**NOTE CHANGE** Before scheduling an exterior insulation and/or drain tile inspection, a
foundation as-built survey must be submitted and approved by the City or a Stop Work order �"� �
will be issued.
Schedule a minimum of one hour for the framing inspection. �
Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to `,�q-�

Erosion control shall be installed and maintained throughout the entire project and must �
remain until vegetation has been established.
A haul route shall be submitted to the City Engineer for approval and inspection prior to
commencement of hauling from the site.The property owner shall be responsible for cleaning I/'�'� /
and repair of roadways for any adverse impacts. �
Prior to the issuance of a Certificate of Occupancy an as-built survey and hardcover calculations �
must be submitted and approved.
In the event of winter or other extended unfavorable weather conditions(which prevent the
completion of the exterior improvements and/or as-built survey) a Temporary Certificate of ���I �
Occupancy(TCO) may be necessary. A TCO requires a$10,000 escrow.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading, sidewalks, retaining
walls, etc. not currently shown on the approved survey and landscaping plan will require a ���
separate Zoning Permit application to be submitted and approved prior to the work
commencing.
Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the
height of the lower wall require engineered plans and a building permit to be submitted and �j�\" `

I have attached a revised survey for this project. It is coordinated with the landscape plan that you already
have. Do you need printed copies delivered?
You found the permit for a removal of two trees from last fall (Silver Maple and Buckthorn) and the landscape
plan shows the planting of two replacement trees within 75' of the OHWL. I expect we are good on this
point.
As previously mentioned,the landscape plan and survey do not match. The landscape plan identifies new
walls and stairs where the survey shows existing walls and stairs to remain. Revised and now matches. I
expect we are good on this point.
• The survey depicts the stairs at 60" wide and the landscape plan depicts the stairs at 48"' wide with a
boulder support/retaining wall on each side. If retaining walls are being proposed with new the stairs
which exceed tread height a variance will be required. Please provide a cross-section for review. Also,
any expansion of non-permitted hardcover within 75' of the OWHL may require variance approval.
• The existing lakeshore retaining walls can be re-built in-kind; however, engineered plans may be
necessary. Walls/hardscape constructed in conjunction with a building permit do not need a separate
Zoning Permit. This work was done by the owner/ landscaper last year after conversations with
Melanie. Please let us know what we need to do at this point..

• Silt fence location must be relocated to accommodate proposed work within 75' of OHWL. The MCWD
permit should be amended to include the proposed lakeshore changes. Revised. I expect we are good
on this point.
• Are the retaining walls on the south side of the property being replaced? Since the walls are over
and/or near the adjacent property line, we recommending coordination with the property owners of
1720 Bohns Point Road. Coordinated with neighbor and will be replaced in-kind,with boulder vs.
existing concrete.

Can you please connect with Melanie on some of this? Per Lincoln at Yardscapes, "Melanie knows about the
trees. I met with her and their engineer on site last year. We had permission to take them but had to get a
replacement plan in place which they have. They also thought replacing the block wall with the stone within
the same footprint was fine but did say I would need to get engineering. I don't recall them saying I needed a
permit."
We'll make the other adjustments that you had noted. I'll drop new sets on plans today.

Can you please connect with Melanie on some of this? Per Lincoln at Yardscapes, "Melanie knows about the trees. I
met with her and their engineer on site last year. We had permission to take them but had to get a replacement plan in

did say I would need to get engineering. I don't recall them saying I needed a permit."

On April 28, 2017 the City received a building permit application for a new single family home. Staff conducted a
preliminary review based on the information provided and recommends the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The survey and landscape plan contradict.
� a. The grading plan used for the variance apptication depicts the existing retaining walls along the
lakeshore as "to remain" and the landscaping plan submitted with the building permit application
C� depicts them as being replaced by stone. Provide clarification.
b. The landscaping plan depicts a stone wall on the north end of the home where none is depicted on
�(� � the grading plan. Provide clarification.
` c. If the plan is to replace the retaining walls along the lake shore the sediment/erosion control plan
�� should be adjusted accordingly. Have the survey updated accordingly.
Please note: If the retaining walls are being replaced and if they are over 4 feet in height as some
appear to be then engineered plans are required.The City Survey standards require retaining walls top
of wall and bottom of wall elevations to be called out. Walls greater than 4'in height must be designed
by a licensed professional,and plans must be submitted to the City for review prior to the approval of
the permit.Tiered walls are considered one wall unless they are separated by at least twice the height
of the lower wall.
�Top of Foundation. The top of foundation elevation is NOT shown on the survey. Please have the
(���surveyor call out the top of foundation elevation as well as show the point or spot where the top of
foundation elevation is in reference to. Please note, we expect the location to be consistent when
submitting the foundation as-built.
e. The bottom 1'/:inches of one of the survey's missing.
f. Please provide two copies of an updated,full-size certificate of survey which matches the landscape
plan for our review.
2. Landscape Plan. A landscape plan was submitted, however:
a. The bottom 1%inches of information missing.
b. Trees are shown to be replaced within 75'of the OHWL. Are the trees being removed dead, diseased
or dying? A Zoning Permit is required for tree removal with 75' of the OWHL. A copy of the Zoning
Permit is attached.
c. The landscape plan does not coincide with survey. Please coordinate and resubmit.
Structural Plans. Only one set of structural plans submitted. Please submit another full set of structural plans.

5. Minnehaha Creek Watershed District (MCWD). An Erosion Control Permit Number 16-439 was issued on

I've reviewed the subject grading plan and offer the following comments:

This wall system has not been designed for ground water surcharge loads. Direct all surface drainage
away from the wall. Methods to do so include but are not limited to the following: drainage swale, site
grading, retention ponds, etc. Details of water control are left to the wall contractor. Please contact

TERMS AND CONDITIONS
This WALL DESIGN and ensuing recommendations is expressly made subject to the following terms and conditions
to which all persons that receive and rely thereon agree:
1. Standard of Service—Services performed by ENGINEER under this agreement shall be performed in a manner
consistent with the skill and care ordinarily used by members of the engineering profession practicing under similar
conditions at the time and in the locality the services are pertormed.
• Client recognizes that interpretations and recommendations of ENGINEER are based solely on the
information available to the company.
• ENGINEER will be responsible for those interpretations and recommendations, but shall not be responsible
for the interpretation by others of the information developed
• Services provided reflect the professional judgment of ENGINEER,to the best of ENGINEER's knowledge,
information, and belief as of the date hereof.
• No other warranty or guarantee,express or implied, is made.
2.Said design is based entirely on and expressly limited by the scope of services ENGINEER has been employed by
Client to perform and as described in WALL PROVISIONS and LIMITATIONS.
3. If the ENGINEER is hired for any construction phase services or site visits, it is understood that the Contractor, not
the ENGINEER, is responsible for the construction of the project,and that ENGINEER is not responsible for the acts
or omissions of any contractor, subcontractor or material supplier;for safety precautions, programs or enforcement;
or for construction means, methods,techniques, sequences and procedures employed by the Contractor.
4. OWNERSHIP OF DOCUMENTS:All reports, field data,field notes, calculations, estimates and other documents
('reports')prepared by Engineer,as instruments of service, shall remain the property of Engineer. Client agrees that
all reports furnished to Client or his agents,which are not paid for,will be returned upon demand and will not be used
by Client for any purpose whatever. Engineer will retain all pertinent records relating to the services perFormed for a
period of five years following submission of the report,during which period the records will be made available to
Client at all reasonable times.
5.TERMINATION: This agreement may be terminated by either party by written notice. In the event of termination,
ENGINEER shall be paid for services performed and expenses incurred up to the termination notice date. Neither
Client not ENGINEER may delegate, assign,sublet or transfer his/her duties or interest in this Agreement without the
written consent of the other party.
6. To the fullest extent permitted by law, Client and ENGINEER(1)waive against each other, and the other's
employees, officers, directors, agents, insurers, partners, and consultants, any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of, resulting from, or in any way related to this wall
design and written report, (2)agree that ENGINEER's total liability to Client shall be limited to the total amount of
compensation received by ENGINEER and(3)if an action is brought against the ENGINEER and the ENGINEER
prevails, ENGINEER shall be entitled to recover costs and expenses, including reasonable attorneys'fees and costs.

This permit is not transferable without District approval, and valid to fhe date of expiration. No
activity is authorized beyond the expiration date. If the permi ee requires more time to complete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for compliance with all District Rules and for the action of their
representatives, contractors, and employees.
Conditions: Project to be completed as described in plans submitted to the
MCWD office on August 9, 2016 according to the provisions of this permit.
• Properly install and maintain all erosion control measures as needed, until

Inspection/Ana vs�s Monitorin� Fees
A site inspection and monitoring by District staff will be performed where the activity involves:
• a commercial/industrial/multi-family residential development
• a single family residential development greater than 5 acres or of any size if within the
Minnehaha Creek subwa#ershed
• any alteration of a floodplain or wetland
• dredging within the beds, banks or shores of any protected water or wetland
• a violation
� any project which in the judgment of the District staff should be inspected due to project
location, scope, or construction techniques
In these cases, the applicant shall pay to the District a fee equal to the actual costs of field
inspection of the work, including investigation of the area affected by the work, analysis of the
work, and any subsequent monitoring of the work, which in the case of a violation shall be at
least$35.

Recitals
1. A building permit application has been filed a

2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, en4ineerina, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application.The escrow will also guarantee reimbursement
to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with
the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security
may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any
damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal
consultant review) associated with building permit # 7__C� ! `7 -�„��JS if compliance with the approved
building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to
the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse
the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow,if any,shall be returned to the Owners
when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement
two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner.may also request the release of the funds, and such funds shall
be released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.

representatives, contractors, and employees.

• any project which in the judgment of the District staff should be inspected due to project ;
