The Orono �Council met on the above date with the following members present: Mayor Van Nest, Council- members Butler, Adams , Frahm, and Hurr. Also present City Attorney Malkerson, Zoning Administrator Mabusth, Public Works Coordinator Gerhardson. City BQputy-Clerk Woytcke. City Administrator Benson arrived at 7 :45 P.M. CONSENT AGENDA* Butler moved, Van Nest seconded, that items #2 , #3 and #24 be removed from the Consent Agenda* . Motion, Ayes (5) - Nays (0) . Butler moved, Van Nest seconded, to approve the Consent Agenda* , subject to removing items #2 , #3 , and #24 with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk ' s Office. Motion, Ayes (5) - Nays (0) . MINUTES* Butler moved, Frahm seconded, to approve the minutes of the Regular Meeting of September 13 , 1982 as amended. Motion, Ayes (5) - Nays (0) . MINUTES OF SPECIAL* Butler moved, Adams seconded, to approve the minutes MEETING 9/16/82 of the Special Meeting of September 16 , 1982 as amended Motion, Ayes (5) - Nays (0) . PARK COMMISSION Barbara Peterson, Peggy Watson and John Watson were present to discuss with the council the Bederwood Park Ballfield. Peggy Watson reported to the Council the problem with the outfield and explained the Park Commissions recommendations for sodding or seeding the field. Hurr moved, Butler seconded, to allow staff to get bids for the field on seeding or sodding and to poll the council for approval by telephone. Motion, Ayes (5) - Nays (0) . L.M.C .D. REPORT Councilmember Hurr reported that the L.M.C.D. appreciated the lettez of support. Also at the last meeting the officers were elected as follows : Chairman-Bob Brown, Vice-Chairman-Robert Raskob, Secretary-JoEllen Hurr, Treasurer-Ed Bauman. #669-TONKA LAKE PROPERTIES-RESOLUTION Hurr moved, Frahm seconded, to approve the preliminary plat subject to the findings and conditions setforth in the resolution . In additon applicant be advised by council to work with the owners of lot 17 &18 and 19 to see if they would agree to grant a road and utility easement to the City permitting the upgrading of the private road to a maximum 18 ' width same as existing road and allow regular maintenance by the REGULAR MEETING OF THE ORONO COUNCIL, SEPTEMBER 27 , 1982 PAGE 2 City of that portion of the road to the cul de sac , and advise staff of their decision as soon as possible to assure final approval by Council no later than Dec. 8 , 1982 . Motion , Ayes (5) - Nays (0) . #704 DOUGLAS AABEL* VARIANCE Butler moved, Van Nest seconded, to approve the side yard Setback Variance for pouglas Aabel at 1580 Long Lake Blvd. Motion , Ayes (5) - Nays (0) . NE3LS EASEMENT Van Nest moved, Butler seconded to approve the original amended Flowage & Conservation easement to be filed with the new 1ega1 description of the wetlands . Motion, Ayes (5) Nays (0) . EASEMENT & APPEAL WAIVERS-NORTHERN AVE. SEWER City Engineer Cook reminded the Council that the bids would be received and opened on Oetober 8th tor the Northern Avenue Sewer Project. Council approved the Agreement to Waive Special Assessment Appeal form, with the correction in wording on page 2 item 7 . BIG ISLAND-HENNEPIN COUNTY PARK RESERVE Mayor Van Nest reported that he was the host for a Big Island trip with Commissioner of Veterans Affairs , Chairman o� Metropolitan Parks and Open Space Commission, Hennepin County Park Reserve representatives , Bob Searles and 4 people from the House of Representatives. The discussion was regarding the Vets Camp property out on Big Island. The fact that it would be ideal for park area similar to Carver Park, trails , and tents for camping. LAKE ACCESS MEETING Mayor Van Nest announced the Lake Access Committee Meeting will, be October 12 , 1982 . It will be a boat trip to a�l the public marinas on the Lake. METRO WASTE CONTROL COMMISSION MEETINGS The Metro Waste Control Commission Meeting will be October 5 , 1982 at Shakopee. PRIMARY ELECTION RESULTS* Butler moved, Van Nest seconded, to accept the memo regarding the Primary Election Results. Motion, Ayes (5) - Nays (0) . POLICE FACILITY* Butler moved, Van Nest seconded , to accept City Administrator Bensons memo regarding the Northwest Contracting Bldg. for Police Facility. Page 3 RESOLUTION AMENDING* Butler moved, Van Nest seconded, to approve RESOLUTIOv #1399 Resolution #14I7 amending Resolution #1399 regarding election judges . Motion, Ayes (5) Nays (0) . FALL CLEAN UP DAY* Butler moved, Van Nest seconded, to accept City Administrator Benson' s memo regarding the Fall Clean Up Day for October 16 , 1982 . Motion, Ayes (5) - Nays (0) . METRO TRANSPORTATION* DEVELOPMENT GUIDE Butler moved, Van Nest seconded, to accept City Administrator Benson ' s memo regarding the Metro Transportation Development Guide. Motion, Ayes (5) - Nays (0) . COUNTY ROAD 15 PLAT* Butler moved, Van Nest seconded, to accept City Administrator Benson' s memo regarding the County Road 15 plat. Motion, Ayes (5) - Nays (0) . FRENCH LAKE SEWER PLANT* PROPER'rY-JIM JOHNSTON Var_ Nest moved, Adams seconded, to amend the original purchase agreement to inc�.ude the following: If the Johnston' s fail to get clear title of the 20' wide disputed corridor the City will agree to repurchase the parcel of said land for the same amount that he paid for it which was $5 , 300 . 00 , and to approve the most western lot as a buildable site without the 1 . 3 acres of City land. METRO COUNCIL PLANNING* Butler moved, Van Nest seconded, to approve the ASSISTANCE GRANT-AGF.EEMENT Metro Planning Assistance Grant Agreement and AND RESOLUTION Resolution. . Motion, Ayes (5) - Nays (0) . L.M.C.D. Letter dated* September 16 , 1982 Butler moved, Van Nest seconded, to accept City Administrator Benson' s letter to L.M.C .D. reqard- ing enforcement of its ordinances. Motion, Ayes (5) - Nays (0) . SALARY REVIEW* JEROME SMITH Butler moved, Van Nest seconded, to approve the salary increase for Jerome Smith in the amount of 5 . 7$ . This will increase his hourly rate from $9. 29 to $9. 82 per hour effective September 27 , 1982 . Motion, Ayes (5) - Nays (0) . GENERAL REVENUE SHARING* STATEMENT Butler moved, Van Nest seconded, to approve City Administrator Benson' s memo regarding the Revenue Sharing Statement of Assurances for Entitlement Period Fourteen. TOWN MEETING-10-21-82* Butler moved, Van Nest seconded to have City � REGULAR MEETING OF THE ORONO COUNCIL - SEPTEMBER 27 , 1982 PAGE 4 Administrator Benson arrange a Town Meeting and let council know what date that worked out better for the majority of the people. SPECIAL BUDGET MEETING* Butler moved, Van Nest seconded to accept City Administrator Benson' s suggestion for a Special Meeting concerning the budget September 30 , 1982 . Motion, Ayes (5) - Nays (0) . FRED HERFURTH LETTER* September 23 , 1982 Butler moved, Van Nest seconded, to accept City Administrator Benson letter regarding the Fred Herfurth sewer matter. Motion, Ayes (5) - Nays (0) . FUTURE POLICE CONTRACTS* OTHER BENEFITING SERVICES Butler moved, Van Nest seconded , to approve City Administrator Benson' s memo regarding the future police contracts and other mutual benefiting service. Motion, Ayes (5) - Nays (0) . ADJOURNMENT Frahm moved, Adams seconded to adjourn the meeting at approximately 8.: 49 P.M. EXECUTIVE SESSION* At this time the City Attorney announced that the Council would now go into executive session to discuss matters in litigation. City Council discussed the settlement agreement between North Shore Marina and L.M.C.D. Butler moved, Hurr seconded, nat to object to the settlement aareement as long as the Marina was required to complete a survey of the dock to prove com�liance �aith code.
