Thank you for your email....
Please know,the Average Lakeshore Set Back Line ("ALSBL")submitted is drawn accurately and complies with all aspects
of the ordinance, including the parts of which you cite below—I attach the copy we pulled. The ALSBL is drawn from
the next closet residence structure, and originates at the point of the residence protrosion attached to the residence(I
further note this protrusion in this case is more than 42 inches high along more than half its length. Therefore,the
ALSBL submitted in the survey and attested to by the surveyor is, if fact, per the ordinance drawn from the most
lakeward protrusion of the residence building on the immediately adjacent lakeshore lot.
But that is only half the story and its not necessary to "drill down"further on this, because the proposed deck
replacement in this instance doesn't even come close to the ALSBL. In this case,the 13 feet deep proposed replacement
deck(only 2 or so feet deeper than the existing lower deck)does not even close to approaching the ALSBL. The
attached Illustration below shows this point. In the illustration below,a red line is drawn towards lake straight out from
house until it crosses the ALSBL. Significantly,the point where the two lines cross is more than 27 feet out from the
house. The replacement deck is this case is only 13 feet from the house—14 feet short the set back requirement.

The attached appears to be reflect a line drawn to a retaining wall on the adjacent house. The average lakeshore
setback line is measured from adjacent residence structures. Unless I'm missing something, this must be revised....

preliminary review based on the information provided and recommends the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey.
a. A survey dated 9-15-2015 was submitted, however it does not show the lakeward most point of the
house to the south of your property or the average lakeshore setback line. Please clarify.
b. Is the deck shown on the survey existing or proposed? The deck on the survey does not correspond
to the plans submitted. Please clarify.
c. Please provide two copies of an updated, full size certificate of survey which meets all of the City's
survey standards(enclosed).
2. Construction Plans. The plans submitted are not drawn to scale and do not match the sunrey. Revised plans
must be submitted and the proposed plan clarified on the survey.
3. landscape Plan. Will there be changes to the landscaping in conjunction with construction of the deck? If so,
the City requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements,
i.e. patios, grading, sidewalks, retaining walls, etc. The plan should include the name of the individual
performing the work.
4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District which
allows 25%of the gross area of the lot to be covered in hardcover. Please have the surveyor prepare hardcover
calculations, showing existin� and proposed hardcover using the City's Hardcover Calculation Worksheets.

5. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
