Charge - 1290 Loma Linda Avenue

Issue Presented
You have inquired as to what would be a fair,
reasonable, and legal sewer connection charge to collect when
the property at 1290 Loma Linda Avenue is connected to the
municipal sewer system.
Conclusion
Based upon the facts as presented, the proper and
legal connection fee would be �225. 00, plus the actual cost of
extending a stub to serve the property.
Analysis
The situation illustrates the problems that arise when
the city' s connection charge does not represent the full and
fair cost of construction. From a fairness point of view, the
connection charge should reflect the original assessment plus
�225 . 00 since that is what the other properties were charged.
However, since the city did not assess this unit at the time of
the original assessment, the city cannot now assess that
property, without proceeding according to Chapter 429 of
Minnesota Statutes. Given the lapse of time since the original
assessment, it is doubtful whether the court would allow such a
reassessment .
The city, however, does not have to finance the cost
of extending a 90-foot stub to serve the property.

Accordingly, the city should charge the standard �225. 00
connection charge and the actual cost of constructing of the
stub to connect the property. Orono City Code § 3. 06 and 1987
Fee Schedule.
The city may wish to revise its sewer connection
charge ordinance to address the inequities presented by this
type of situation. Given the current nature of special
assessment law and the difficulty in proving special benefits,
such a revision would have several benefits. We have drafted
such an ordiance for another community we represent. If you

Dear Mrs. Udell:
Regarding your request of a determination of the sewer connection
charge for the above-referenced property, it has been determined that per
the current City fee schedule, the connection charge is $225.00. When a
house is built on the property, the property owner will be responsible for
the costs of actual connection from the house to the existing sewer in Loma
Linda Avenue. That sewer line is about 90' from the closest point on the
subject property. The property owner (or his private contractor) will be
responsible for tapping a new service stub into the sewer lateral and any
restoration of roadway or shoulder that may be necessary, as well as
permanent maintenance of that private connection.
This property was not provided �vith a sewer stub at the time sewer
project 1970-LS-1 was constructed, and was not assessed for sewer, although
the lots were listed on the assessment rol 1 as having been not assessed and
not served. Because the property owner is responsible for the costs of
this lengthy sewer connection, there is no sewer assessment.
The fol lowing charges will, therefore, be collected upon issuance of
the building permit for this property:
- Building permit/plan review fee/State surcharge (based on project
valuation)
�. - Sewer connection charge: $225.00
- Sewer Availability Charge (MWCC-SAC) : per current fee schedule
($525.00 in 1987 )
- Park fee - per fee schedule - 0.94 acre lot - $390.00
I have enclosed a copy of the sewer as-built map for your reference.

Linda Avenue via the unimproved "Summit Avenue" right-of-way, location of
such driveway to be approved by the Public Works Coordinator and
constructed and maintained at the property owner's expense.

Dear Mr. Udell:
The Building & Zoning Department is in receipt of your
application for a building permit for the above referenced
property. I note that attached to the permit application are
copies of a letter dated April 20, 1987 and a memorandum from the
City Attorney dated April 13, 1987, regarding the amount of
connection charges for sewer.
This letter is to advise you that the City policies
regarding sewer connection charges were revised in 1988 , hence
the connection charges of which you were advised in 1987 no
longer are correct. The current sewer connection fee is as
follows:
$ 225.00 base charge
3 ,704 .42 unit charge 1970-LS-1 Project
1, 941.62 lift station #10 by-pass
$5, 871.04 Total Connection Charge
Additionally, the sewer availability charge (MWCC-SAC) is
$600. 00 for 1990.
The City Council recently passed an ordinance repealing the
requirement for collection of park fees for existing lots of
record, therefore, the $390.00 park fee noted in the April 1987
letter is no longer required.
The sewer connection charges, SAC charge, and building
permit/plan review/State surcharge, (amount to be determined)
will be due and payable at the time a building permit is issued.

Also note that before a permit can be issued, you must
legally combine for tax purposes Lots 6, 7, 8 and 9, Block 8,
Saga Hill Revised, Hennepin County, Minn. This can be
accomplished by signing the enclosed combination request form and
forwarding it to Hennepin County. Evidence of legal combination
and evidence of your ownership of the property must be submitted
to the City before a building permit can be issued.

CASE IN POINT: A vacant property consisting of 4 separate tax parcels at
1290 Loma Linda Avenue was included in the 1970 LS-1 sewer district but was
not serve �ri�� sewer. It is possible that this occurred because the
property was under 2 or more different owners at the time. The lots are
now under one owner and together meet the area and width standards of the
LR-1B district to be a buildable property, except that sewer is not
available.
It appears technically feasible to extend a private 4" line a distance of
90' from the existing municipal sewer line to the property boundary.
QOESTION: What is a fair, reasonable, and legal sewer connection charge to
collect when we allow the property to connect to the municipal sewer?

- Original assessment for the 1970 LS-1 project was :

PROBLEM: 1987 fee schedule (portion attached) indicates only a $225.00

this is for previously assessed properties only or for all properties. . .
The property is currently for sale; a potential buyer is requesting to know
the dollar amount of the assessment or connection charge the City will
require. Staff requests your input as to what connection charge can
