PAGE 1 ATTENDANCE 7 :00 P.M_ The Orono Council met on the above date with the following members present : Mayor Butler , Council- members Frahm and Hammerel. Councilmembers Grabek and Adamswere absent. City Administrator Benson was absent. Zoning Administrator Mabusth, Building Official Jacobs , Public Works Coordinator Gerhardson, and Recorder Sutton were present. City Attorney Radio and City Engineer Cook were present. PUBLIC HEARING TITLE I C.D.B.G_ FiJNDS 7 :00 - 7 :01 P.M. Mayor Butler announced that now was the time and place for the public hearing concerning the Community Development Block Grant (C.D. B.G. ) Year X funds . Building Official Jacobs noted the affidavit of publication. There wasno one presentin the audience for this public hearing. Mayor Butler closed the public hearing at 7 : 01 p.m. Mayor Butler moved, Councilmember Hammerel seconded , to approve the allocation Year X C.D.B.G. funds in the amount of $29 , 730 for the rehabilitation of private single family properties. Motion, Ayes ( 3 ) , Nays (0 ) . CONSENT AGENDA* Councilmember Frahm moved, Mayor Butler seconded, to approve the Consent Agenda* subject to removing item #19for discussion, with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk' s office. Motion, Ayes ( 3 ) , Nays ( 0 ) . APPROVAL OF MINUTES* Councilmember Frahm moved, Mayor Butler seconded , to approve the minutes of March 12 , 1984 . Motion, Ayes (3 ) , Nays (0 ) . LARE MIIdNETONRA CONSERVATION DIST_ Jo Ellen Hurr was not present, therefore there was no report. POBLIC COMMENTS Councilmember Frahm asked staff why all these real estate signs are being picked up off the street. Frahm stated that the real estate offices should be notif ied of the sign ordinances and where they can pick up their signs. Frahm stated that the real estate signs are so small and really not a traffic hazard. Building Official Jacobs stated that signs are being placed in the middle of the medians and the road right of way, which are a traffic hazard. Jacobs stated that a letter was sent to real estate agencies notifying them of Orono' s sign ordinance. REGULAR MEETING OF THE ORONO COUNCIL HELD MARCH 26, 1984. PAGE 2 Councilmember Frahm stated that it is difficult to find houses out in Orono if someone is not familiar with the area . Frahm stated that directional signs should be allowed. Mayor Butler suggested that this issue be placed on April 9, 1984 , Council agenda and for staff to consider a temporary sign permit and/or standards for directional signs . �807 HENNEPIN COUNTY 2600 WAYZATA BLVD. CONDITIONAL USE PERMIT Earl Johnson and Doug Smith were present. Zoning Administrator Mabusth stated that Hennepin County has agreed to meet the 2 acre minimum. Earl Johnson requested that Hennepin County not be subject to any fencing or walls in the City' s screening ordinance. Mayor Butler stated that the City would much rather see greenery landscaping rather than a fence or a wall . Zoning Administrator Mabusth stated that the temporary access issue should be addressed . Mayor Butler stated that the access should align with the Orono Middle School ' s entrance. Zoning Administrator Mabusth stated that the developer should be responsible for at least constructing a portion of the road until it serves the Hennepin County Library. Mabusth noted that it should not be a temporary access and that access to the library should be f rom another road. Mayor Butler moved, Councilmember Hammerel seconded, to direct staff to draft a resolution approving a library use. Motion, Ayes ( 3 ) , Nays ( 0 ) . #812 ALAN McDOWELL 905 FERNDALE ROAD WEST VARIANCE RESOLUTION #1612 Bob Mitchell , McDowell ' s attorney, was present. Zoning Administrator noted the change in wording in theresolution. Mabusth noted that the applicant was trading off hardcover. Mayor Butler moved, Councilmember Hammerel seconded, to approve Resolution #1612 , A Resolution Granting A Variance To Municipal Zoning Code Section 34 . 201 and 34 . 202 to permit the construction of an attached garage 58feetfrom the lakeshore. Motion, Ayes ( 3 ) , Nays (0 ) . REGULAR MEETING OF THE ORONO COUNCIL AELD MARCH 26, 1984. PAGE 3 #809 JACR HAMLETT 2696 ETHEL AVENUE FINAL SUBDIVISION RESOLUTION #1613 Mr. and Nlrs . Jack Hamlett were present concerning their lot line rearrangement. Mayor Butler stated that this is a lot line rearrangement without creating any new buildable lots. Councilmember Hammerel moved, Mayor Bulter seconded, to approve Resolution #1613 , A Resolution Approving A Metes and Bounds Division of a Lot Line Rearrangement ForJack Hamlett, Dorothy Kearns, and Gordon Amundson. Motion, Ayes ( 3 ) , Nays ( 0 ) . #815 RALPH BAGLEY 1105 FERNDALE ROAD WEST VARIANCE RESOLUTION #1614 Bob Mitchell , Bagley' sattorney, waspresent . Zoning Administrator Mabusth stated that the present code violations would be corrected at the time the building permitis issued. Mabusthstated that Bagley offered to direct the drainage away from the lake and into a retention area. Councilmember Frahm stated that if this wasn ' t an after-the-fact application that the City probably wouldn' t have approved the variance application because of the hardcover problem. Frahm stated that he would like to see a trade-off in hardcover as in the McDowell application. Frahm noted that there is too much hardcover on the property already. Mayor Butler noted that the property is very unique. Mayor Butler moved, Councilmember Hammerel seconded, to approve Resolution #1614 , A Resolution Granting A Variance to Municipal Zoning Code Section 34 . 201 and 34 . 202 to permit the construction of a screened porch 12 feet from the lakeshore. Motion, Ayes ( 2 ) , Nays (1 ) . Councilmember Frahm voted nay. RESOLUTION #1615 R�LEASING TAX FORFEIT LOT FOR PRIVATE SALE Mayor Butler moved, Councilmember Hammerel seconded, to approve Resolution #1615, A Resolution Approving the Release of Tax Forfeit Land, Tract V, RLS 461 for Private Sale To Adjoining Property Owner. Motion, Ayes ( 3 ) , Nays ( 0 ) . REGULAR MEETING OF THE ORONO COUNCIL HELD MARCH 26, 1984. PAGE 4 RESOLUTION #1616 AMRNDING FEE SCHEDULE Councilmember Frahm moved, Councilmember Hammerel seconded, to approve Resolution #1616 , A Resolution Approving a Fourth Amendment to the 1983 Fee Schedule. Motion, Ayes ( 3 ) , Nays ( 0 ) . LETTER TO ROSSILLON FWBI City Engineer Cook reviewed with the Council his letter in regard to sewer unit charges for the F.W.B. I . sewer study as requested by the Council at their previous meeting. Cook noted the letter stated the sewer unit charges would be $970 per unit if a more realistic development pattern of 47 units were projected for the next 10 years instead of 93 units previously mentioned. Cook stated that the F.W.B. I . unit charge would remain at $500 per unit plus $2 , 000 per acre. Councildirected City Attorney Radio to determine when the proposed sewer unit charges could be put into ef f ect and to present that inf ormation at the April 9 , Council meeting. SPECIAL COUNCIL MEETING Mayor Butler announced that a special meeting will be held to meet with John Shardlow, Howard Dahlgren & Associates, concerning the Maple Plain Interceptor. Butler stated that such meeting will be held on Wednesday, March 28 , 1984 at 7 : 30 p.m. in the Council Chambers. WESTONRA CHAMBER OF COMMERCE MEETING - CSAH 15 Mayor Butler announced that the Westonka Chamber of Commerce would hold a meeting on May 16 , 1984 . LETTER TO LAKE MINNETONRA MAYORS - MAPLE PLAIN INTERCEPTOR Mayor Butler noted the letter sent to all Lake Minnetonka Mayors about the Maple Plain Interceptor. CABLE TV - FRANCHISE ORDINANCE - PUBLIC HEARING Mayor Butler announced the Cable TV Franchise Ordinance public hearing to be held April 4 , 1984 at 7 : 00 in the Shorewood City Hall. LETTER FROM SHARDLOW TO METRO COUNCIL* Councilmember Frahm moved, Mayor Butler seconded, to approve the corrected letter f rom John Shardlow to the Metropolitan Council. Motion, Ayes (3 ) , Nays (0 ) . METRO COUNCIL ANSWER TO SHARDLOW* Councilmember Frahm moved, Mayor Butler seconded, to approve the Metropolitan Council ' s answer to John Shardlow' s letter. MAPLE PLAIN INTERCEPTOR JOHN SHARDLOW - ADDITIONAL FUNDING Councilmember Frahm moved, Mayor Butler seconded, to table the additional funding of $3 , 000 until the Wednesday, March 28 , 1984 , special meeting when the Council will meet with John Shardlow. CITY ENGINEER COOR'S LETTER - MAPLE PLAIN INTERCEPTOR FORCE MAIN DESIGN* Councilmember Frahm moved, Mayor Butler seconded, to approve City Engineer Cook' s letter dated March 8 , 1984 concerning the Maple Plain Force Main Design. Motion, Ayes ( 3 ) , Nays ( 0 ) . PCA PERMIT - MAPLE PLAIN WASTEWATER PLANT* Councilmember Frahm moved, Mayor Butler seconded, to note the PCA permit to the Maple Plain Wastewater Plant. Motion, Ayes (3 ) , Nays ( 0 ) . PCA AUTHORIZATION TO DISCHARGE - MAPLE PLAIN WASTEWATER PLANT* Councilmember Frahm moved, Mayor Butler seconded, to note the PCA' s authorization to discharge and construct wastewater treatmentfacilities concerning the Maple Plain Wastewater Plant. Motion, Ayes ( 3 ) , Nays (0 ) . EXCELSIOR LETTER - MWCC COST ALLOCATION SYSTEM* Councilmember Frahm moved, Mayor Butler seconded, to note the City of Excelsior' s letter concerning the MWCC Cost Allocation system. EMPLOYMENT - JOHN HENNING � SAM JACRSON - LIQUOR STORE* Councilmember Frahm moved, Mayor Butler seconded, to approve the employment of John Henning and Sam Jackson at $3. 95 an hour as of March 7 , 1984 .
