Regular Meeting of the Orono Council , March ?..8 , 198�
The Orono Council met on the above date with the
f_ollowing members present : Mayor Butler ,
Councilmembers Frahm, Grabek , and Hammerel .
Councilmember Adams arrived at 7 : �7 P.M. Also
present : City Planner Olson , Zoning Adminis-
trator Mabusth , City Attorney Malkerson, City
Administrator Benson , City Clerk Strom ,
Planning Commission Members Goetten , Kelley,
and Sime .
CONSENT AGENDA*
Council.member Hammerel moved , Councilmember
Frahm seconded , to remove item # 2. from the
Consent Agenda* . Motion , Ayes ( 4) - rlays ( �3) .
Councilmember Hammerel moved , Councilmember
Frahm seconded , to approve the Consent Agenda* ,
subject to removing item #2 , with all staff
reports concerning items reviewed at this
meeting to be attached to the original copy of
these minutes on file in the City Clerk' s office .

MINUTES
Mayor Butler moved , Councilmember Frahm
seconded , to approve the minutes of the Regular
meeting of March 14 , 1.98? , subject to including
the Affidavit of Publication in the CDBG public
hearing item and on page 4 , to add the heading of
Resolution #14ti5 for that item. Motion, Ayes
(41 - Nays ( �l) .
PARK COMMISSION
COMMENTS
Mayor 8utler announced that the next meeting of
the Park Commission will be held April 5 , 1983 at
? • �� P.M, to consi.der the Bederwood Park
improvements for 1993 .
LAKE MINNETONKA
CONSERVATION DISTRICT
The Lake Minnetonka Conservation District
representative ,7oEllen Hurr was present to
report on the activities of the Lake Minnetonka
Conservation District stating that the LMCD
tabled regulations for residential boat storage
density for further study. Mrs . Hurr informed

the City Council that aerial photos would be
taken of docks on Lake Minnetonka that would be
valuable for further study of the density of
residential boats . Mrs . Hurr informed the City
Council that the LMCD regu_lations allow two boats
per 5�1 ' of shoreline and one boat for each
additional 5�i ' . M�yor Butler stated that she
felt it was discriminatory that residents with
less then 1�1�J ' could have only two boats ; proof of
ownership of four boats per household would be
more appropriate . She a�so stated that the
Water Patrol did a very efficient job of seeing
that the owners of fish houses were notified to
cleanup their fishing areas . Mrs . Hurr
inf_ormed the City Council that late applications
for multi_ple c�ocks were being fined 55� , which
helped in solving the problem of late
applications for the LMCD.

ZAi�fi:IlL�TE PRESENTATION
City Planner Olson introduced Mr . ,7ohn Shardlow,
Jess Martin , and Dr . Rossillon who were present
to discuss housing for students and scientists
for the Gray Freshwater Biological Institute .
Mr . Shardlow reviewecl a memo he had prepared
concerning the problems of_ housing that some of
the students encountered . He st�ted that the
Institute would like to build low-cost housing
for the students and visitors to the Institute .
Mr . Shardlow showed slides of the present
building and the av�ilable land surrounding it
where the location of the building would be . He
a7_so stated that the University of Minnesota
would take-overthebuildingatsomefuturedate .
The area consists of 37+ �cres adjacent to the
GFWBI . The building would consist of sixteen ,
four- bedroom units . The intentions of the
Institute is to contact property owners in the
Navarre area to explain their project . Trees
woulcl be left on the property to act as a buffer
and none of the wetl.anc3s woulc] be disturbed . The
property that would not be built on would remain
the propertyof theInstitutewhentheUniversity
takes-over the property the new construction
will be on . Some of the services that the City of
Orono would provide include sewer , water , and
schools which the University would agree to pay a
fair price .

Discussion centered on what the conditions were
when the building permit was approved for the
Freshwater Biological Institute , if additional
buildings could be placed on the property at a
later date or not . Council requested that the
former file be searched to determine previous
acti.on .
BIG ISLAND VETERAN'S CAMP*
Councilmember Hammerel moved , Councilmember
Frahm seconded , to approve the Big Island
Veteran ' s Camp status report prepared by City
Planner Olson dated March 23 , 1983 . Motion ,

DNR SHORELAND ADVISORY

Advisory Committee Report prepared by City

VARIANCE #72�1
925 WILLOk�l DRIVE SOUTH
DOUG DE MALIGNON
Mr . & Mrs . deMalignon were present to discuss
their after-the-fact variance for a six-foot
f_ence at 925 Willow Drive South . Mr . deMalignon
read his letter dated March 28 , 1983 to the City
Council in support of his reasons for the fence
versus extending the present trellis , which had
been approved by the City Council on February 2�3 ,
1983 .
Mayor Butler explained to Mr . deMalignon the
procedures and conditions for granting of
vari�nces , which are required to show a hardship
to the land , not a hardship for the persons
involved .
Councilmember Grabek moved , Mayor Butler
seconded , to approve the after-the-fact
variance for poug deMalignon , 9?.S Willow Drive
South , for a six-foot fence placed in the same
place as the Council agreed on for the trellis ;
Mr . deMaliqnon agrees to pay fees of S215 owed on
the application , and to a�ree inwriting that if a
problem is caused to health , traffic or
maintenance , that the fence be removed .
Motion , Ayes ( 1) - Nays (4) . Mayor Butler ,
Councilmembers Ad�ms , Frahm , and Hammerel voted
Nay. Motion failed .

Mayor Butler annonced that the Sewer Service
