The Orono Council met on the above date with the following members present: Mayor Butler, Council- members Adams, Frahm, Grabek and Hammerel. City Administrator Benson arrived at 7 : 30 p.m. City Attorney Radio, Public Works Coordinator Gerhardson, Zoning Administrator Mabusth, Engineer Repre- sentative Harlan Olson, Recorder Sutton, and Police Chief Kilbo represented the City staff . COMMENDATION - RESERVE OFFICER MIRE CARLSON Police Chief Kilbo and Mayor Butler commended Reserve Officer Mike Carlson for a job well done in arresting a felon. Kilbo presented a plaque and read a letter of thanks from the United States Department of Justice. CONSENT AGENDA* Mayor Butler moved, Councilmember Adams seconded, to approve the Consent Agenda* , with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk' s office. Motion, Ayes ( 5 ) , Nays ( 0 ) . MINUTES* Mayor Butler moved, Councilmember Adams seconded, to approve the minutes of the April 9 , 1984 , Council meeting. Motion, Ayes ( 5 ) , Nays ( 0 ) . LARE MINNETONRA CONSERVATION DISTRICT REPORT Jo Ellen Hurr was present. Hurr stated that the LMCD will review the Walters Port dock issue. Hurr stated that a public hearing will be held Wednesday, April 25 , 1984 , about sea planes . Hurr stated that right now they are restricted to one landing and one take off between 11-6 on Saturdays and Sundays . Hurr stated that the LMCD has tabled Chaska Marines application for another 30 days . Hurr stated that the LMCD is going to investigate changing the application fees . Hurr stated that if this was passed that it would reduce the assessments charged to the Cities by almost one-half . Mayor Butler asked Hurr why the LMCD did not respond to the City' s request asking for their support in Orono' s position on the Maple Plain Interceptor issue. Hurr stated that the LMCD took the position that they took a strong stance that every sewage treatment plant should be out of the watershed. Hurr stated that as far as she knew the LMCD was still planning on staying with that position. Hurr stated that the LMCD did deny the Sailors World application. Hurr also noted that the speed limit on the lake has been reduced to 20 mph. REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. PAGE 2 PLANNING COMMISSION COMMENTS Planning Commission Representative Sime had no comments. PUBLIC COMMENTS John Purdy of 1975 Fagerness Point Road reemphasize that the neighbors are anxious to have a solution to the problem. Purdy stated that if that line is sized to serve only what is there now with no capacity to serve Orono. Purdy stated they are not anxious to trade one kind of pollution for another and that the neighbors have documented why they do not think an interceptor sized to serve only the needs of the Maple Plain Plant will encourage any development in Orono. Purdy stated that enough restrictions can be placed on the interceptor line so that development will not occur. Purdy stated that the neighbors are anxious that any action taken by the Council may jeopardize federal funding for this project. Purdy stated that the City may not persuade the PCA and the MWCC to change its position but Orono' s objection may only serve to delay a solution to the problem. Mayor Butler stated that the City will be having a special Council meeting in May or June after the response or action from the public hearing to be held by the PCA or Met Council . Karen Bohn of 3186 North Shore Drive stated that she lives close to North Shore Drive Marina . Mrs. Bohn stated that the dockage that they have been granted extends farther out into the lake. Mrs . Bohn stated that they are putting up a big light along with gas pumps. Bohn stated that they have put up with it all along but now it is even worse. Bohn stated that the boat traffic in the summer will be terrible and encroach onto her property. Mayor Butler asked the Building and Zoning Staff to look into the problem. #754 DARYLE UPHOFF 2497 RELLY AVENUE FINAL SUBDIVISION RESOLUTION #1621 Zoning AdministratorMabusthstated that the applicant had read the resolution and had no problems with it. Mayor Butler moved, Councilmember Hammerel seconded, to approve Resolution #1621 , A Resolution Approving the Plat of Kelly Cove. PAGE 3 #804 PAINTERS CREER 4680 BAYSIDE ROAD PRELIMINARY SUBDIVISION AND CONDITIONAL USE PERMIT FOR PRD Bruce Lange and Ron Bastyr represented the Painters Creek Development Corporation. The following _ members from the public were present for this application: Bonnie Cuff of 4660 Bayside Road; Mr. and Mrs . Peter Achey of 4720 Bayside Road; Marc Fritzler and Desyl Peterson of 4385 Chippewa Lane; Lucy Yogerst and David Dunn of 4740 Bayside Road. Zoning Administrator Mabusth reviewed with the Council that these lots are actually building pads or ways to convey ownership of a rural lot. Mabusth stated that the 5 acre per unit density is assured with the credit of Outlots A and B. Mabusth stated that Outlot Cissetasideforfuture development. Mabusth stated that the applicant is asking that the City credit the area of McCulley Road sold to the City at the time the road was planned. In the absence of survey information, the owners were not aware that in selling the one acre to the City, they would be giving up one residential unit. Mabusth stated that the developer is dedicating land to the Dunn property to make a legal subdivision. Mayor Butler read the section of the code dealing with the purpose of a PRD: "The plan is available to land subdividers subject to Council approval as an alternative to the standard minimum lot size subdivision of land. The purpose of this plan is to enhance the appearance of neighborhoods through preservation of natural open spaces, to counteract the effects of urban congestion and monotony, to provide cohesive structure to neighborhood design, to offer recreation opportunities close to home, and to aid in improving the welfare in general of City residents. " Mayor Butler stated that PRD' s apply to the land in question and not the intent of the developer. Butler stated that PRD' s are used to preserve natural amenities such as trees and slopes . Butler stated that this property definitely has steep slopes and trees. Butler stated that this is an appropriate use for a PRD. Ron Bastyr stated that Painters Creek Development Corporation is dedicating land to the Dunn property. Bastyr stated that is the reason they are asking for credit from McCulley Road so that they can have three buildable lots on Outlot C at some future point. Bastyr stated that Outlot C was 14 . 7 acres and with the dedication to the Dunn property it will be 14 . 4 acres. Bastyr stated that the developer would rather see the City address the issue of Outlot C now. REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. PAGE 4 #804 PAINTERS CREEK Zoning Administrator Mabusth stated that staff could not recommend that the City credit their land from the County Road but only consider the McCulley Road. Mabusth stated that crediting land from a County road would set a negative precedent. Councilmember Adams suggested granting a variance to the one lot rather than giving credit from McCulley Road. Adams stated that both could set a precedent. Ron Bastyr stated the total density would be 4 . 98 acres per unit. Bastyr stated that additional landscaping would be added. Councilmember Frahm stated that since the Cityforced him to great extents to meet the 5 acre requirement, why should they make an exception now. Frahm stated that they should have to meet the requirement for Outlot C too. Desyl Peterson of 4380 Chippewa Lane stated that she was in opposition to the Council crediting the McCulley Road to this land. Peterson stated that she felt that this would establish a negative precedent. Peterson stated that the developer purcr.ased the property fully aware of its limitations and purchased the property after McCulley Road was established. Peterson stated that the crediting of McCulley Road was just another way to get another buildable lot which is an economic advantage to the developer. Peter Achey of 4720 Bayside Road asked if the same setback requirements would have to be met as the 5 acre zoning district requirements. Zoning Administrator Mabusth stated that with a PRD it varies . Mabusth stated that with the clustering of the houses you have different setbacks . Peter Achey of 4720 Bayside Road asked if the current substandard lots in the area would be forced to adhere to the 5 acre zoning district setbacks or do they get the same consideration as these developers. Zoning Administrator Mabusth stated that unless you are invalved with a PRD, then you would be subject to the 5 acre zoning district. Mabusth stated that Mr. Achey owns a conventional lot that is just over one acre and is expected to adhere to the 5 acre setbacks. Peter Achey of 4720 Bayside Road stated that the developer is asking for a great economic benefit by asking the City to credit some of McCulley Road. Councilmember Grabek asked why the developerisgiving land to the Dunn property. REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. PAGE 5 #804 PAINTERS CREER Zoning Administrator Mabusth stated that the Dunn property was actually subdivided illegally and that they did not have the required 5 acres in area. Mabusth stated that the Dunn property will now have additional land to allow area for an alternate septic system. Councilmember Frahm noted that the developer would have still been short even if they had not given additional land to the Dunn property. rrahm noted that by granting that credit the City would be setting a negative precedent. Mayor Butler asked City Administrator Benson if the City needs that 100 ' for McCulley Road. City Administrator Bensonstated that McCulley Road is a Minnesota State Aid (MSA) road and had to f ol low the 100 ' requirement. Councilmember Adams moved, Councilmember Hammerel seconded, to approve the conditional use permit for a PRD and preliminary subdivisionfinding all standards of the PRD and RR-lA code have been satisfied and that all residential units have adequate areas for primary and alternate septic drainfield sites, all subject to the following conditions : l . Create additional outlot to be set aside for use of Dunns at 4740 Bayside. 2 . Dedication of 33 ' right of way for County Road 84 . 3 . Residential pads to be designated as lots on final plat with language to show density credit of Outlot A and adjusted Outlot B. 4 . Outlot B to be ad justed in area must be exclusive of McCulley Road right of way per Council directive. 5. Open space easement over Outlots A and B to assure density credit for this PRD. 6 . Underlying road and utility easements to the City over road outlot. Road must be designated as outlot. 7 . Conservation and flowage easement over wetlands area, overland drainage courses and storm sewer if applicable. 8. Lot 10 will require a separate access permit from Hennepin County. 9 . �pplicant to provide copy of restrictive covenants that will deal with the use and share in costs for upkeep and maintenance of the open space area, road outlot, etc. REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. Motion, Ayes (5 ) , Nays ( 0 ) . �804 PAINTERS CREER REQUEST FOR BUILDING PERMIT PRIOR TO FINAL PLAT APPROVAL RESOLUTION #1622 Councilmember Frahm moved, Councilmember Grabek seconded, to approve Resolution #1622 , A Resolution Approving the Request of Painters Creek Development Corporation to Apply for a Building Permit Prior to Final Subdivision Approval. Motion, Ayes ( 5 ) , Nays (0 ) . #817 STEVEN RASTER 2675 FOX STREET CONDITIONAL USE PERMIT Don Hess represented Steven Kaster. Zoning Administrator Mabusth stated that the City Engineer has asked to look at the application again. Mabusth stated that she met with Dr. Hanson, Freshwater Biological Institute, and he stated that dredging in wetlands is not harmful. Mabusth stated that Dr. Hanson states that the main thing to worry about is the spoils that is removed from the wetlands. Councilmember Adams stated that the City should look at their wetlands ordinance and improve it and set up guidelines for dredging of wetlands . Don Hess stated that he could not find any guidelines f rom the City f or them to f ol low. Zoning Administrator Mabusth stated that 1600-1800 cubic yards of spoils would be removed and that those spoils should be placed at least 50 ' away from the area. Don Hess stated that his client was not in a hurry. Councilmember Hammerel moved, Mayor Butler seconded, to table the Kaster conditional use permit pending review by the City Engineer, City Staff , and staff to set up guidelines and performance standards for other applications of this type. Lonie Fiskstated that he hadn' t received any of the papers promised at the last meeting. � Councilmember Frahm moved, Councilmember Grabek seconded, to table the Fisk variance application until May 14 , 1984 Council meeting to allow applicant to review the neighbors submittals. Motion, Ayes ( 5 ) , Nays (0 ) . Zoning Administrator Mabusth noted the following items given to the applicant at this meeting: Zoning Administrator Mabusth memo dated April 18 , 1984 . Exhibit A - Survey of undeveloped lots Exhibit B - Sketch of setbacks Exhibit C - Resolution #1354 Exhibit D - Purchase Agreement Exhibit E - Work Sheets Exhibit F - Neighbor ' s Position Paper Exhibit G - Acknowledgement Sheet City Attorney Radio stated that any other information should be sent certified mail to both Lonie Fisk (applicant ) and Curtis Fisk (owner ) . #822 HOWARD JOHNSON 1635 CONCORDIA STREET SRETCH PLAN REVIEW - CONCEPTUAL DIRECTION TO APPLICANT FOR PRD Howard Johnson was present. Helen Trainer of 1675 Concordia Street, Donna Belowski of 1695 Concordia, Dick Catton of 2870 Pheasant Circle, Paul Bozonik of 1795 Concordia, and Roger Dahlin of 1685 Concordia Street were present. Zoning Administrator Mabusth stated that she had brought this application to the Council for conceptual direction to the applicant for proposed 9 unit PRD. Mabusth stated that the applicant has responded to the excessive hardcover created by the attached 9 units within the 75 ' -250 ' setback area by creating two retention ponds. Mabusth stated that with this PRD the applicant is forced to ask for a hardcover variance of 28$. Mayor Butler read the PRD regulations of the City: "the purpose of the Planned ResidentialDevelopment is to enhance the appearance of neighborhoods through preservation of natural open spaces , to counteract the effects of urban congestion and monotony, to provide cohesive structure to neighborhood design, to offer recreation opportunities close to home, and to aid and improving the welfare in general of City residents . PAGE 8 #822 HOWARD JOHNSON Councilmember Hammerel read the LR-1C zoning district requirements : "One Family Lakeshore Residential District is intended to provide a district which will allow a combination of inedium density residential development and limited agricultural activities . Planned Residential Developments may be allowed by _ conditional use permits . Proposed land use may not endanger the quality of storm water runoff into Lake Minnetonka. Because of the location of the district near Lake Minnetonka, special regulations are necessary to protect the natural resource in the effect of intense development. The district shall have immediate access to highways and to public sanitary sewers . " Howard Johnson stated that he felt he met all those requirements . Johnson stated that he proposes 9 attached units with single garages. Johnson stated that by attaching the units he is using less hardcover. Johnson stated that he has designed retention ponds to handle the excess runoff. Johnson stated that he would give the City some land. Johnson stated that he is 20 ' from one side lot line and 25 ' from the other. Johnson stated that he exceeds the side setbacks . Councilmember Grabek stated that he would not approve the PRD concept with thisproperty. Grabek asked what the applicant was planning if the people who lived there had more than one car. Councilmember Frahm stated that this property would only be allowed 2 riparian lots. Frahm asked how the applicant would divide the 2 riparian lots up between 9 units. Frahm stated that he didn' t feel that the PRD concept was an appropriate use for this property. Howard Johnson stated that he was thinking of having another 10 car garage for extra storage of cars or boats. Councilmember Grabek stated that he didn' t feel that this PRD enhanced the neighborhood. Grabek stated that it looked like a small motel 75 ' from the lake. Grabek stated that this does not have the proper access from a public road and that he would not approve a PRD for this property. Councilmember Adams stated that the intent of a PRD is to cluster the houses away from the sensitive area. Adams stated that the applicant has clustered the houses in the most sensitive area of this property next to the lake. PAGE 9 #822 HOWARD JOHNSON MayorButler stated that the housesshould be awayfrom the lake. Butler stated that this development may meet the numerical requirements but that it doesn' t meet the intent of the PRD. Howard Johnson stated that he could get more houses - without the PRD anyway. Councilmember Hammereldid notfeelthat thisproperty was appropriate for a PRD development. Helen Trainer of 1675 Concordia Street stated that Mr. Johnson is talking about a duck pond wouldn ' t he have to dredge. Trainer stated that she has a drainage problem right now and that this increased development will affect her drainage problem. Trainer stated that Johnson ' s drainage runs onto her property. Mayor Butler asked staff to see if this property was in theflood plain. Butler assured Ms. Trainer that the Council would not approve anything that would cause her a drainage problem. Butler stated that she might feel different about the PRD if the building looked like the surrounding neighborhood. John Ehlert of 1785 Concordia Street stated that the traffic would affect him. Ehlert stated that PRD' s require that access be provided by a highway. Councilmember Adams asked if the Council was able to approve 9 units if the existing road could not handle the increased traffic. Adams asked if the applicant would be assessed for any improvements made to the existing road. Tom Sachs of 1705 Concordia Street asked if the neighbors would get assessed for any road improvements . Zoning Administrator Mabusth stated that usually if the developer creates the burden he must share in the major portion of the assessment for improvements of the road. #823 NORTH SHO.RE DRIVE MARINA 3222 NORTH SHORE DRIVE VARIANCE RESOLUTION #1623 Larry Hork was present. Zoninc} Administrator Mabusth stated that she has been advised by City Attorney Malkerson that the City cannot approve a variance until the rezoning has been finalized. Mabusth stated that the Planning Commission wanted hardcover removed if they were to increase hardcover within the 75 ' -250 ' setback area. MINOTES OF THE ORONO COUNCIL MEETING HELD APRIL 23, 1984. PAGE 10 #823 NORTH SHORE DRIVE MARINA Larry Hork stated that it would cost him $17 , 000 if the City does not approve this now. Hork stated that he has complied with all the City' s regulations and that he has been continually delayed. Mayor Butler moved, Councilmember Frahm seconded, to direct staff to draft the rezoning agreement within 48 hours so that the building permit can be issued. Motion, Ayes (5 ) , Nays ( 0 ) . Councilmember Grabek moved, Councilmember Frahm seconded, to approve Resolution #1623 subject to #1 being deleted and adding that the applicant put in screening. Motion, Ayes (5 ) , Nays ( 0 ) . #829 DEAN LINDBLOOM 2630 FOX STREET REQUEST TO BUILD DOCK Dean Lindbloom was present. Zoning Administrator Mabusth stated that the applicant lives on Fox Street but is requesting to build a dock on Tracts T and S on Lake Minnetonka. Mabusth stated that Lindbloom has purchased this tract of land with an existing dock that is in disrepair. Mabusth stated that his principal residence is on Fox Street. Councilmember Adams stated that the applicant is asking the City to approve something illegal. Mayor Butler asked if the former owner owned only the riparian outlot. Zoning Administrator Mabusth stated yes and that the owner lived in Minneapolis. Councilmember Adams stated that the neighbors should get together and apply for a joint use dock license. Councilmember Grabek moved, Councilmember Harnmerel seconded, to table the request until after the Marina Committee has reviewed the joint use dock license from the neighbors. RESOLUTION #1625 MINNETONRA BOAT WORRS 1984 COMMERCIAL MARINA LICENSE* Mayor Butler moved, Councilmember Adams seconded, to approve Resolution #1625 allowing a 198.4 commercial marina license for Minnetonka Boat Works. Radio also informed the Council that Smith had requested staff permission to install a private well and that it is staff ' s recommendation not to allow a private well because there is water service available.
