Dear Mr. Radunz::
When we last spoke about the drainage problem, you indicated that you would not do anything.
on your property until Mrs. Mattson did something on her side. When the properties were
inspected by City Engineer Shawn Gustafson and myself, there was still snow on the ground and
some things were unclear. A downspout that was mentioned on Mrs. Mattson's property does
go into a drain that was covered with snow when we were on site. The letter also mentioned
grading problems on Mrs. Mattson's side, one area being the driveway and the other her side
yard between your two houses. While these areas could use some regrading, Mrs. Mattson is
able to deal with the water she has on her property. The problem is the water from your garage
roof, driveway and rock areas. Again if this could be redirected in a swale down toward the
lake, the problem would be solved. Mrs. Mattson has also cut back her downspouts to help
relieve the problem down hill from her.
What would you expect to see done on her side before you would work on your side? If you
like we could arrange another meeting on site with the City Engineer.

Dear Dear Mr. Radunz::
This letter is to confirm our conversation regarding drainage on your property at 1066 Loma '
Linda Avenue. You agreed to create a swale along the property line 5 to 6 inches deep. The
swale will then be covered with crushed rock. A plastic lawn edging will be placed against the
retauung wall and backfilled against. The timber at the gate will be notched or in some fashion
revised to allow the passage of water. The swale and the plastic edging will extend from the
garage to the sandbox where it will be routed away from the property line to the house side of
the sandbox where the water will sheet flow onto the lakeshore yard.
You have ab eed to do the work this fall before the ground freezes. If you have any problems
with this agreement as I have described it, please contact me. If I do not hear from you, I will
assume it is acceptable. If this work is completed as described, the City will feel you have done ,
everything possible to solve the problem.

Dear Mrs. Mattson and Mr. Radunz:
Enclosed is a letter from the City of Orono's consulting engineer, Shawn D. Gustafson. From
the letter, you can see both of your properties are in need of grading to prevent water problems.
Mr. Radunz, I understand your frustration with this matter, but with minor grading and other
minor work, the problem could be solved on your side. The problem is that you cannot always
depend on your drain to work. Sometimes it freezes and sometimes it plugs up with leaves and
debris and since you do not live there full time, you are not able to maintain it. A small swale
from your garage to the front of your house would take overflow drainage and drainage that
occurs past your drain. The engineer's proposal to add a landscape edging along the retaining
wall would also be a good idea to keep any drainage from going through the wall and washing
your rocks on to the neighbor's property. If this work was completed, the City would feel that
you've done everything possible to help solve the problem.
Mrs. Mattson, as you can see from the engineer's letter, you have some problems on your
property also. Your driveway has over the years become too high to allow water from behind
the garage to drain out and then it appears on your garage floor instead. Also I could show you
with a level that your lot and sidewalk slope toward the house on the north side. So, not only
drainage from uphill but drainage from your property runs in your foundation. You also have
a downspout in the northeast corner of your house that dumps on the sidewalk that slopes toward
your house. Mrs. Mattson, as you can see from the engineer's letter, the property downhill
from you is also a concern. At the least, you should cut back your downspouts to just cross the
sidewalk and let the drainage soak into more yard before it reaches the neighbor. The neighbor
spoke to me and conf'irmed that it was a problem.

As I've indicated to both of you in the past, the City has no authority to require either of you
to perform the necessary work. I do hope, however, you both could solve this problem and get
on with the rest of your lives. It is no fun banging our heads over and over about this problem.
If, however, you cannot work out the problems, then I suggest a civil action in Court between
the two of you or you may wish to be involved in mediation offered by the county. If you have

Dear Lyle,
We inspected the property along the east side of Loma Linda Avenue on Thursday, March
10, 1994. Tlie wet basement and garage floor reported at 1074 Locna Linda Lane (Lot 7),
are most likely a direct result of poor drainage on the property. This situation would be
improved if this property owner regraded the north side of the lot and the driveway. A
small swale could be constructed in both locations to direct the surface runoff away from
the house and garage. This grading would require up to a foot of excavation with
restoration of the sod and driveway rock.
The property located 'unmediately north of Lot 7 would also benefit from the same type of
grading improvements. A swale constructed along the south side of this lot would improve
and control the drainage on the lot. Also, some type of landscape edging could be installed
along the south property line to prevent runoff from reaching Lot 7.
The situation on the lot located immediately south of Lot 7 appears to be a greater concern.
The downspouts and site drainage from Lot 7 run directly onto this property, which also has
poor drainage. �

Deaz Mr. Radunz,
City ordinances require that stormwater run-off be managed to limit impacts on
neighboring properties, and prohibit grading within five feet of the property line. Due to
ongoing complaints related to drainage and grading,the city is requesting that you
address the following issues as they relate to the neighboring property.
-excess dirt between the garages which is causing drainage problems as well as
deterioration of the siding on the neighboring garage
-rotted timbers at the lot line
-drainage running to the neighboring property
-a failed drain pipe
-landscape rocks washing on to the neighboring property
These issues all have simple, easy solutions. Your prompt attention to these issues is
requested.
