; This statement is true. i) Not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; This statement is true. j) Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; Screening or buffering is not recommended. k) Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; This statement is true. 1) Not cause excessive non-residential traffic on residential streets, parking needs that cause a demonstrable inconvenience to adjoining properties, traffic Page 2 of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6766 congestion, or unsafe access; The proposed additions will not add additional measurable traffic. M) Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; The kitchen is sited to preserve views from the pavilion, and will not impact views from the property. The shed is located in the middle of the property. n) All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; no lighting is proposed and o) Not detrimental to the public health, public safety, or general welfare. This statement is true. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed interim use permit on the health, safety and welfare of the community. 9. The City Council finds that the Applicants' request would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a Conditional Use Permit amendment pursuant to Orono Municipal Zoning Code Section 78418 to allow the construction of a maintenance garage and an outdoor kitchen, subject to the following conditions: 1. This CUP is for temporary use of the Property in accordance with the site layout and plans submitted by the applicant, attached hereto as Exhibit A. 2. Applicant shall obtain all appropriate required permits from Hennepin County, Minnehaha Creek Watershed District, MPCA, and any other agencies or governing authorities as may be required for activities on the site.
