Regular Meeting of the Orono Council, March 14 , 1983
The Orono Council met on the above date with the
following members present: Mayor Butler, Council-
members Frahm and Grabek. Absent: Councilmembers
Adams and Hammerel. Also present: Zoning Adminis-
trator Mabusth, City Planner Olson, City Attorney
Malkerson, Public Works Coordinator Gerhardson,
and Deputy Clerk Woytcke. Also absent: City
Administrator Benson.
PUBLIC HEARING
CDBG YEAR IX
At 7:01 P.M. , Mayor Butler announced that now was
the time and place for the public hearing concerning
the Coummunity Development Block Grant Program.
City Planner Olson presented the Affidavit of
Publication and stated that the purpose of the
public hearing was to receive suggestions from the
public concerning uses of the CDBG funds for Year
IX.
Mr. Howard Meagher, representative of the Westonka
Senior Organization, stated that he was happy for
Orono ' s participation in the Westonka Senior Housing
project but hoped that it could be located in Orono;
possibly, at some future date Orono could have a
similar project.
After all persons present were afforded an oppor-
tunity to be heard, Mayor Butler closed the public
hearing at 7:07 P.M.
Mayor Butler moved, Councilmember Frahm seconded,
to approve the proposed program and to authorize
staff to prepare and submit the formal Year IX
application for Westonka Senior Housing and Housing
Rehabilitation funds to Hennepin County. Motion,
Ayes (3) - Nays (0) .
CONSENT AGENDA*
Councilmember Frahm moved, Mayor Butler seconded,
to approve the Consent Agenda*, with all staff
reports concerning items reviewed at this meeting
to be attached to the original copy of these
minutes on file in the City Clerk ' s office. Motion,

LAKE MINNETONKA CONSERVATION DISTRICT
No report of the LMCD at this time, a copy of the
March Agenda was presented to the Council .
MAYOR' S REPORT �
Mayor Mary Butler reviewed with the council the
Lake Minnetonka Mayor' s report that was included
in the packet. She stated the meetings would be
quarterly.
CITY PLANNER' S REPORT
#726 STATUS REPORT
MOLLY' S CORNER
City Planner Alan Olson reviewed with the council
the memos and reports regarding the Molly' s Corner
matter.
Mr. Olson passed out a letter to the council that
he received at 4 : 30 P.M, this day from Mr . Berg,
the attorney for the Gregory' s, for the council to
read and then comment.
The public hearing on Molly' s Corner is set to
continue at the Planning Commission March 21 , 1983 .
Mayor Butler commented that she did not understand
the memo regarding fencing. She felt it was wrong
for the City of Orono to be putting fencing up on
private property. She agreed the City should put
a gate up to control the parking area and that the
police should police the area, there should be signs
designating hours that the area could be used but
she did not feel the City should spend taxpayers
money to fence Mr. Gregory' s property.
John Gerhardson stated these matters were suggestions
from the Gregory ' s attorney and that the City had not
agreed to any of these conditions .
This matter will be discussed at the public hearing
on March 21 , 1983 .

RESOLUTION #1465
Mr . Ned Dayton was present to represent Mr. Bruce
B. Dayton.
Zoning Administrator Mabusth reviewed this applica-
tion with the Council .
Councilmember Frahm moved, Mayor Butler seconded
to approve the preliminary subdivision application
of Bruce Dayton subject to the Planning Commission' s
recommendations of the following conditions:
1 . Applicant execute a flowage & conservation
easement over the wetland area designated at
the 962 elevation per survey dated revised
January 19, 1982 .
2 . If Outlot A is developed in the future creating
additional residential lots, a cul de sac must
be installed and the plat road brought up to
current standards for rural development.
3 . The City will ask for an underlying road and
utility easement over the road outlot .
4 . The applicant must execute a maintenance agree-
ment to assure the upkeep and maintenance of the
private road.
5 . Payment of a park dedication fee determined as
Lot 2@ 200 . 00 and Lot 3@ 200 . 00 for a total of
$400 . 00 .
Also Councilmember Frahm approved staff ' s conditions
of :
1 . Dedication of 33 ' right of way for Old Long Lake
Road.
2 . 100 ' length apron paved from intersection of Old

to adopt Resolution #1465 Approving The Request of
Jensen Homes, Inc. To Apply For A Building Permit
Prior To Final Subdivision Approval . Motion, Ayes

780 TONKAWA ROAD - VARIANCE
RESOLUTION #1466
Zoning Administrator Mabusth reviewed this Variance
application of Mr. Gabriel Jabbour 780 Tonkawa Road.
Mayor Butler moved, Councilmember Frahm seconded,
to adopt Resolution #1466 Granting A Variance To
Municipal Zoning Code Section 34 . 452 - File 728 ,
subject to the Planning Commission' s recommendations
of the following findings:
1 . Location of trees and mature plantings.
2 . The structure will not be located within the
75 ' to 250 ' setback area .
3 . The structure will never be used by vehicles
seeking direct access onto Tonkawa - doors face
away from Tonkawa with no formal driveway.
4 . The structure does not create traffic hazards
or sight problems.

CABLE T.V. REPORT
Mayor Butler announced that there will be a Public
Hearing regarding Cable T.V. at the Shorewood City
Hall on April 12 , 1983 at 7 : 30 P.M.

Councilmember Frahm moved, Mayor Butler seconded,
to accept City Administrator Benson' s memo regardinq
the I-394 Construction. Motion, Ayes (3) - Nays (0) .
82-2 STREET IMPROVEMENT REVISION
Mayor Butler moved, Councilmember Grabek seconded, to
approve the revision of the street improvements to
provide for a joint access with the cabinet shop in
addition to the original access planned on the east
side of the Dairy Queen Property. Motion, Ayes (3)

It was announced by Mayor Butler that Councilmember
Hammerel will be on vacation from March 7 - 19 , 1983 .
GRAY' S BAY DAM*
Councilmember Frahm moved, Mayor Butler seconded
to accept the letter dated February 24 , 1983 from
the DNR regarding the Gray' s Bay Dam Operational
Plan, Permit 76-6240 . Motion, Ayes (3) - Nays (0) .
MINNEHAHA WATERSHED*
It was announced by Mayor Butler that the Minnehaha
Watershed District Meeting will be April 7, 1983 at
7: 30 P.M. at the Orono Council Chambers .

to accept the letter dated February 28 , 1983 from
the Hennepin County Dept. of Transportation regarding
the Hennepin County Entrance Permits and Right of Way
