Regular Meeting of_ the Orono Council , April ?5 , 1983 The Orono Council met on the above date with the following members present : Mayor Butler , Councilmembers Adams , Frahm, Grabek , and Hammerel . CONSENT AGENDA* Councilmember Grabek had questions concerning items 21_ , 2.2. , and 2.9 on the consent agenda . Item 21 : Open Meeting Law, City I��lministrator assured Councilmember Grabek thatthematter has been �ttended to ; Item ?.2 : Southwest �'acility Ptan letter to Brad Van Nest , Benson informed him that the Ci ty appointed Van Nest to represent the City and report back to the City f_or direction ; Item ?.9 : Hennepi.n County Radio l�tter , Benson explained the procedure to Councilmember Grabek . REGULAR MEETING OF THE ORONO COUNCIL, APRIL 25 , 1983 Page 2 PUBLIC COMMENTS Peggy ,7ohnson , 35�8 Lyric Avenue , informed the City Council that the contractors for the Schlee Development were blocking Blaine Avenue and Livingston Avenue with trucks . Mayor Butler stated that it was part of the agreement with the developers that trucks were not to use the City roads . City Administrator Benson stated that he would inform the dev�lopers to clean up the area ancl not to use City roads per the agreement . MAPLE PLAIN SEWER William Van Nest , �ormer Mayor of Orono , st�te� that he had a meeting with George Lusher , Metropolitan !aaste Control CommissS.on , who indicated to Van Nest that the MWCC does not want to go into the publ ic hear inq process but would be willing to negotiate for the upgradi.ng o� the . Maple Plain `v�astewater Treatment Plant and to put in phosphorous remova). equip.ment as soon as possi.ble . T_ssuing a permit to the M�ple Plain Treatment Plant to operate will be more cost effective th��n putting �n interceptor throuqh Orono . Councilmember Fran� mo��ed , Mayor Butler seconder] , to reaffirm the Council ' s previous motion that they are in favor of upgrading the �taple Plain '�lastewater Treatment Plant with phosphorous removal equipment . Motion, Ayes ( 5) - Nays (�1) . LAKE MINNETONKA TASK FORCE William V�n Nest , L�ke Minnetonka Task Force , informed the City Council that the final draft of their r�port should be comp).eted by the middle of May, 19R� . The report states that the Hennepin County ramp at Hendrickson bridge is more than adequate for 7one 1. , which is Orono , and that no new access will be necessary in the City. The . one site that i.s speciFically mentioned in the report is the h1olJ_y' s Corner �rea . Van Nest stated that the Department of Natural Resources has had pl.ans to obt�in land that is ownec� by Hamm at that corner , to improve the tand to provide additional. parking and J.aunchi.ng of boats , and possiblya pier . Therecould also be additional parking along County Road �15 . Van Nest informed the DNR that this particular area is too dangerous an area for that type of_ use as i t i.s used hy fishermen now, and that the matter is before the City Council at present . Van Nest stated that he informed the DNR that previous REGULAR MEETING OF THE ORONO COUNCIL, APRIL 25 , 1983 Page 3 acti.on by the Orono City Council was to retain the shoreline along County Road 15 for public use . The Dr1R �vould share costs with the City of Orono to construct a pier and parking area but that the DNR would not let the City regulate the use of the area . Van Nest stated that. he would like direction from the City Council on what to report back to the Task Force . MOLLY'S CORNER Mayor Butler informed the City Council and the audience present that the Molly' s Corner matter would now be discussed . Mayor Butler stated that this item has had two public hearings before the Pl�nni_ng Commission and had been be�ore the City Council at their la,st regular meeting . Mayor Butler stated that the City Council has tY�e verbatim transcript before them which includes everything that has been said concerning the Molly' s Corner matter . She stated that it was now time for the City Councilmembers to discuss this item amongst themselves but if any person in the �udience has anything new to add , the City Council will hear them . Mr . Peter Watson , 1925 Fox Street , st�ted that he was not present at the last meeting but wished to state that he is opposed to the parkinq at that location due to the unsanitary conditions with garbage scattered all o��er plus the trespassing on private property by persons using the present parkinq lot . Mr . �nleed , 13�i5 Orono Lane , stated that he disagreed with Czty Planner Olson ' s memo dated Apri _l ?_?., 1983 statinq that it was too emotional thathe would prefervacating BrackettAvenue but to �llow limited parking and fishing at that area . Mayor Butler stated that it was now time for the Councilmembers to discuss this matter between themselves . She stated that the City Council wasremissin notconsidering the recommendation by the Planning Commission �t their me�ting of March 21 , 1983 . M�yor Butler moved , for the purposes of discussion , that the Planning Commission recommencl��tions of March 21 , 79�33 be adopted . Is there a secon�? Councilmember Frahm seconded . Mayor Butler moved to direct the City staff_ to prepare a resolution to include the followinq : l . The City/County will not vacate any area currentlyused bythepublicforroadway, parking or direct ] ake �ccess . 2.. The City/County will vacate or abandon excess riqht of way width not needed for roadway maintenance incJ_uding portions of Brackett Avenue in return for receipt of deeds to Gregory' s Block ls? and Reserve , including any pr. ivate interest in the shoreline accreations atonq County Road 15 south of the Reserve . 3 . Gregory wiJl relinquish or assign his easement f.ror� the railroad over the parking �rea to the City . 4 . The City will grant docici_ng or moor. ing rights alonq Brown ' s Bay to Gregory and Duff , including the ability to transfer those rights to the Tanager Lake side if. they so chose . 5 . The City wi ]_]_ erect a fence hetween the Reserve and the Hamm property , but will not erect any fence around the parking lot , at least not at this time . The City will gate or cable the parking lot entry and will post the area cJ_osed from 1�1 : (��1 P. M , to � : �1�1 A. M. The City will perform reasonable litter maintenance but will not otherwise promote the area or make any financial investment to improve it . The City will enforce the curf�w, loitering , litteri.ng , anc� other laws i.nclu�? ing tow-�way of_ illegally or danger.ously parked cars . The City will eva�uate activities anc3 complaints over time to see if other controls are necessary . � . The actual vac�tion , deeding and other transf_ers will occur simultaneous with final plzt approval and recording , with actual timing anei legal methods to be c�etermined by Mr . Berg and Mr . Ma�k�rson . 7 . The intent of_ this agreement is indicated on the attached map. REGULAR MEETING OF THE ORONO COUNCIL, APRIL 25 , 1983 Page 5 Councilmember Grabek pointed out on the map the areas to be vacatecl and ret�ined and exp].ained the motion . The reserve area was pointed out to Mrs . Gregory anc3 explained that that was leftover property. The parking area was termed a toy that cannot be reached legally. A l�ase from the railroad wou_ld bn necessary for legal access to the parking l.ot . Parking wou]_d also be used on the east side of County Road 15 . Ci. ty Aclmini.strator Benson presented the City Council with a memo concerning various options f_or mai.ntenance and improvi.ng the parking area for Molly' s Corner dated April 25 , 1983 . Discussion incl_uded paving , striping , gate and guardrails . It was stated that the City would be 1i.able for any problAms if they bui]_t a parking lot there and the possibility of condoning the trespassing on private property by persons using the railroad property . Counci.lmem�er Adams star_ed that his motion at the previous Council meeting was not intended to incre�sz the parkinqare� orpermitthecontinued use for illegal purposes such as trespassing on private propnrty. Councitmember �rabekstated thathewouldlike to seethe parkingarealandscapedandbeautified by next spring . If it were done over a period of time , it would not come as a surprise to the persons usinq the parking lot when they come next spring �nd f.ind it closed to the publ. ic . Mr . Berg , �.ttorney f_or the Gregorys , presented a l�ase from Burlington I�Iorthern railroad . City ,�ttorney Malkerson checked over the lease and determined that the lease is not a signed lease , therefore , the lease w�s not accept�d . Mr . wAec3 stated that the corner is very dangerous and that many accidents occurred there . Mayor Butler informed Mr . Weed that Chief of Police Kilbo , at the first public hearing 'raef_ore the Planni.nq Commission , stated that no accidents occurrec� at that corner due to the parking lot . The accidents that had been at that corner were due to sp�ed on the curve and other factors not related to persons leaving or entering the parkinq lot . Discussion again incluclec� the DNR acquiring property at that corner and huilding a larger parking lot , puttin� in a fishing pier and possibly a boat 7_aunching area . M�yor Butler : Let me read to you the staff recommen!?ations concerning the Planning Com- mission action which was adopted by the Planning Commission with a couple of changes . Based upon facts in the record , the position of the applicants , William Gregory and David nuff , and the clear need for something to be done to reduce problems and confl_ icts in the areG of Molly' s corner , City staff_ recommends the fo7lowi.ng acticn regarding vacation : The highway right of caay should remain 5ti feet wide as in�icatec3 on the County Highway Plat as recorded February 17 , ].982 , including all land originally plattec-3 in 1Q87 as BrackPtt Avenue , except as follows : 1. . Basec� upon actual use and topographical conditions , that portion of_ the hi.gh�vay abutting the unplatte� Gregory and Duf_ f_ properties in Secti.on 11 should be limited to 27 . 5 feet from centerl ine on the west side onl_y (as requested by the applicantsl thereby vacating 5 . 5 ft on tlzis sirle . The east ( shoreline) side must remain 33 ft . £rom centerline and must not be vacated as this entire area consi. sts oE roac�bed , ripr�p and supportfor theroad . The actual shoreline here was cre�te� when the road was relocated in the late 197..(� ' s/ early 193P1 ' s , has been publicly used forfishing , �nd ispuhliclynecessarytosupport and maintain the road . There can be no public purpose shown for vacating any shoreline which was either platted public or created by public road construction . � . ORONO PARK TOUR Mayor Butler announced that the Orono Park Tour will be Tuesday, May 3 , 1983 at � : �� P. M. All of the City Council stated that they will be going on the tour . CABLE TV Mayor Butler announced that the Cable TV public hearing was held April 1?_ , 1983 and that the RFP was mailed out to the interested Cable companies on April 13 , 1983 . The response to the RFP will be coming in possibly late in May or early June . The next Cable TV meeting will be held ,June 12 , 1983 to answer any questions that the C�ble companies might have that need clarification.
