The Orono Council met on the above date with the following members present: Mayor Buter, Council- members Frahm, Adams and Hammerel. Councilmember Grabek arrived at 7 :14 p.m. City Administrator Benson was absent. Zoning Administrator Mabusth, City Attorney Malkerson, City Engineer Cook, Public Works Coordinator Gerhardson, and City Recorder Sutton represented the City staff . CONSENT AGENDA* Mayo� Butler moved, Councilmember Adams seconded, to approve the Consent Agenda* subject to removing items 12 agd 13 from the Consent Agenda* for discussion with all staff reports concerning these items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk' s office. Motion, Ayes (4 ) , Nays (0 ) . APPROVAL OF MINUTES* Mayor Butler moved, Councilmember Adams seconded, to apprflve the Council minutes of July 9 , 1984 . Motion, Ayes (4 ) , Nays ( 0 ) . LARE MINNETONRA CONSERVATION DISTRICT REPORT Jo Ellen Hurr was not present. A memo concerning a boat tour was passed out to the Council for their information. PLANNING COMMISSION COMMENTS Pla�ning Commission Representative Sime had no comrnents. PUBLIC COMMENTS There were no public comments #712 JAMES HARTZELL 2987 CASCO POINT ROAD FINAL SIIBDIVISION RESOLUTION #1657 Zoning Administrator Mabusth presented thefinal plat for the Hartzell Addition. Mabusth stated the reason for the long delay since preliminary approval was created by engineer questions dealing with lot right of �ay. Councilmember Adams moved, Councilmember Hammerel seconded, to approve Resolution #1657 , A Resolution Approving The Plat of Hartzell Addition. Motion, Ayes (5 ) , Nays (0 ) . #844 DAVID WILLITS 1900 WEST FARM ROAD VARIANCE Councilmember Adams noted for the record that he was vacating his Council seat because of a conflict of interest. MINUTES OF THE REGULAR COUNCIL MEETING HELD JULY 23, 1984 . PAGE 2 #844 DAVID WILLITS Zoning Administrator Mabusth noted that a public hearing would be called at the next Council Meeting. Mabusth noted that this was a procedural variance and the hardships noted severe slopes to the north and east on property and limitations placed on building enveiope by septic areas claiming major flat areas of site. Councilmember Frahm moved, Councilmember Grabek � seconded, to conceptually approve the variance application subject to the calling of a public hearing at the August 13 , 1984 Council meeting and directs staff to draft a resolution of approval . Motion, Ayes { 4 ) , l�ays (0 ) Abstention (1 ) . Councilmember Adams - abstained. 7:30 APPEARANCE - ASSESSING ISSUE Don NSonk, Hennepin County Assessing, was present. Mayor Butler stated that it was her understanding that the t�ree ex-mayors of the City of Orono would not be in atter�dance because a formal invitation was not extended from the Council. Butler stated that she woulc� gladly extend an invitation to them if the Council felt that it was necessary. Planning Commission Representative Bill Sime stated that the mayors told him they would attend if the Councilextended theinvitation. Sime stated that at 7 : 30 John Burger would be present to discuss this issue. Councilmember Hammerel suggested that the Council appoint the three ex-mayors to a committee to study this assessing issue. Councilmember Frahm stated that someone has to show him that the City will save money by hiring its own assessor. Frahm stated that the mill rate can be raised which would raise taxes and hiring an assessor might defeat the purpose. Bill Sime stated that there are seven adjacent communities that are getting their assessing done cheaper than Hennepin County can do. Sime stated that Excelsior has just hired their own assessor at a cost of $9_41/tax parcel and they don ' t furnish any room in . their city hall nor do they furnish the assessor a car or staff. Sime stated that this is done independently. Sime stated that Council should have all the facts before making a decision. Sime stated that Robert Locky from St. Louis Park could came to the Council and give information about hiring an assessor. Discussion was continued after John Burger arrived at 7 :30 p.m. M�NUTES OF THE REGULAR COUNCIL MEETING HELD JULY 23, 1984 . PAGE 3 John Burger suggested that the Council extend the invitation to the three ex-mayors for open discussion about the hiring Orono' s own assessor. Councilmember Grabek stated that this is an important decision that will be made by the Council and that the Orono residents should have every opportunity to be heard. Mayor Butler stated that even if Orono gets their own assessor that the state legislature holds the key as far as how much a City can lower its taxes . Butler stated that Hennepin County still has their own formula and they can step in at any time and redo the assessing if it doesn ' t meet Hennepin County' s regulations. Butler stated that someone has to convince her how having Orono' s own assessor is going to change anything. Councilmember Adams stated that historical sales ratio should be provided for the Council for this special meeting. Adams asked Don Monk if the City could have a one-year contract instead of the four- year contract. Don Monk stated that one-year contracts are terrible to manage. Monk stated that from a budget standpoint that it is hard to do long-range planning with too many one-yearcontracts . Monkstated that bylaw that one- fourth of all properties should be assessed annually. Bill Sime stated that according to Budd Robb that Hennepin County has several one-year contracts . Sime stated that Shorewood has a one-year contract. Councilmember Grabek moved, Mayor Butler seconded, to have the City Administrator write a letter to extend a formal invitation to the three ex-mayors to give their past experiences in this assessing issue, Hennepin � County Assessor, Don Monk, John Burger, and anyone else that can give as much information on the assessing subject, with such special meeting for the sole purpose of discussing the assessing issue to be held on August 22 , 1984 , at 7 : 30 p.m. at which meeting a decision will be made whether or not to renew the Hennepin County contract or not. City Administrator to try and get the Art Center Auditorium or the Orono School Auditorium for such meeting. City Adminis- trator to notify the press of such a meeting to allow the public to be heard. Hennepin County to provide historical sales ratio studies for that special meeting. Bill Sime to invite Mr. Locky, St. Louis Park Assessor, to the meeting also. Motion, Ayes (5 ) , Nays (0 ) . MINUTES OF THE REGUL�R COUNCIL HEETING HELD JULY 23, 1984 . PAGE 4 Don Monk stated that when Dick Benson asked for an extension of the contract that he only wanted 60 days. Monk stated that the assessment cycle starts right now and it is hard for Hennepin County to come in in the middle of the assessing cycle and start work. Monk � stated that he would have to hire more staff if Orono � decides to enter into the contract too late. Monk stated that the Hennepin County Board has the last say. Councilmember • Frahm stated that he needs clari- fication on the mill rate. Frahm stated that say the city hires their own assessor and gets the taxes down, but then the school board needs more money and therefore raises the mill rate. Frahm stated that the taxes would still go up even with the city' s own assessor if the schools or Hennepin County needs more money. City Attorney Malkerson stated that three issues should be addressed by staff : 1. One advantange of having Orono' s own assessor is that they know the zoning code, comprehensive plan, formal and informal policies , eliminates problems that you may or may not have with the County Assessor. 2. Own assessor is more apt to be courteous to the citizens of Orono because that person knows if he or she is not courteous and doesn ' t respond in a timely manner that person can lose his/her job. 3 . What' s the advantage to the City to hire its own assessor. Under state law, each year they do a sale ratio study and if our sales are of f the ratio by a certain percentage then the state and the county can step in and redo the assessing. 4. Sales ratio studies of surrounding communities that have their own assessor should be submitted to the Council for that special meeting. COUNCIL POLL- #840 NED DAYTON Zoning Administrator Mabusth stated that she wanted to poll the Council on the Ned Dayton PRD development. Mabusth stated that it is a 17 unit PRD. Mabusth . stated that the developer was notif ied that this would be discussed at this Council meeting. � Mayor Butler asked how riparian rights to French Lake would be divided among the residential pads. � Zoning Administrator Mabusth stated that Planning Commission never addressed riparian rights and that staff would have to address this issue. MZNUTES OF THE REGULAR COUNCIL MEETING HELD JULY 23, 1984. PAGE 5 Councilmember Grabek stated that the developer should address the drainage issue before it comes to Council. Councilmember Frahm stated that he doesn ' t really like PRD's along the lake. Zoning Administrator Mabusth stated that the developer will locate well, septic and the building envel�pe for each lot all on one plan before it comes to Council. CHASRA MARINA Marcia Schoeneman of 3332 North Shore Drive was present. Schoeneman stated that Chaska Mar'na has not camplied with the Council ' s last directive given at the last Council meeting. Schoeneman stated that the trespassing is still occurring. Schoeneman stated that they actually took down part of the fence that is up to get across her property. Schoeneman stated that if Council doesn ' t require Chaska to get a varia�ce for the fence or require the installation of the fence that she will start having people arres,ted that come across her property. Schoeneman stated that someone has painted orange rings around the schru�s and trees . City Attorney Malkerson asked if Chaska Marina had been �otified that discussion was going to take place tonig�t concerning their application. Malkerson stated if not, that Chaska should be notified to allow procedural due process . Zoning Administrator Mabusth stated that Chaska Marina was not notif ied because she was not aware that this was going to be discussed tonight. Mabusth state� that staff went out, that they noted all the plantings that the City had asked Chaska to plant. Mabusth stated that to put a huge fence in that area that it would do away with all the natural landscaping. Mabusth stated that in the B-2 zoning it clearly requires screening and that Chaska should not be required to apply f or a variance f or the f ence when the B-2 zane requires screening. Councilmember Grabek moved, Mayor Butler seconded, to notify Chaska Marine and all parties that this fence and trespassing issue will be discussed August 13 , 1984, Council meeting at which time the Council will make a decision and staff to include the landscaping requirements in the B-2 zone. Motion, Ayes (5 ) , Nays (0) . STATUS OF HOUSEBOATS ON NORTH SHORE DRIVE MARINA Mayor Butler asked for a status report on the house�oats on North Shore Drive and whether they were remov�ed. Mayor Butler asked for a status report for the August 13, 1984 , Council meeting concerning the houseboats kept at North Shore Drive Marina. LYRIC AVENUE HOUSE STATUS . Mayor Butler asked for a status report on the home on Lyric Avenue who is using residential property for a auto repair shop. Zoning Administrator Mabusth stated that it has been hard for staff to pin down the repair shop business. Mabusth noted two site inspections and staf f could not find visible signs of operation. Mayor Butler asked for a status report for the August 13, 1984 Council meeting concerning this repair shop business. ABANDONED BUILDINGS Councilmember Grabek stated that Keaveny' s abandoned building should be removed. City Attorney Malkerson stated that as long as it is not hazardous it can stand there not being used. Malkerson stated that the Council could adopt an ordinance that stated abandoned buildings may not boarded up because of the adverse aesthetic effect that that has on the neighborhood, the diminution in value that results to a neighborhood, that they must appear on the outside as if they are used. Malkerson stated that you could notify Keaveny and any other property owners that this applies to. Mayor Butler stated that there also two other cabins on County Road 51 that are boarded up. CouncilmemberGrabek moved, Mayor Butler seconded, to direct staff to research to see if there are such ordinances and to draft an ordinance that abandoned buildings may not be boarded up and left and should not appear vacant for the aesthetics and safety of the surrounding area. While drafting ordinance, staff should distinguish between rural and urban areas, and barns and accessory structures. Motion, Ayes ( 5 ) , Nays (0 ) . BEAUTIFICATION OF NAVARRE Councilmember Grabek moved, Mayor Butler seconded, to direct staff to see if there is any state or federal funding or grants available for the beautification of downtown Navarre and for staff to study tax increment financing to be brought to the August 27 , 1984 meeting. PAGE 7 City Attorney Malkerson stated that tax increment f inancing could be used for beautif ication of Navarre. Malkerson stated that staff can contact investment banksthat specialize in taxincrementfinancing with citiesto come out and discussthis. Malkersonstated that staff could probably contact some banks that would come out on a no fee basis. � Councilmember Adamsstated that theimprovementsmade to Navarre should be coordinated with Hennepin County' s improvement plans for County Road 15 . Councilmember Frahm stated that the owners of the properties in Navarre should take the initiative and the City could encourage the improvements. Frahm stated that he would not be in favor of the City funding all these projects alone. Frahm stated that staff could study a type of financing for this type of project and encourage redevelopment. Councilmember Grabek stated that a public hearing should be held for the property owners in Navarre to discuss the beautification of Navarre. SEAL COAT BID AWARD City Engineer Cook stated that the lowest bidder of the sealcoating of City streets and paving repair and sealcoating of McCulley Road was Buffalo Bituminous . Cook noted the breakdown of the bid as follows : Sealcoating City Streets $ 55 , 612 . 50 Paving Repair & Sealcoating 11 , 809 . 50 McCulley Road Total Bid $ 67 , 42?. . 00 Cook stated that because MN DOT must approve the MSA portion of the bid, he recommends awarding the bid to Buffalo Bituminous contingent upon MN DOT approval. Mayor Butler moved, Councilmember Hammerel seconded, to award the bid to Buffalo Bituminous for an amount not to exceed $67 , 422 contingent upon MN DOT approval. Motion, Ayes (5 ) , Nays (0 ) . PAYMENT #2 HANDICAP RAMP PRECINCT #3 LAREVIEW GOLF COURSE City Engineer Cook stated that this was the second . payment to Halvorson Construction. Cook stated that this project would be finished soon. Mayor Butler moved, Councilmember Adams seconded, to approve payment #2 in the amount of $3 , 271. 46 to Halvorson Construction Co. Motion, Ayes (5 ) , Nays (0 ) . METRO PARRS & OPEN SPACE COMMISSION Council noted the Metro Parks and Open Space Commission' s scheudule. INFORMl�TION MEETING WITH CRYSTAL BAY RESIDENTS ON-SITE SEWER SYSTEMS Council asked staff to change the meeting date of the Augu�t 9 , 1984 Council meeting to August 15 , 1984 so that the Councilmembers can be in attendance. ORDINANCE NO. 5, SECOND SERIES - UTILITY RATES AND CHARGES Councilmember Frahm moved, Mayor Butler seconded, to approve Ordinance No. 5 , Second Series , An Ordinance Regulations Utility Rates and Charges . Motion, Ayes (5 ) , Nays ( 0 ) . LONG LARE-ORONO WATER SERVICE AGREEMENT MayorButler moved, Councilmember Frahm seconded, to approve the Long Lake-Orono water service agreement. Motion, Ayes (5 ) , Nays ( 0 ) . ADVERTISE FOR BIDS GARAGE AT WATER PLANT Public Works Coordinator Gerhardson stated that this heated garage is need to store the sewer cleaning machine and two sewer and water vehicles . Councilmember Frahm stated that he would like to see the figures on how much it will cost to heat this buil�ing per month. Frahm stated that he would like to see how much it will cost to maintain this garage. Frah� stated that he would like to see where the funding will come from for the construction of this garage. City Attorney Malkerson stated that an architect should draw up the plans and also specs should be done before the bid. MayorButler moved, Councilmember Hammerel seconded, to direct staff to advertise for bids on August 10 , 1984 subject to specs being prepared and staff is authorized to have an an architect finalize plans if necessary with results from research of the cost of heating the garage should be presented at the time of awarding the bid. RESIGNATION - CITY CLERR - ALBERTA STROM Mayor Butler moved, Councilmember Adams seconded, to direct the City Administrator to draft a letter of appreciation for Alberta Strom' s years of service and for staff to purchase a plaque. APPOINT DEPUTY CLERR- JOANNE LATTIN* Mayor Butler moved, Councilmember Adams seconded, to . approve the appointment of Joanne Lattin as Deputy Clerk with a salary increase from $19 , 828 . 70 per year to $20,437 . 03 per year effective July 30 , 1984 . SALARY INCREASE- PAM SUTTON, RECORDER* Mayor Butler moved, Councilmember Adams seconded, to approve a salary increase for Pam Sutton, City Recorder, from $7 . 00/hr to $7 . 50/hr effective July 30 , 1984. SALARY INCREASE- LYLE OMAN, ZNSPECTOR* Mayor Butler moved, Councilmember Adams seconded, to approve a salary inc-rease for Lyle Oman, Field Inspector, from $7 . 00/hr to $7 . 25/hr effective July 30, 1984 . BIG ISLAND INSPECTION- CODE VIOLATIONS UPDATR* Mayor Butler moved, Councilmember Adams seconded, to approve Building Official Jacobs ' memo dated July 12 , 1984 , concerning Big Island Veteran ' s Camp Fire Code Violations . COMMUNITY ACTION AGENCY* Mayor Butler moved, Councilmember Adams seconded, to approve the correspondence of the Community Action Agency for Rural and Suburban Hennepin County. GOVERNMENT BUILDINGS- PAINTING BIDS* Mayor Butler moved, Councilmember Adams seconded, to approve the informal bids for painting of government buildings with bids received by Public Works Coordinator Gerhardson, and the bid going to Greenwood Painting for an amount not to exceed $7 , 691. 00 . STATUS REPORT REQUIRED ON JUNR CARS Councilmember Hammerel stated that he had received several complaints on old junk cars sitting on French Lake Road and on Casco Point Road. Hammerel asked for staff to look into the matter. STATUS REPORT REQOIRED ON TONRA TRANSMISSION Councilmember Grabek asked staff to investigate into Tonka Transmission and the number of cars that they are limited to. Grabek also stated that the il�uminated sign has been lighted on several occasions . Grabek asked for staff to look into the matter. DOCKS STATUS REPORT Mayor Butler asked for a staff report on the docks that have just recently been constructed near Pauls Landing. ADJOIIRNMENT 9 :40 P.M.
