Public Works Coordinator Gerhardson, Zoning Adminis- trator Mabusth , Assistant Zoning Administrator �affron, City Attorney Radio and City Clerk Hallin. City Recorder Sutton was not present. Also in Attendance w� � e Planning Commission members : ��oetten, S ime, Ca 1 1 ahan and Ke 1 1 ey. COA�SENT AGENDA* Councilmember T. Adams asked that item 3 be removed from the Consent Agenda* . Councilmember T. Adams moved, Councilmember Frahm seconded, to approve the Consent Agenda*, subject to removing item 3 , with all staff reports concerning these items to be attached to an original copy of these minutes on file in the City Clerk's Office. Motion, Ayes (5) , Nays ((d) . COMMISSION APPOINTMENTS AND INTERVIEWS Mayor Butler stated that there are two openings on the Planning Commission. Diann Goetten current member of the Planning Commission is requesting reappointment. The following people have indicated a desir� to be appointed to t'ne Planning Commission: Paul Taylor, Bill Wear , Denny Pederson and Robert Kost. Philip Bradley and Mariann Kienzler have indicated a desire to serve on the Park Commission. Mayor Butler moved, Councilmem'per Frahm seconded to reapooint Diann Goetten to a 3 year term on the Planning Commission. Motion, Ayes (3) , Nays (2) , L. Adams and Grabek nay. Mayor Butler asked each candidate to introduce themself to the Council and audience. Paul Taylor, stated he has lived in the Farview� Addition for 7 years. The family has been active in Orono School activities. He is currently a member of the Orono Park Commission. Believes it is important for public minded citizens to make their time and talants when the opportunity presents itself. WilliamWear , stated that he is a 5g year resident of Orono. A business man from the north end of Orono. I am for the development for the north end of Orono. I feel that that I could do a good job on the Planning Commission for the City. At that time I was 2xposed to the City's Zoning Ordinance and Comprehensive Land Use Plan. I am a landscape architect and have been before 2lanning Commissions and Councils. Would like to offer my services to the City in helping the City maintain its quality of life. Councilmember T. Adams asked Kost if he would be interested in a position on the Park Commission. Mr. Kost said he would be interested . Mayor Butler asked that the two persons interested in the Park Commission say a few words. Philip Bradley stated, I have worked with park activities since the late 6�'s. I am a member of the Scott Hennepin Park Reserve District whicn is a joint powers agreement between Hennepin and Scott Counties. I am an appointee of the Hennepin County Park Reserve District serving on t'ne Board with Scott County. Mariann Kienzler stated, I have lived in the Orono area for about thre� years. I work for the University Minnesota in the Forestry Department where I do forestry research. I would also be cvilling to volunte2r for oth`r commissions. Mayor Butler stated that the Planning Commission must be composed of two members that reside in the rural service area as described in the Comprehensive Community Plan, two members shall reside in the urban service area of the City, and three mem'pers shall be appointed to respresent the City at large. The one vacant seat should be from for rural service area. Councilmember T. Adams moved, Councilember L. Adams seconded to appoint Paul Taylor to the unexpired term of Lynn Adams �ahose term expires December 31 , 1985. Motion, Ayes (4) , Nays ( 1 ) . Grabek nay. An ordinance was passed by the LMCD to allow 'r_ne Sheriff to fence channels where there is open water. So far this year 31 people have gone through the ice, 24 snowmobiles and 11 vehicles. The LM�D has passed an ordinance ruling out boats over 7P1 feeL in length on Lake Minnetonka. The LMCD has contraced to spend $ 13�0 to have a nrogram made up �nc� printed of all the violations on the lake, where they occurred and the kind of violation. Adams moved, Councilmember Frahm seconded to approve Resolucion # 1271 , A Resolution Granting A Variance. Assistant 7,oning Administrator Gaffr_ on stated this property would require a variance or at least some additional review because of the proposed 'nardcover and Mr. Krutzig would like to present some alternatives to hardcover. We have a report from his engineer, Mr. Mark Gronberg , that discusses slat spacing oL decks and underlying :naterial . I have asked the City r��ngineer i,lenn Cook to review this material . �ook stated the pr000sal to place a sand bed under tne dec'r, to a'psor'p the runoff is a good idea if you look a� it irom a hydraulic point of view. From the City' s point of view we hav�� a policing �roblem, we have no way of knowing at some point in time of changes ti�at could b� made 'oy future owners oE the property. rrahm stated he would not be in favor of pol icing deci�s, i,. Adams stai.ed we should leave the ordinances the way t'ney are, discouraging decks beyond the allowed hardcover and not allowing decks within the �1-75 foot setback. �+1'nen a special situaLion co�nes along where t'ne a���� l_ icant izas nresented a good plan for runoff absorption and where the applicant has a hardship on the lot we would allow some additional decking or some additional treated hardcover on a variance iJdS1S. ?oning Administrator Mabustn suggested listing this in the resolution limiting the deck to the size or area you would allow for that decking since the resolution is filed in the chain of title. Assistant Zoning Administrator Gaffron stated the property would be allowed a minimal garage apron and a 10 or 12 foot driveway getting out to the access road. Krutzig is prouosing a new product , it is a rock aggregate witlz an epoxy material that will hold tl�e�n together. Gaffron showed sam� tes of this nroduct to the Council . This product has not been used without a solid base in a winter climate and the recommen:9ai.ion is to use i� on a base of asphalt or concrete. Grabek stated this is new construction and the applicant should live with the hardships. Counei lmember L. We believe it to be a tree trimming business although it is very difficult to prove. Molin noted t�zat he doesn't like the 3 dump trucks that are parked there. Jim Campion, 160 Cygnet Place, explained that it's not on ly the mess and the trucks are of fens i ve, but also on Sunday mornings they cut wood and run motorcycles without mufflers that disturb the neighborhood. Clint Miller , 190 Cygnet Place, stated there are 4 houses for sal� on this street and 3 of these have been on the market for over a year , ar�d I think the Rossing's property has orobably had an effect on our �r.o�eriy values. He hasn't lived there for 3 or 4 rnonths. He has been contacted and 'ne is coming to remove al 1 the wood that he hauled in, and that will take care of probably over half of the wood. Councilmember Grabek moved, Councilmember L. Adams seconded that all the violations on this �r_operty be cleared up by Arpil 1 , 1985, or upon that date if it is not removed that we instruct the City Attorney to take either criminal or civil or both actions against the property owner to have that area cleaned up. The Zoning Ad�ni��istr_ator shoul3 take into account the co�n�laints and com�nents �; i=h�� neighbors, but t�Ze final discrezion nust� r_est with the Zoning Admii�istr.�tor . Mayor Butler stated tne Council agrees with this interpretation of the ordinance.
