Dear Mr. Paddock:
We have been informed by the Minnehaha Creek Watershed District that you intend to install riprap on the
property at 1450 and 1500 Bracketts Point Road in Orono, MN. Because riprap is often part of a larger project,
we want to alert you to some related City code provisions so you can avoid the hassle and expense of obtaining
an after-the-fact permit or even having to undo some of the work.
With few exceptions, inctuding riprap and lakeshore steps, City code prohibits the installation of impervious
surfaces within 75 feet of the lake. Any sort of fabric is considered impervious. This means that riprap rock may
be extended farther than allowed by the riprap permit but no fabric may be installed under it.
The following activities require a permit from the City:
• Any earth movement outside the area where the rip rap will be placed
• Replacement of retaining walls and/or installation of new retaining walls within 75 feet of the lake (regardless of the
height of the walls)
• Construction or replacement of lakeshore steps
• Removal of trees (dead or alive)six inches in diameter or larger within 75 feet of the lake
• Removal of vegetation on any slope within 75 feet of the lake that is too steep to easily walk
• Removal of vegetation or trimming of trees larger than six feet to provide a view of the lake from the house
• Total or near total removal of vegetation within 75 feet of the lake not part of another pe►mit
A tree removal permit can be arranged by calling 952-249-4600. For the other permits your contractor must
submit a permit app�ication and plans for review. Additional information can be found at the City website,

This permit is not transfierable without District approval, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires more time to complete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for compliance wi#h all District Rules and for the action of their
representatives, contractors, and employses.
Conditions: Project to be comple#ed as described in plans submitted to the
MGVIID office on April 6t", 2017 according to the provisions of this perrnit.
• All equipment intended for use at � project site must be free of prohibited
inv�sive species and aquatic plants prior to being transported into or within
the st�t� and placed into state wa#ers
• All equipment used in designated infested waters must be adequately
decontaminated prior to being transported from the worksite
• Properly install and maintain all required erosion control measures until the
disturbed areas are re-stabilized
• Notify MCWD in writing upan completing installation of perimeter and
sedimerrtation controls
• When the site is re-stabilized and the MCWD staff has perFormed a final
inspection, all perimeter control must be removed

A site inspection and monitoring by District staff will be perFormed where the aetivity involves:
• a commercial/industriai/rriulfii-family residentiai development
• a single family residential development greater than 5 acres or of any size if within the
Minnehaha Creek subwatershed
� any alteration o#a floodplain or wetland
• dredging within the beds, banks or shores of any protected water or wetland
• a violation
• any project which in thE judgment of the District staff should be inspected due to project
location, scope, or construction techniques
In these cases, the applican#shall pay to the District a fee equal to#he actual costs of field
inspectian of the work, including investi�ation of the area affected by the work, analysis of the
worl�, and any subsequent monitoring of the work, which in the case of a violation shall be at
least $35.
