The Orono Council met on the above date with the following members present : Acting Mayor Frahm, Councilmembers Adams , Grabek, and Hammerel. Mayor Butler was absent. Zoning Administrator Mabusth, Public Works Coordinator Gerhardson, City Engineer Cook, City Attorney Radio and Recorder Sutton represented the City staff . City Administrator Benson arrived at 7 : 33 p.m. CONSENT AGENDA* Acting Mayor Frahm moved, Councilmember Hammerel seconded , to approve the Consent Agenda* subject to removing item #14 , with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk ' s office. Motion, Ayes ( 4 ) , Nays ( 0 ) . APPROVAL OF MINUTES* Acting Mayor Frahm moved, Councilmember Hammerel seconded , to approve the special meeting minutes of February 9 , 1984 . Motion, Ayes ( 4 ) , Nays ( 0 ) . APPROVAL OF MINUTES* Acting Mayor Frahm moved, Councilmember Hammerel seconded , to approve the minutes of the Council meeting held February 13 , 1984 . Motion, Ayes ( 4 ) , Nays (0 ) . PARK COMMISSION COMMENTS There were no Park Commission comments . LAKE MINNETONRA CONSERVATION DISTRICT REPORT Jo Ellen Hurr was present. Hurr stated that the LMCD had adopted a new dock license for the North Shore Drive Marina. Hurr noted that the LMCD has reduced the night time speed limit to 30 mph on the lake. Hurr stated that the LMCD i s sti 11 trying to get something passed which would require a water skier to wear a floatation device. Hurr stated that this summer each patrol boat will be equiped with a radar unit and that speeders will be tagged. Hurr stated that the LMCD has a proposal for car and trailer parking standards. Hurr noted that a public hearing will be held on March 7 , 1984 , concerning the west side setback variance for Chaska Marine. PLANNING COMMISSION COMMENTS There were no Planning Commission comments . PUBLIC COMMENTS There were no comments from the public present. APPROVAL OF ZONING AMENDMENTS Councilmember Adams moved , Councilmember Grabek seconded, to approve the amendments to sections of the Zoning Code Dealing with Review Procedures for Variances, Conditional Use Permits and Vacations , Updating Definitions , New Performance Standards for Use Districts and Existing Lots of Record . r�4otion, Ayes ( 4 ) , Nays ( 0 ) . Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve Resolution #1606 , A Resolution Approving a Conditional Use Permit Per Municipal Zoning Code Section 31 . 700 , to permit construction of a pond . Motion, Ayes ( 3 ) , Nays ( 0 ) . Tim Adams returned to his seat as Councilmember . #761 DOUGLAS SMITH 3237 CASCO CIRCLE VARIANCE RESOLUTION #1607 Douglas Smith was present. Acting Mayor Frahm asked what the status of Lots 16 and 17 were. Zoning Administrator Manusth stated that Lots 16 and 17 are legally combined. Acting Mayor Frahm stated that "Lots 16 and 17 are legally combined" should be added to finding #3 in the Resolution. Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve Resolution #1607 , A Resolution Granting A Variances to Municipal Zoning Code Section 34 . 552 , to permit construction of a new residence, subject to amending finding #3 . Motion, Ayes ( 4 ) , Nays ( 0 ) . LEASE AGREEMENT - LAREVIEW GOLF COURSE Acting Mayor Frahm moved, Councilmember Adams seconded, to approve the lease agreement for the Lakeview Golf Course handicapped access for elections. ADVERTISE FOR BIDS HANDICAPPED ACCESS PRECINCT #3 Acting Mayor Frahm moved , Councilmember Grabek seconded, to authcrize staff to advertise for bids for the handicap accessibility improvements for the Lakeview Golf Course for precinct #3 . Motion, Ayes ( 4 ) , Nays ( 0 ) . HENNEPIN COUNTY ROAD #15 REPORT Councilmember Adams announced the Hennepin County Board Meeting on March 22 , 1984 . MONTHLY LIQUOR STORE OPERATING REPORT* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve the N,onthly Liquor Store Operating Report as of January, 1984 . YEAR-TO-DATE ESTIMATED REVENUES* Acting Mayor Frahm moved, Councilmember Hammerel seconded , to approve the Year-to-Date Estimated Revenues Compared to Actual Revenues as of December 31 , 1983 . Motion, Ayes ( 4 ) , Nays ( 0 ) . YEAR-TO-DATE BUDGET APPROPRIATION COMPARED TO ACTUAL REVENUES Councilmember Adams asked what the increase in fire resulted from. City Administrator Bensonstatedrealignment had to do with the increase and also a balance was paid on one of the trucks . Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve the Year-To-Date Budget Appropriation Compared with ActualExpenditures as of December 31 , 1983 . FEE SCHEDULE - WATER METERS - RESOLUTION #1608* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve Resolution #1608 , A Third Amendment to the1983FeeSchedule. FINAL PAYMENT - BUFFALO BITUMINOUS* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve the Final Payment for 1983 sealcoating to Buffalo Bituminous in the amount of $3 , 954 . 65 . REVENUES & EXPENDITURES* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve City Administrator Benson ' s memo dated February 21 , 1984 , concerning revenues and expenditures , mill rates and tax distribution. RICHARD HANSOtd* Acting Mayor Frahm moved , Councilmember Hammerel seconded, to approve City Administrator Benson ' s memo dated February 24 , 1984 , concerning the Maple Plain Wastewater Treatment Plant and retaining Dr . Richard Hanson as a consultant to gather scientific data as recommended. Motion, Ayes ( 4 ) , Nays ( 0 ) . MINNEHAHA CREEK WATERSHED DISTRICT* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve City Administrator Benson ' s letter dated February 23 , 1984 , concerning the Minnehaha Creek Watershed District 1984 waterways maintenance and repair fund request for proposal and district funding. Motion, Ayes ( 4 ) , Nays ( 0 ) . APPOINT TOM JACOBS TO C.D.B.G. COMMITTEE* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to appoint Tom Jacobs to the C.D.B.G. committee. LETTER - NORTH SHORE DRIVE MARINA* Acting Mayor Frahm moved, Councilmember Hammerel seconded, to approve Zoning Administrator Mabusth' s letter dated February 22 , 1984 , to the LD1CD concerning NorthShore Drive Marina.
