Please find attached the documents for request for removal of damaged and undesirable lakefront trees at 1220
Bracketts Point in Orono.
The first attachment contains letter from the Landscape Architect as well as arborist discussing which trees are to be
removed and why. The second document displays the mitigation plan and where the two trees slated for removal are
located on site as well as were the proposed replacement trees are to be planted

Per our conversation, please provide additional information pertaining to the two trees within 75' of the OHWL that you
are proposing to remove. According to Citv Code Section 78-1285, no live tree within 75' of the shoreline can be
removed without a permit. Before we can issue the permit, please provide a narrative with the reason(s)for their
removal, a statement from an arborist to the health of the trees as well as a proposed landscape plan so we can
continue the review the application. The proposed landscape plan should include the type and size of replacement
trees.
As mentioned, I will be out of the office from 2-1-17 to 2-20-17. If you will be replying to my email during my absence,

Re; Request for Damaged Lakefront Tree Removal
Ms.Christine Mattson,
After several discussions with our consulting arborist,we are concerned with the future integrity of both the
White Oak tree and the Ash tree in the lakefront area of the property. Because both trees are in close proximity
to the home,we believe it is best to remove both trees due to the high risk of potential property damage.
The White Oak has notable decay in the upper canopy from previous storm damage and pruning activity. Due to
the tree's northern lakefront location,our concern is that tree will likely suffer future damage from high storm
winds.
The Ash tree is currently under threat from the Emerald Ash Borer(EAB).The tree is not healthy enough to
withstand an EAB attack. Our consulting arborist recommended that we remove this tree before its health
seriously degrades and it becomes a future hazard.
It is ideal to take action now while the site is currently under construction. In fact,the construction process itself
has resulted in significant root compaction to various trees on site including but not limited to the oak and the
ash trees. Many trees have likely been negatively impacted due to the use of heavy equipment on site. Root
compaction is very detrimental to the health of trees and often can resuit in decline and ultimately failure in tree
health.Our consulting arborist recommends that we remove and replace these trees while the site is still
accessible to the necessary equipment. If we proactively remove the unhealthy trees during the construction
phase, it will ensure that the replacement trees will not be impacted by further root zone compaction at a later
date due to retroactive tree removal. It also allow us the opportunity to machine move larger trees to this area
via spading while we have access.
We propose to replace the old lakefront trees with two new, healthy, native maple trees.The attached plan
illustrates our proposed locations for these new trees.We have sited the new trees in the same lakeside setback
area as the proposed trees slated for removal.

After visiting the site this fall it appeared that the construction process that has taken place at
1220 Brackets Point Rd has resulted in significant root compaction to various trees including but not
limited to the large oak behind the house. Many trees have likely been impacted to varying degree due
to the various equipment access and excavation. Root compaction is very detrimental to the health of
trees and often can result in decline and ultimately failure in tree health. In some cases it should be
considered to remove and replace certain backyard trees while the site is still accessible for
equipment. Removing impacted trees proactively while the site is still under construction,will ensure
that replacement trees will not then be impacted by further rootzone compaction at a later date due to
tree removal.

(a) No live tree within 75 feet of the shoreline or within the bluff impact zone with a diameter of six inches
or more (or 19 inches in circumference or greater) measured three feet above the ground may be
removed without first obtaining a permit from the city staff, provided that at least the equivalent
number of replacement trees of a size and nature found acceptable to the staff are planted at the same
setback from the shoreline as those removed. Removal of trees that are dead shall not require a
permit, but such trees must be inspected by city staff prior to their removal.
(b) Intensive vegetation clearing within 75 feet of the shoreline, on steep slopes or within the bluff impact
zone within the Shoreland Overlay District is prohibited. Limited clearing of shrubs and trees less than
six inches in diameter and cutting, pruning and trimming of trees of any size is allowed to provide a
view to the water from the principal dwelling site and to accommodate the placement of permitted
stairways and landings, picnic areas, access paths, beach and watercraft access areas, and permitted
lockboxes, provided that the screening of structures, vehicles or other facilities as viewed from the
water, assuming summer, leaf-on conditions, is not substantially reduced.
