The Orono Council met on the above date with
the following members present: Mayor Butler ,
Councilmembers Frahm, Grabek and Hammerel .
Councilmember Adams arrived at 7 : 38 P.M. Also
present : Zoning Administrator Mabusth , City
Attorney Malkerson, Public Works Coordinator
Gerhardson, City Engineer Cook and Deputy
Clerk Hallin. City Administrator Benson
absent.
CONSENT AGENDA* Councilmember Frahm moved , Mayor Butler
seconded to approve the Consent Agenda* ,
subject to removal of Item #2 , with all staff
reports concerning items reviewed at this
meeting to be attached to the original copy of
these minutes on file in the City Clerk ' s

SEPTEMBER 25, 1983 Councilmember Frahm moved , Mayor Butler
seconded to approve the minutes of the regular
September 26 , 1983 , subject to amending the

seconded to approve the minutes of the special
meeting held October 6 , 1983 . Motion , Ayes

PARK COMMISSION COMMENTS
Paul Taylor , Park Commission member , was
present and stated that the Park Commission
wanted to thank the City Council for their
cooperation approving the first stages of
development for Summit Park.
LMCD REPORT No comments from the Lake Minnetonka
Conservation District Representative .
PLANNING COMMISSION COMMENTS
No comments from the Planning Commission
Representative .

City Council the request for Thomas Vickerman,
679 Minnetonka Highlands Lane for an "After
the Fact" Conditional Use Permit and Variance .

Councilmember Grabek moved , Councilmember
Hammerel seconded to approve the "After the
Fact" Conditional Use Permit and Variance for
Mr . Vickerman and the City Council would not
require removal of the cement pads at the
bottom of the access stairs located within 75
feet of the lakeshore. Staff to draft a
resolution to be presented at the next City
Council meeting . Motion, Ayes (4) - Nays (�) .

155 WILLOW DRIVE SOUTH
SUBDIVISION Lake Minnetonka Homes contacted � the City
office and stated that their application was
incomplete and asked the City Council to
table their application. They will present
another preliminary plan to the Planning
Commission at a later date .
Motion by Mayor Butler seconded by Council-
member Frahm to table Lake Minnetonka Homes
application per their request. Motion, Ayes

PRELIMINARY SUBDIVISION Zoning Administrator Mabusth reviewed with the
City Council the subdivision request of Carl
Parten. Mr . Carl Parten and his son, Dan
Parten, were present.
Councilmember Frahm moved , Councilmember Adams
seconded to direct staff to prepare a
resolution approving this preliminary sub-
division contingent on the recommendations of
the Planning Commission and an access easement
for sewer maintenance. Staff will also
prepare a resolution allowing the issuance of
a building permit at preliminary approval time
subject to the resolution of the sewerage
matter . Motion, (5) - (0) .

seconded to adopted an amended Resolution
#1568 , A Resolution Granting A Variance To
Municipal Zoning Code Sections 34 . 201 , 34 . 2�2
And 34 . 552 , subject to stating that a variance
to Section 32. 371 is granted and this variance
shall be permanent . Motion, Ayes (5) - (�) .

seconded to expand the review of the
Conditional Use Permit to an annual basis and
to table this Conditional Use Permit request .

CONDITIONAL USE PERMIT
AND VARIANCE Zoning Administrator Mabusth reviewed with the
City Council the application for Rodney
Burwell .
Councilmember Hammerel moved , seconded by
Councilmember Frahm to adopt Resolution #1569
Granting A Conditional Use Permit To Municipal
Zoning Code Section 31 .700 And A Variance To
Municipal Zoning Code Section 31 . 831 . Motion,
(5) - Nays (0) .
WEST HENNEPIN HUMAN SERVICES
PLANNING BOARD Diane Dunlap and Jean Kottemann, represent-
atives to the West Hennepin Human Services
Planning Board , were present and reported to
the City Council the purpose and plans of the
West Hennepin Human Services Planning Board .
They also presented to the City Council their
budget request for 1984 in the amount of
$854 . 00, which is based on the population of
Orono , 12 1/2 Cper person.
The City Council thanked the representatives
for their report and suggested that they keep
the Council up to date of the services
available to the citizens of Orono .

ORONO-MEDINA-LONG LAKE
SEWER BYPASS City Engineer Cook reviewed with the City
Council the location and purpose of , pipe "D" ,
the bypass . He stated the bypass will be
operational Wednesday, October 12, 1983 .
Mayor Butler moved , Councilmember Adams
seconded to accept, pipe "D" , the Orono-Long
Lake-Medina bypass as presented by City
Engineer Cook . Motion, Ayes (5) - Nays (0) .
STUBBS BAY -
CRYSTAL BAY SANITARY
SEWER FEASIBILITY
CONTRACTS Councilmember Grabek moved , Councilmember Adams
seconded to approve the Stubbs Bay Feasibility
Study Contract which includes the sub contract
for soil borings not to exceed $3 , 300 .

Mayor Butler moved , Councilmember Frahm
seconded to approve the Crystal Bay Feasibil-
ity Study Contract which includes the sub
contract for soil borings not to exceed

TASK FORCE REPORT Mayor Butler announced that the League of_
Women Voters will sponsor a town meeting of
the Lake Minnetonka Task Force . Mr . Brown ,
the Chairperson of the L.M.C.D. , will be
presenting the report to the public . The
meeting will be held October 13 , 1983 , at 7 : 30
P.M. , at the Gray Freshwater Biological
Institute .
FALL CLEANUP Mayor Butler announced that Orono will have a
fall cleanup day. It is scheduled for
Saturday, October 15, 1983, from 8 : 00 A.M. to
4 : 30 P.M. at the long gold equipment shed next
to the Administrtation Building .
CABLE T.V. REPORT Mayor Butler reported that the Cable T.V.
meeting scheduled for October 4 , 1983 , was
cancelled and has been tentatively scheduled
for November 1 , 1983 .
Mayor Butler announced that once the Cable
T.V. Joint Powers Commission has appointed the
franchise holder she would like to step down
from the Cable T.V. Commission. The City
Council will then have to appoint another
Councilmember to this commission.
