Regular Meeting of the Orono Coouncil , November 8 , 1982 .
The Orono Council met on the above date with the
following members �resent : Mayor Van Nest , Council-
members Frahm, a�d Adams arriving 8 : 15 . P .M, meeting
the quorum requirement . Absent were : Butler and
Hurr. Also present : City Attorney Malkerson, City
Planner Olson, Zoning Adninistrator Tlabusth, City
Clerk Strom, Public Works Coordinato Gerhardson,
Bill Carlson Votir_g Machine Custodian, City Engineer
Glenn Cook, and Deputy Clerk Woytcke. City Adminis-
trator �enson arrived approximately 7 : 30 P .M.

Councilmember Adams moved, Frahm seconded to approve
the consent agenda as presented. Motion, Ayes (3)

CANVASS BOARD MINUTES
Councilmember Frahm rnoved, Adams seconded to apDrove
the Canvass Board Minutes of November 4 , 1982 as
amended. Motion, Ayes (3) - Nays (0) .
AFFIDAVIT-REGARDING THE
VOTING NIACHINES
Councilmember Adams moved, Frahm seconded, to accept
the affidavit as part of public record regarding the
election of November 2 , 1982 . Motion, Ayes (3) -

RepresentativP present was J . Diann Goetten, also
present from Planning Commission was Gloria MacDonald.

OLD CRYSTAL BAY ROAD
Mr . Gonyea was present to discuss with the Council
the possibility of sewer availability for the area
of Wayzata Blvd, and Old Crystal Bay Road.
Councilmember Frahm moved, Adams seconded to direct
staff to prepare a report showing the present alloca-
tion of_ sewer units and some recomrnendation of potential
realiocar..ion . Motion , Ayes (3) - Nays (0) .

the council the preliminary sub-dzvision application
of Mr . Vincent R. Anderson 1865 Concordia Street .
Mr. Anderson was nresent .

to approve the plat , Fa�erness Woods , of a lot line
rearrangement subj�ct to cond�tions setforth by

Commercial Site Plan
Zonin�, Adminis*�rator Mabusth reviewed with the Council
the Commercial Site plan. Mr . Steve Wagner was present .
He explained the fence on top of the building caould be
5 ' hi�h and onlv small items such as wheelbarrows etc .
would be stored there .
Councilmember A.dams moved, Frahm seconded to ap:prove
the Commercial Site Plan for 3609 Shoreline Drive .

CITY ENGINEER' S REPORT
EASEi�IENTS 82-1 & 82-2 City Attorney Malkerson s�ated the three easements
yet to be finished are the Hardinp; , Schommer, and
Geyen. He stated his recommendation of these easements
should be in at least 30 days .
Malkerson stated the City has yet to receive the
letter of Credit from Schlee Builders . He stated
the letter of credit should be in the office by
Tuesday morning.
Mayor VanNest stated he feels the City of Orono
should not enter into a contract until the letter of
credit has been issued. If the contracter can extend
fine but if not , the City may have to scrap this
proje�t . The econolnical situation is so doubtful
that it would not be wise f-or the CitS� to c^*^mit
itself without the letter o� cre�i; t. ,
Mayor Van Nest moved, Frahm seconded, that the City
staff inform Mr. Feirst that the City will not sign
a contract until such time they have in hand the letter
of credit drawn ta th� standa.rds required by the City
of Orono . And if n.ecess�ry the City would cancel the
project if need be . Motion , A_yes (3) - Nays (0) .

Change Order ��3 that the contract woui.d be extended
by 15 days . Motion, Ayes (3) - Nays (0) .

LAKE MINNETONKA TASK FORCE
Mayor ��an Nest reparted the Lake Minnetonka Task
Force Meeting ��ou1d be November 16 , 1982 at 7 : 30 PM
at tlie F .W. B . I . Building in Navarre . He stated
Mr . Richard Hanson, Director of FWBI would be there
to discuss the Watershed and its relation to the lake .
BIG ISLAND MEETING
Mayor Van 1Vest repor.ted that on December 14 , 1982
the Lake Minneton�ca Task Force wi11 be meeting in
the Twin City Feder,�l Building in Excelsior and
they �aoulci be discussin� the Bi� Islar�d Vets Camp .

at 8 : 00 A. M, as this is the building the City is
deciding on for the Po.lice Department ,
Councilmember Adams stated he could be present ,
Mayor Van Nest stated he would try,
Councilmember Frah.m state he could not be present .

City Administrator Benson' s memo regarding the tax
levy for the 1983 Budget collectible in 1983 in the
